If someone finds what another person has said is ‘NOT offensive’ – then, the conclusion is that the statement is NOT legally offensive.
This reduces a legal system to pure randomness. A legal system is supposed to operate within normative standards not randomness.
Furthermore, to operate within normative standards, the legal system has to move out of subjectivity into objectivity. It cannot define a legal or illegal action on the basis of what an individual subjectively ‘feels’; it must only deal with objective facts that are observable as such by a reasonable number of people.
And, of course, to outlaw any discourse that mind ‘offend’ people is to freeze a people into a regressive anti-civilization, a people who lack the ability to doubt, to question, to explore, to examine, to compare, to evaluate. That’s what censorship does – it denies the mind. And that mind is the basic property of our species; it is what sets us apart from all other species.
Funny how the lefties think some library or school or store deciding not to carry a certain book constitutes “censorship” but the heavy hand of the government coming down on an individual citizen (as in the cases of Steyn/Levant and the Truth Tribunals) is just fine and dandy.

drained brain – heh, yes, the HRC are, in themselves, violating the HRA. They are promoting hatred against people who think and who freely express those thoughts.
However, back to my point that the Islamic texts are themselves, if you use the HRAct, in violation of that Act. They specifically promote hatred against specific groups of people based on an ‘identifiable property’, namely, their religion, Jews and Christians. [Irwin Daisy has posted many excerpts from the Islamic texts so I won’t repeat them; he knows the texts far better than I do.]
But, these texts also promote hatred and contempt for Muslims, because the Jews and Christians will, justifiably, if one reads the texts and listens to the Islamic sermons, feel afraid of the stated murderous intentions in those texts and sermons.
And, Jews are a minority.
So- why doesn’t the HRC find these texts, and sermons, offensive?
We are back to ‘square one’. The Islamic texts refer to a social and political mode of militancy that emerged in the 7th century as a reaction, I claim, to the expanding agricultural settlements of the Byzantine empire. This social and political mode was then FROZEN by its being redefined as a religion. And, moreoever, a religion whose axioms were defined as ‘direct from God’ and removed from debate, interpretation, dissent, discussion, analysis. That froze the Muslim society; and froze its mind.
They have to break out of this – and it’s not an easy task, when you have set yourself up within a knowledge base that is frozen in the 7th century. Some Muslims are trying to do this – and frankly, they require the help of the West. If we assist the fundamentalists in retaining Islam as a frozen knowledge base, by rejecting our freedom of speech and thought – then – we are assisting them in their onslaught against us.

Reading Liblogs makes me just shake my head, These are fellow Canadians and we must love them but the hatefullness and spite and namecalling and outright lies and visciousness scares me a lot.
These radically HATE conservatives (that’s millions and millions of fellow Canadians). It has gone way beyond political discourse in my opinion.
And every radical anti establishment or communist/socialist group in this country is rallying to the Liberals. They used to go NDP as the communist choice but the Liberals are now the home for the close minded hateful special interests.
Not to mention pretty well any Liberal who was somehwat credible and balanced in Dion’s caucus has announced they are quitting. The “front runners” are novices with no political or public service experience whatsoever like Ignatieff, Dryden, Hall Findley and the Liberals “stars” are also the spiteful showboats like Brisson, Turner, Dhalla.
Can you name ANY credible experienced balanced non radical Liberal who will be left in the caucus when the election is called?

I think it’s important that Ezra is a lawyer and that he has really done his homework. He can rebut the misinformation of the AHRC, he can challenge them on their invalid allegiations.
Again, where is our MSM on this important case? Not a word out of them. Silent – while our freedoms are eroding.
I think an important point re Ezra’s case and the AHRC is that if Muslims were offended by the cartoons they were free not to purchase the magazine. As a woman, I am offended by some of the nastier porn available, but this type of thing is still published, and 18+ are still free to purchase. It would have been different if the images had been displayed on TV — which is in everybody’s livingroom and thus the images could have been accidentally viewed. But the Western Standard was available through subscription or via newsstands where it was not always easy to locate. No Muslim could have been offended had he/she not gone out of their way to obtain the magazine. Re the question of whether or not non-Muslims seeing the cartoons are inspired towards hate — surely the cartoons (which most Westerners found to be quite innocuous) are not nearly so provocative as the attempt of this Muslim group to squelch free speech.

I more than agree. They must be brought forward.
As I’ve stated on many occasions, the Islamic ideology, as expressed in the trilogy (Quran, Hadith and Sira) is the impetus for violence against non-Muslims, specifically Jews, as well as women.
Islamic defence, to this point, has been the typical, ‘out of context’ charge. Which is a ridiculous claim since the Quran is not chronologically ordered and it has absolutely no context without the Hadith and Sira. The commands and rewards for violence do not have period, or place limitations either.
The other defence typically used is ‘kitman’ (telling half truths in order to deceive).
The Quran is divided into two periods. The early period was when Mo was in Mecca. The verses attributed to this period are moderate and some even seem reasonable (ie, “there’s no compulsion in religion…” and, “to you, your religion and to me, mine…” etc.). Which sound nice and fuzzy. Although, when put in context, often the meaning changes. For example, the second verse refers to Mohammad’s acceptance (the Satanic verses) and later his rejection to worship the other Meccan gods along with allah, in order to make peace. This changes the meaning from the way Muslims typically use this verse. “See, Islam is tolerant of other religions,” they say. When in actual fact, Mohammad used those words in breaking a peace pact.
To make matters worse, the violent verses from the Medina period abrogate the earlier Meccan verses. For example, Quran 9:5, “But when the forbidden months are past, then fight and slay the Pagans wherever ye find them, and seize them, beleaguer them, and lie in wait for them in every stratagem” abrogates no less than 124 less violent verses.
Islam is dualistic, because the Quran is dualistic. A Muslim can hold two verses that contradict each other to be true. So, depending on what a Muslim wants to believe, or more importantly – wants the infidel to believe – they have a choice.
Regardless, there are literally hundreds of verses in the trilogy, especially to do with Mohammad’s words and actions, that can be proven to have been used throughout history, up to the present day, to incite unbelievable hatred and violence.
Those in glass mosques, I suppose.
ET, the Canadian MSM in giving coverage to Ezra would be shining a light on their own cowardice. He boldly published the cartoons feeling it was a free speech issue while they spinelessly censored themselves. Aside from a few perfunctory op-ed pieces, I’m sure they hope he’ll fade away as soon as possible.

I’d bet that the overwhelming majority of those hits come from Americans, directed there by the LGF coverage.
For a Canadian to care about this they would have to be engaged in current events here and abroad, and to feel some sort of imminent threat to themselves. Neither one of these is the case sadly. The people who post here, and on Ezra Levant’s site, and on BloggingTories, do not represent the average Canadian. Not even the average Conservative Canadian. Sad, but I believe true.
A single event like Ezra Levant’s amazing performance and broadcasting of the HRC interview cannot reverse decades of decay.
However, it is the persistence of the message that we get out there that can win in the long run. This single event won’t do the job. Steyn’s thing will be another. I’m sure there will be more. The cumulation of months and years of us hammering home the message that Canada is evolving into much less than what it used to be might eventually break through the “hear no evil” public and self-serving media.

I think it is wise to remember that Levants present issue is a specific rebuttal of the posting of the cartoons in his publication, however the greater and more important issue here is the role of the HRCs and their impact on free speech in general. Let’s not get too tied up in the Muzzie thing and ignore the broader ramifications this may hopefully have.

The reason is that Dawg is not amenable to logic or reason or facts. What he’s doing on Thompson’s blog is akin to the Pigs’ soothing down the concerns of the animals in Orwell’s Animal Farm.
Dawg is trivializing the issue, informing us that after all, the HRC isn’t actually a court and making it almost akin to a chat in the local coffee shop. It isn’t; you are called to appear by an official regulatory body of the provincial and Canadian governments. You can be fined and charged by this body; it’s no inconsequential coffee conversation.
Dawg is furthermore, informing us that it seems quite reasonable to have ‘first level’ bodies that sift through conflicts – making these HRC something like a secretarial vetting before one goes to the Official Legal System. Wrong again. These HRC operate and make final judgments, with no appeal process, according to an official Act and are not the ‘first step’ in a sifting legal process.
And, Dawg is ignoring the fundamental right and necessity of free speech.
I very much doubt that he, a confirmed leftist and a member of the Cloud Dweller Set, will be able to see practical and rational reality.
