The U.S. Supreme Court has ruled that states have the authority to protect individuals who suffer injuries in trucking accidents. This decision stems from a trucking accident lawsuit – plaintiff who suffered severe injuries after his parked vehicle was struck by a truck operating under the authority of Caribe Transport in Illinois. The ruling has significant implications for the trucking industry, particularly regarding the potential liability of freight brokers and the safety standards they must uphold
The Supreme Court’s decision – brokers may now face increased liability for the actions of the trucking companies they contract with, particularly if they fail to conduct adequate safety checks.
Recent decisions – freight brokers can be held liable for negligently hiring unsafe motor carriers in trucking accidents, as confirmed by the Supreme Court in the case of Montgomery v. Caribe Transport II, LLC. This ruling allows state-law claims against brokers, marking a significant shift in liability exposure within the trucking industry.
Owner operators and firms are going to face liability insurance premium increases up from $750k per driver to $2million per driver.
Do you have ANY idea how many (mostly illegal) drivers in CA have no insurance? And no assets whatsoever? These sketchy trucking companies and brokers will just get sketchier and sketchier … they’ll insure themselves then cancel insurance, transfer ownerships, and move assets beyond the reach of legal judgements. They’ll go bankrupt and be doing business under a new shell company tomorrow. The victims will never get paid.
The only answer is LONG criminal prison sentences for everyone from the driver all the way up the food chain of who put these idiots on the road.
These wrecks and deaths can no longer be termed “accidents”. No, they are preplanned mayhem on the road … acceptable collateral damage. Because human life is cheap in the hellholes where these people originate.
I have every confidence in the Trial Lawyers Association, specifically,m the personal injury lawyers, to hunt down every penny they can squeeze from the trucking industry.
Forget the long criminal sentences, capital punishment is the more effectove solution as Buddy says above.
