    On Wednesday night, Fox News Senior Judicial Analyst Judge Andrew Napolitano issued a blistering critique of Hillary Clinton’s ongoing controversy surrounding the use of a private email account while she was Secretary of State. Appearing on Fox News’ The Kelly File, Napolitano argued that Mrs. Clinton may have committed a “felony” and “the other way that she’s in trouble is a person who knowingly and willfully destroys or conceals government records.”
    One is if she retained on her personal email account using the Clinton server at her home or near her home in Chappaqua, New York, classified materials, classified documents, she arguably violated the same statute that General Petraeus has agreed that he will plead guilty to which prohibits retaining classified information in a non-government non-secured way. That’s a misdemeanor. It’s not a felony. There’s no grand jury. There’s no trial jury. But the punishment is up to a year in jail and $100,000 fine for each document.
    Napolitano then went on to suggest that if Mrs. Clinton knowingly destroyed government documents on her private email account, she may have committed a felony, which would disqualify her from serving in elected office:
    The other way that she’s in trouble is a person who knowingly and willfully destroys or conceals government records. This is a felony punishable in jail by up to three years. And are you ready for this? Disqualification from holding public office under the United States of America in the future.

By waiting to call today’s press conference until the 24 hour advance notice for press credentialing at the United Nations had already ended (reporters were given about 18 hours notice), Ms. Clinton effectively ensured access to the press conference would be restricted only to journalists already credentialed by the United Nations.
    As MSNBC reporter Alex Seitz-Wald explained today in the video below, had she held the presser elsewhere, everyone who wanted in would have gotten in, including those political reporters who likely know the most about this story and are therefore prepared to ask the best questions.
    “It’s appearing at the UN, which has a notoriously difficult credentialing process. So there’s going to be a restriction on the number of reporters who can come in. You had to apply 24 hours in advance for press passes. So I don’t know if it is intentional or not, but there will definitely be a limited number than if they held it at, say, a hotel or somewhere else in New York where they could be expected to be mobbed by every reporter and their mother in the city.”

    Few people could rival BillyJeff at dissembling. He was the best liar to hold office in my lifetime. Hillary is not in his league and and that alone is going to hurt her aspirations.
    Besides that, a lot of people just don’t like her. She is so nasty that even the secret service consider being assigned to her protection team a punishment detail.

    1. She used Bill for cover.. He had the server setup by the SS and it was SS secure. That opens up the existence of Backup and archive. The archive retrieves all her Emails, Run Hillary
    2. But if the Presidential privilege fails. She stated that she had NO classified State Business on her mail.. That’s an easy lie to prove if the Department of State now claims that “any” of her email are Classified.
    3. She used the word “Deleted”, twice in my count, and she stated
    that her Attorney was tasked with oversight.. Nice to have put a lawyer in deep shit.
    NOTE: Converting Hard Copy paper to data (was data) will take about 2-7 days by any service certified to handle legal evidence. Does not take months & cost millions. The data can then be searched & sorted. Hard Copy was 1970’s obstruction.. NOT

Hitlery has the refined reflexes of a master criminal – she knows if she can deflect the immediate charges, her media will disappear it from the news cycle in a week or two and the voters really aren’t paying attention anyway – it won’t hurt her – it’s like throwing feces at a turd and thinking it makes a difference to the stink it is already putting off.

  10. Hans, the problem is that the evidence has been thoroughly deleted by now. The original hard drive has no doubt been degaussed after the non-incriminating emails that Hillary kept were transferred to a new one.
    Any trial would end with Hillary walking away because it will a case of the DA said, Hillary said. Unless someone hacked the server before any deletions occurred and can provide the prosecution with the email where is the evidence? Even then, the courts demand a chain of custody of the evidence by law enforcement and the prosecution would be presenting evidence gathered during commission of a criminal act without a search warrant or court order for its procurement. Any decent lawyer would have the case thrown out.
    The only place this will be tried is in the court of public opinion and considering that this same public elected Obama twice I’m not expecting a rational verdict.

    As a former member of the intelligence community I felt a deep shadow fall over me as I read about Hillary Clinton’s use of an outside email service instead of the more secure and private State Department system. She did this for obvious reasons, to keep her communications out of official channels and away from the prying eyes of her political enemies (the Republicans…). One might sympathize with a politician in her situation.
    However, the Secretary of State of the United States of America is the number two intelligence target IN THE WORLD, behind only her boss, the President. To tap into her communications guarantees lavish rewards and promotions to the intelligence team who does it. All eyes are on her, like vultures, waiting. Yes, it really works this way.
    An email system such as the one described is considered “easy pickings.” After seeing the details in the press, my first conclusion is this:
    Russians and the Chinese were reading her emails. In real time.
    I’m not saying maybe or perhaps.
    They were.
    The Russians and Chinese have sophisticated intelligence services, with sophisticated spotting, assessing, targeting capabilities. They have thousands of people who work these issues. Ms. Clinton may say that she didn’t talk about classified matters, and she may think this is correct. But any intelligence professional knows its impossible to “talk around” a topic effectively (despite what you might see in spy movies…). With a high value target like Ms. Clinton, an intel service will have teams of analysts and psychologists analyzing every word she says, with absolutely clear context.
    It is also likely the French, the Germans and a host of other sophisticated services were tapping in. There will be no trace of their reading it, no logs, no records. This is an easy lift.
    On the “perhaps” list, the Mexicans, the Iranians, the Narco Cartels, and the more sophisticated backers of Al Quaida, along with various computer-savvy nuts from around the country and around the world. Who else was getting it? Anyone the Chinese or the Russians thought should get it!
    Let’s talk about information. Back in the day, I was told if you have a good source but no particular requirements from your reports officer you ask about “Plans and Intentions.” We are talking about plans and intentions of the U.S. government, negotiating positions, possible movement of resources that reveal policy decisions, actions that if known could be circumvented or countered.
    We don’t know the content of these emails, and of course a major part of those have been deleted so we may never know. We have to assume the worst, so let’s ask some questions:
    Did Putin know what our reaction would be before he invaded the Ukraine?
    Did Al Quaida know our intentions in Benghazi before the attack?
    Did Iran know our proposals before we started negotiating this latest agreement?
    How about any trade or political agreement where Russia or China might have an interest? Compromised? How much money, positioning power, or benefit did the American people lose because the opposite side new exactly how far to push? These are potentially trillion dollar issues.
    I wrote recently about a failure of Ms. Clinton’s leadership during the Benghazi attack. But this reveals a major failure in her understanding of simple security procedures, to the devastating loss of her country. It always seemed to me that President Obama has always gotten his clock cleaned in international negotiations. Could it be because his Secretary of State was compromised?

  13. Politics is the natural habitat of the morally ambivalent but the Clinton’s have made their habitat into a sanctuary for sociopaths. No one with the possible exception of Obama can compete with Mrs Clinton for so effectively personifying evil. The Court Eunuchs of the MSM are as culpable as the Clintons, But then they are all part of the Evil Party. Too bad the Stupid Party feels they have to grovel for invitations to their cocktail parties while eating their own.

If the Sack of Sh….er Secretary of State sends an email to a secured government email recipient would there be a copy of her email on the government server even if she destroyed her server’s hard drive

    Not a IT expert. Hillary was the head of State. That would normally mean that her inbox (she doesn’t reply to most) would have significantly more emails than her out box. Hillary has only provided the emails she sent (outbox)
    Example:
    If a request for additional security was made from Libya. That request & the action taken, would be reported up the chain of Command and end up in Hillary’s Inbox…She would read it and if she didn’t have any problems… no response was necessary.
    It is absolutely necessary to see all incoming & outgoing
    emails.
    .

  27. Anonymous I didn’t ask the question in defense of Hillary. The woman is guilty as sin and should be getting three squares a day for the rest of her life courtesy of the American Justice System. My question was my non techie attempt to show just how foolish she is if she thinks she could get rid of evidence by using her own server. Not that anything is going to happen until Obama is gone from office but it would be nice to see Hillary in an orange jumpsuit.
