  4. Yeah Hudak did an ol 180 on this issue the fastest I have seen in a while, pretty much winning the politician speaking out of both sides of his mouth award for the year. Not suprised.
    McGuinty has done his usual buying votes, and “promises” again now that an election is rearing. His polling is slowly increasing as well. If he gets in again, I’ll have to wonder at the intelligence of Ontarians.
    Hudak needs to get on an energy policy that makes sense, I think this will reach voters more than anything.

    The PC’s are way too PC. I’ve never voted for them, not even for that Mr. Good Bar, M.D. Harris.
    Refooorm is better than another little Blue McGuinty.

    It’s simply a stalling tactic to satisfy those who are critical of the HRC’s,at the end of the year,safely past the election date, nothing will be done to the HRC except some cosmetic changes.
    So, from the comments here, am I to assume Ontario has a choice between McGuinty, and McGuinty lite?

  8. I notice it’s being handled by lawyer Andrew Pinto (“the Pinto probe”), who was in my class at University of Windsor law school. Remember the other review a few years ago headed by an academic from Windsor law? I’m not optimistic about any real changes.
    And how come I don’t got no probe?

  9. Witness the reason I didn’t vote for Hudak in the party elections. Spine of solid goo, morals of a weather vane.
    Note my friends that this 180 is POST Rob Ford victory in HawgTown, proving that the 416 unteachable Annex Left does -not- hold all the cards even in Toronto any more.
    I am disgusted, and my PC guy Toby Barret will be hearing about it. Sadly I’m still forced to vote PC, the evil prospect of a continued crooked Liberal government is only overshadowed by a return to the insane NDP.

  11. In related news, the BC Human Rights Tribunal has its list of exceptions to their code:
    – Hiring restricted to women.
    – Restrict hiring to persons of Aboriginal ancestry.
    – Hiring restricted to persons 16 to 24 years of age.
    – Hiring restricted to women, including transgendered women, for all staff position.
    – etc

    I hear you. And that’s too bad. Barret is one of the more conservative Conservatives.
    I’m staying home on election day…and so are my family and friends and most of the OLA folks in this riding.
    Friend of mine in the Lanark LA said it well yesterday when he talked about the latest poll results that have Hudak slipping back neck-and-neck with The Liar:
    “Took 8 years of McGuinty to wake up the stupid population – and I guess it’s going to take another four to get the stupid PCs to wake up.”

  15. My sympathies to the people from Ontario for only having a choice between McGuinty and McGuinty lite. It is not only Hudak dropping in the polls, but Wildrose is slipping in Alberta also. I guess the people have not suffered enough yet.
    On the other hand, the polls did not look good for Rob Ford either.

    Being on the other side myself I would say, “If these damn “atheists” would pick up their Bibles and actually apply Biblical principles. Being a shallow thinking atheist on tax payers dime does sit well with Christian conservatives, and there are many of us!!!

  19. When silence on free speech rights is the policy of the three parties that matter, you can bet the fix is in.
    The emergence of sufficiently PC police administrations and justice resources shows that shifting the dirty
    work of the HRCs into the covering morass of everyday police work and the courts is going to be
    undertaken in the near future. There is every indication that the government in Ottawa is tinkering with
    legislation re the internet and the “control” of free speech that will find favour with all interested parties
    except the few free speech advocates with high public profiles or the ordinary citizens/usual victims.
    The HRCs will remain, unnoticed, quietly victimizing the powerless as per their original mandate.

  20. For non-Ontarioans and some locals, its important to remember the “conswervatives” in Ontario are the Progessive Conservatives, and have always been liberal-lite. (I’m leaving that typo in -what a freudian slip!…:) Very little Hudak says has made me want to vote for him, and he’s going to have to work hard to win my vote back. Watching Randy Hillier sit there and squirm on the HRC question, completely eunuched, tells me buckets about the direction Hudak is taking the party. Ontario has no future.

  23. Truthfully I have no time for religion in politics, because its always the smokescreen used to cover the stuff they don’t want you to see. Which is always about -money-. My money, going to government specifically.
    But this Hudak thing is nothing to do with religion. Its Hudak CAVING on a basic principle of freedom in order to appease people who hate his guts. So its immoral, cowardly and utterly futile all at the same time.
    And I still have no alternative to voting for his party. Spoiled ballots, staying home or voting for anyone but the PCs are all victories for the Liberals. Which sucks, because we can’t afford to let those saboteurs win again.

    In Ontario, we actually have a “none of the above” option. You can formally accept your ballot, then decline to cast a vote with it. This is officially recorded as “declined to vote” and is not treated as a spoiled ballot.
    However, I need to see who tosses their hat in the ring in my riding, come the end of the month. There is a local independent that is gaining strength. I might go with her.

  28. I’ve posted a long list of the reasons the HRCs and HRTs are unjust before, and I managed to find one from SDA on August 16, 2009:
    – lack of due process
    – right to a fair trial does not apply
    – no presumption of innocence
    – complainants get the full resources of the state working for them, while targets of complaints are on their own
    – no legal aid for the targets
    – complaints can be launched in multiple jurisdictions, to see what “sticks to the wall”
    – hearsay evidence is allowed
    – documents are frequently not disclosed in a timely manner (if at all) and/or have portions “redacted”
    – no search warrants are needed for investigators
    – investigators sometimes obtain information from police who have obtained warrants
    – truth is no defence to any expression
    – no “costs” rule for unsuccessful or frivolous complaints
    – cannot file lawsuit for malicious prosecution
    – entrapment is routinely used on targets of complaints
    – tribunal overseers sometimes want to hold proceedings in secret, and have been known to attempt to exclude the target of the complaint from his own “trial”
    – judges are appointed for life and are independent, whereas HRC tribunal heads are not
    – HRC personnel are often radical activists with a personal agenda or vendetta
    – HRC proceedings are considered “remedial” even though there is no difference between fines from HRCs or from real courts
    – “human rights” law is considered quasi-constitutional, even though it is made up on the fly by persons with no legal training
    The last point apparently stems from an offhand comment by former chief justice Antonio Lamer back in a 1982 case called Heerspink, and it was based on absolutely no legal foundation whatsoever.
    There’s more:
    – lack of intent is not a defense (this is a slap in the face to a fundamental aspect of the justice system)
    – some “hatreds” are protected against, like race and sexual orientation, but others aren’t, like wealth, occupation, American-ness (many actions have been brought against white Christians, none against persons of other religions)
    – section 11 of the Charter of Rights describes the legal rights of persons “charged with an offense”, but HRC victims are not charged with an offense (likely a deliberate omission on the part of PET)
    Even Supreme Court justices get tangled in knots trying to work out this crap; see Eaton of 1997, in which it was said that segregation can be protective of equality and violative of equality depending upon the person and the state of disability; and M v. H of 1999, where they considered that the law might be “overinclusive” and “underinclusive” at the same time.

From a comment on the Star story by ‘biggarthomas’ @ 4:45 p.m.: “The short answer to those who have speculated about whether utilizing the Charter of Rights and Freedoms would be an adequate substitute for using the the Ontario Human Rights Code. The answer is a no. The Charter applies to the governments and legislatures of Canada. Human Rights law applies to “private” as well as governmental matters. Most human rights cases are filed against individual employers, landlords and service providers (doctors in relation to patients, stores in relation to customers etc.) Those cases cannot be heard under the Charter.”
    This seems to be the official theory, but it’s garbage. The purpose of having a Charter of Rights is to delineate the rights of all Canadians at all times in all circumstances. The right to life is what makes murder illegal, so it’s idiotic to say that the Charter only applies to governments. (I’m not criticizing the commenter, who was just reporting)
    Another big problem with alleged “human rights” law is that it violates genuine human rights like freedom of expression and freedom of association.

    Yup. The PC bible was authored by 25 year-old fartctchers with Pol Sci. degrees. The Toronto media controls the PCs. Everything they do and say is predicated upon what the press reaction mught be. Real Leaders d it the other way round – they control the press.
