The lawyer for the widow of an American soldier killed in Afghanistan said Tuesday they have filed an application so that any money paid by the Canadian government to a former Guantanamo Bay prisoner convicted of killing him will go toward the widow and another U.S. soldier injured.

Further to this ongoing saga which has come about through a judgement of the SCOC. The judges in their wisdom ruled that the Canadian Government didn’t do enough to protect Khadr’s interests, or something along that line. So here is a question, the people that were injured in the attack described in this article;

are they able to sue the Canadian government for failing to adequately protect them. The first duty and function of a government is to protect the citizens that appointed the said government, that being the case as exemplified by this latest ruling of the SCOC, then all victims of terrorist attacks are warranted to receive compensation due to the governments failure to protect. Any legal beagles out there that want to make a few million dollars the easy way?
I suspect that the Shiny Pony will let that check for wee Omar be signed and, who knows, he may even hand it over himself.

If a Can government really, wanted to avoid a cash payment to this terrorist there are means of doing so, the SCOC does not completely dictate to Parliament; they could have made a non-litigation clause as part of his repatriation to Canada. American officials were careful to add a clause that any money coming to Khadr through publication or benefits would accrue to the Speer family.

I did some research on this. Canadian armed forces were still in Afghanistan at the time Khadr entered the fray. They had been drastically reduced before that, possibly because no end could be seen. I understand 600 were still there. Never the less the Canadians were allies of the Americans. I believe 74 Canadian soldiers were killed by IED. Surely this was an act of treason. Acting against the actual allies, working together with Canadians.
The widow has a $134 million judgment in the US. Assuming Khadr was properly served and the judgment was not obtained by fraud, I don’t see why the widow could not obtain a judgment in Alberta and enforce it against Khadr. See Beals v. Saldanha, [2003] 3 SCR 416, 2003 SCC 72.
