    1. Cops believe a certain provision in the Rules of the Road Regulations gives them permission to break any traffic law they desire for any reason they decide. Obviously, I don’t interpret it as liberally as they do.

      1. 64(1) Where, considering the circumstances, it is reasonable and safe to do so, a peace officer driving a motor vehicle may, in carrying out the peace officer’s duties, do one or more of the following while not operating a siren:
        (a) drive the motor vehicle in excess of the speed limit;
        (b) proceed past a traffic control signal indicating stop or a stop sign without stopping;
        (c) contravene any other provision that is prescribed by the Act, this or other regulations or a municipal bylaw governing the use of the highways.
        (2) Where, considering the circumstances, it is reasonable and safe, a peace officer may, in carrying out the peace officer’s duties, park a motor vehicle, while not operating any flashing lights or siren, contrary to any provision that is prescribed by the Act, this or other regulations or a municipal bylaw governing the parking of motor vehicles

        1. (3) At the end of a duty shift, officers will be allowed to greatly exceed the speed limit as they drive on 14th street while returning to the police station.

    2. A few years back I complained that CPS wasn’t setting a good example doing things on the road (for no good reason) that everyone else would be ticketed for.
      Referencing that Regulation, they responded, “We can do as we damn well please.”

      And regarding Larry’s comment below – true story. My brother had a brief encounter with an RCMP officer that had stopped his cruiser next to the Yield sign, blocking a lane that accesses the Lougheed Highway in southwest BC. After waiting for at least a minute for the officer to move along, he got out of his car, walked up to the driver’s door, and asked the officer what he was doing. “Monitoring traffic” was the answer.
      “No you’re not,” says my brother. “You’re impeding it. Now will you write yourself a ticket, or would you like me to write one for you?”
      The officer promptly rolled up his window and sped off.

  3. L – The police officer should upon finding that out should have:
    1. Upon having the lack of mud flaps on his car issued a ticket to himself and thanked the citizen for pointing that out acting out of civic duty. Or
    2. Changed the first ticket to a warning one in respect of the citizen doing his civic duty. Issued a warning ticket to himself.

    Equality under the law is fundamental to the Rule of Law. That is integral to the term ever since the Magna Carta 1215. Respect is mutual or it doesn’t exist.

  5. To the best of my knowledge the requirement is for rear mudflaps, which the guy had on his truck already. FFS…

    1. Mudguards
      64(1) A motor vehicle or trailer must have a part of its body, a fender or a mudguard that covers the width of each tire.
      (2) The body part, fender or mudguard referred to in subsection (1) must be above each wheel and
      (a) extend downwards at the rear of each axle or axle group to at least the centre line of the axle, or
      (b) be a distance away from the ground equivalent to at least 1/3 of the horizontal distance from the bottom edge of the mudguard to the centre line of the axle, but not closer to the ground than 150 millimetres when the vehicle is loaded.
      (3) In addition to the requirements of subsection (1), the following types of vehicle must be equipped with rear wheel splash and stone‑throw protection that complies with SAE Standard J682:
      (a) a commercial vehicle or combination of commercial vehicles that is registered for a gross weight of more than, or that weighs more than, 4500 kilograms and that is not a bus;
      (b) a bus;
      (c) a trailer.
      (4) A passenger car is not required to have a mudguard.
      (5) This section does not apply to a trailer designed and constructed for drive‑on and drive‑off low loads.

    2. There are “work-arounds” to getting what you need at no cost from the AKP.

    3. If you look closely at the offending vehicle he does have mud flaps, and it looks like they go to the centre line of the axle. But if you look at the cop truck the “mud flap” is built into the quarter panel.

      Also, the guy would have needed to have a 3/4 tonne truck with a registered gross weight of 4,500 kg or more. That truck (without a trailer) does not weigh that much. If that is a Toyota Tundra (looked like it), they are 1/2 tonne vehicles and do not require mud flaps.

      I’m not a lawyer but I would contact Toyota and tell them their trucks are improperly registered. Maybe they would hire a lawyer to defend this guy.

  8. A great example of how those people from other countries bring their sense of “how things work” to tier 2 Canada, I expect the worst from those who seek to impose their way of living upon us. I’m including police from the UK in this as well, they seem to enjoy a weird love for the foreign king/queen and their associated inbreds.

    ie; flaps not required if vehicle body meets height of axle centerline.

    They do extend non-rust life of body panels where so-called governments salt the roads to death in winter,
    and spring, to keep gov’t ‘workers’ in the heather since it’s impossible to contract out as private sector in Canada.

    Calgary cops are better than most,
    wouldn’t pull over a vehicle just for that, so…

  12. NEVER in over 60 years heard of mudflaps on the front of a pickup.
    the entire *purpose* of mudflaps is to stop road debris esp mud from clinging to the wheel and being flung off the back side high up into windshield of the vehicle following. most important at higher speeds that sends the mud even higher when it is most a hazard.
    the above NEVER happens off the front wheels. the mud and rocks ALL gets knocked down with the undercarriage of the vehicle. as such no mandate or need for a mandate. or an oinker making things up.
    this is utter pure B.S. B.S. B.S.

  14. I don’t see the point of that argument.

    All these nuances are something to argue in court. Contest the ticket and you have all this ammunition listed above in the other comments. I really doubt there is a cop in the country who would change his mind about a ticket after an argument like that, it’s a lot like referees, it’s pointless to argue like that. In fact, sometimes the ticket is just a warning. So he eliminated that possibility by arguing forcefully. Arguing like that likely eliminates any sympathy.

    However, taking a picture or video of the cop’s vehicle cannot hurt. Doesn’t hurt to discuss things politely and calmly.

    When I was younger, I got maybe 6 tickets, most speeding/stop-sign, and one expired sticker violation. Not one was a warning, all were fines.

    But in the last 20 years, I’ve been pulled over maybe 7 times and paid zero in fines. One was for driving with a dog in my lap, 3 for speeding (1 highway, 2 on local roads), one for going though a stop sign. 5 of those were warnings. One I contested in court and never got a court date, it was just dismissed. The other I contested in court and won.

    1. Last year i lent my truck to my girlfriend. She got a red light camera ticket turning left. Beside her in the other lane was an Alberta Sheriff vehicle on the photo, judge dismissed the case.

    2. The cop has to go to court. He’s paid to do it. It’s his job.
      If someone contests a ticket that’s their right. Win or lose it’s a waste of a taxpayer’s time.
      Did I mention that the cop is paid to be in traffic court as a part of his job?

      Back in the day(’70s), when I was a young man and Detroit muscle cars were a common sight on Calgary streets, the cops use to pull over gearheads and give them the exact same ticket for having mag wheels that extended too far past the fenders.

      When I was in Sir Winston Churchill High School I lent my best friend $400 to buy a guy’s used 1971 Plymouth Hemi Road Runner.
      The guy who sold it to my buddy had just graduated from the police academy.
