HUGE: SCOTUS grants cert in presidential immunity appeal, orders appellate court to hold issuing its mandate (ruling that denied Trump’s immunity argument) until SCOTUS decides the matter. Oral arguments in April.

What does this mean?…

The Jan 6 case in Washington has been on hold since December—all pretrial deadlines were suspended pending resolution of immunity question. Chutkan vacated the March 4 trial date earlier this month.

In doing so, she indicated she would essentially roll back the clock and allow Trump to make up the time between December hold and SCOTUS opinion. So even if SCOTUS issues a decision in late May and upholds appellate court ruling denying immunity claims, that adds almost 6 months to trial schedule.

In short, the earliest a trial could begin in Washington with that timeframe would be late October. And considering a trial could go 2+ months, that means no conviction on this indictment before Election Day.

And VERY important—the week before, SCOTUS will hear oral arguments on 1512c2 appeal. That will give us some indication of how justices are leaning. If a majority sound skeptical as to DOJ’s application of 1512c2, it’s big trouble for Jack Smith’s DC indictment bc that count represents half of his J6 indictment against Trump.

If SCOTUS reverses how DOJ has used 1512c2, hard to see how he keeps it in indictment. Then Will he go to trial in late October on two vague and flimsy conspiracy charges?

So the war over the border between Texas and the Biden Administration is now in the “Sitzkrieg” stage. Texas Gov. Greg Abbott has essentially declared war on illegal immigration. He invoked Article I Section 10 of the United States Constitution, which forbids states from declaring war except when “actually invaded” (or in such imminent danger as to admit of no delay) and, by implication, allows them to declare war when that happens. He also invoked the Guarantee Clause of Article IV, which requires the federal government to protect the states against invasion.

Abbott’s legal argument is that since he’s being invaded, he’s entitled to respond, and since the federal government is defaulting on its obligations it has no business – it’s basically estopped from – complaining. There was a lot of huffing and puffing at the time, with members of Congress calling on President Biden to federalize the Texas National Guard and the like, but basically, nothing happened. The Supreme Court vacated an injunction forbidding the Border Patrol from cutting the barbed wire that Texas had installed along the border, but – contrary to many media reports – didn’t rule that what Texas had done was illegal, or order Texas to stop policing the border.

Now not much is going on. The big complaints about immigration are mostly coming from outside Texas, places like New York City where illegal immigrants beat police with impunity, being released without bail after being arrested. (The usual endgame for this sort of thing in other societies has been death squads, organized either by police or by police-adjacent groups, taking out those whom the legal system cannot or will not control; we’ll see what happens in New York City.)

But next month Texas’s law allowing the state to apprehend and effectively deport illegals will go into effect, and that’s when the sitzkrieg is likely to end. Following are my (very) preliminary thoughts.

At 4:00 p.m. (EST) Feb. 02, U.S. Central Command (CENTCOM) forces conducted airstrikes in Iraq and Syria against Iran’s Islamic Revolutionary Guards Corps (IRGC) Quds Force and affiliated militia groups. U.S. military forces struck more than 85 targets, with numerous aircraft to include long-range bombers flown from United States. The airstrikes employed more than 125 precision munitions. The facilities that were struck included command and control operations centers, intelligence centers, rockets, and missiles, and unmanned aerial vehicle storages, and logistics and munition supply chain facilities of militia groups and their IRGC sponsors who facilitated attacks against U.S. and Coalition forces.

Election fraud has consequences.

Biden has been talking tough with Iran for many, many weeks, and Iran has repeatedly proven that it is not deterred by his words. But the moment troops were killed, Biden was suddenly under pressure to respond with more than just idle threats. And he did promise a response.

And then promptly broadcast those plans to Iran.
