The Supreme Court of Canada ruled in a recent sexual assault case that it was “problematic” for a lower court judge to refer to the alleged victim as a “woman,” implying that the more appropriate term should have been “person with a vagina.”
In a decision published Friday, Justice Sheilah Martin wrote that a trial judge’s use of the word “a woman” may “have been unfortunate and engendered confusion.”
Martin does not specify why the word “woman” is confusing, but the next passage in her decision refers to the complainant as a “person with a vagina.” Notably, not one person in the entire case is identified as transgender, and the complainant is referred to throughout as a “she.”

This is why I worry about the appeal to the Emergency Act decision.
Because the “upcoming” Supreme Court ruling was already written when the case was first filed in Federal Court.
Oh, the appeal court will deliver whatever decision it’s told to deliver. The problem is that the Liberal party is clearly of two minds about this. You may recall the Senate would not vote to confirm the emergency. And we’ve seen a chief judge of the federal court allow a judge to hear the case and rule on it honestly. There is an element in the party that recognizes how wrong this was and wants, if not necessarily to punish the people responsible, to see them comprehensively repudiated by the party and bearing the disgrace themselves. So the final decision may not have been written yet, and if it has, it may not be so bad.
If the case eventually gets to the Supreme Court, and if the Supremes support the Justin/Jagmeet position that invoking the Emergencies Act was justified, then, if PP is elected, he will have the option to invoke the Emergencies Act with little provocation (e.g., against the looney left that will take to the streets to protest his election). Maybe there is an upside to losing the appeal.
