  9. As we have found out, the Charter of Rights is worthless. There was a debate at the time where no one in power in the provinces or Ottawa wanted to grant the right to property. So we haven’t had it since then.

    Just as every right in the charter has a proviso that cancels it. If the horns are too loud, then no right to assembly or speech.

  12. I have scant hope for Canada. However, the American Founders in their wisdom foresaw all of this. Whether they believed in Him or not, they wisely insisted, in the US Constitution that these inalienable rights came from God. It will be a lot harder to convince Americans of something that evil and stupid or that the government has the right to take them away. Plus, due to one of those God given rights, they are well armed. I guess we’ll see.

      The city of Edmonton expropriated my great grandfather’s farm. It was worth millions, a square mile on the edge of the city. They gave him 70 grand for it, told him “take it or leave it, we don’t care, the land is ours now.”
      That land is now Millwoods. My great great grandfather built the mill after which the subdivision is named, great grandpa farmed that land for over 60 years, and after a lifetime of work, just enough money to buy a tiny house in the city.

    1. What Charter rights violations? According to that very document the government has the power to negate, in part or in full, any right that you think that you may have if it’s considered in the national interest. The very first GD paragraph explains exactly how they can do it.

  29. Well that’s simply false. Canadians DO have the right to own property. It isn’t specifically mentioned in the Charter, but it does exist….and it is the provinces that control it. The question is, however, what is the definition of “property”….because if it means real estate, all land in the country is owned by the “Crown”…..that is, the Queen.

    1. Actually, there is specific land designated as “Crown Owned.” And, Crowned Owned land does enjoy absolute ownership. A good test is “squatters rights.” On private land, a squatter who makes use of the land for 10 consecutive years can claim “ownership” from the rightful owner. However, you can’t do that on “Crown Owned” land. It’s illegal. Interestingly, your government enjoys absolute ownership in that regard. The same is applicable towards aboriginal land. They enjoy absolute ownership as well.

      Your Bill of Rights from the 60’s addresses ownership of private property to some extent, but it is a procedural ruling.

      In short, your claim to private property is, and has always been, at the whim of your Federal and Provincial governments as well as the courts. Your Constitution was designed that way. There have been a number of efforts over the last century to change that…all unsuccessful, however.

      1. All land is owned by the Crown. Even if you have property in “fee simple”, you do not own it. You own rights TO it, but you don’t own the land.

  34. That we don’t have property rights is not a revelation. When the charter was formed it was the provinces that wanted to exclude them.

    Also recall that in the debates during Stephen Harper’s first win, he announced he wanted to bring them back to the table. Though nothing came of it.

  37. Canada signed the United Nations Universal Declaration of Human Rights in 1948. Article 17 says we have the right to own property and not be arbitrarily deprived of it. As I understand, this declaration is Canadian law.

    But Lametti said “absolute”, and there are almost no rights that are absolute in Canada or any other country.

Bottom line is if they can freeze bank accounts because you participated in a legal protest, or they can use happenings south of the border to take away your gun ownership right, or they can suspend basic civil liberties to apparently protect your health- they can do what they want. This is no longer up to politics. Canadians need to stand up. Sadly most will not and simply do not care. They will not realize that they have lost their freedom until it is gone.   41. I have a pamphlet in my drawer from Harper’s first election as leader of the PCs. Property rights are one of the bulleted items. We went to a rally in Cornwall and applauded (like the fools we were) when Harper committed to enshrining property rights. We spent countless hours working for the local PC candidate, Pierre Lemieux, and we did cartwheels when the Conservatives won.

    So, we waited, and waited, and waited… and when we asked “what about property rights?”, we got “Well, not now … we only have a minority”. Okay, we’ll wait.

    So eventually Harper got his majority, and when we got ahold of him, Lemieux & Co., and reminded them about their commitments, not only was there was zero enthusiasm for property rights, but there was even less for rural rubes like us.

    I still have Lemieux’s letter. A snake would have a hard time following his evasions.

    1. That’s exactly what happened to gun owners. Harper promised in Parliament and in writing that his party would re-write the Firearms Act. Gun owners mobilized, and helped give him his majority.

      No attempt whatsoever was made to re-write the Firearms Act. They allowed a couple of extremely weak private member’s bills to proceed, knowing that those almost always fail. There was NO gov’t sponsored bill put forward. Then, when we called them on it, it was bait-and-switch time: “Oh no, we never promised that, we only promised to end the so-called long gun registry, you ungrateful louts, you.”

      And even that, they screwed up badly: Quebec got to keep a copy and we KNOW the RCMP illegally kept a copy too.

      I also feel deep shame that I cheered for them, bought memberships, made donations… I will never vote CPC again under any circumstances.
