Right now, thanks to a 2013 Supreme Court of Canada decision in R. v. Pham, judges can consider a criminal’s immigration status when deciding a sentence. That means a non-citizen can receive a reduced sentence to avoid triggering deportation.
TBF … the newcomers simply don’t yet understand Canada’s laws. We need to allow them to repeatedly break the laws at least two dozen times before actually punishing their crimes. Because just think of all the crimes committed by the white settlers who came to Canada …

It’s probably not a good idea to use fundamental racism as a guiding principle in determination of a law precedent. The message is:
“They don’t know any better. And, we have to coddle the poor dears.”
It’s an elitist guilt reflex based mostly on propaganda and retroactive historical editing. It displays the supporters of this decision as racist elitists, and the recipients of this gift as opportunists. That’s not a good foundation for legal precedence.
