OTTAWA — The Supreme Court of Canada has found the Liberal government’s federal carbon tax law to be constitutional, dealing a blow to the governments of Ontario, Alberta and Saskatchewan who had been fighting the law in court.
In a 6-3 split decision released Thursday morning, a majority of justices found the law is constitutional because reducing greenhouse gas (GHG) emissions is a matter of national concern, and the law is focused on that narrow purpose while still giving provinces the ability to come up with their own solutions.

The discussion misses the central issue. What actual good will the carbon tax do? If implemented as planned, what will be the impact on global temperature?
Temperature is not measured in tonnes of CO2 emissions.
One tonne of CO2 emissions raises global temperature by roughly 0.00000000000155⁰C. The feds tell us that if implemented as planned, emissions will be cut by 90 mega tonnes by 2022. Simple arithmetic shows the impact on temperature:
90,000,000 tonnes / year x 0.0000000000015⁰C / tonne = 0.0001395⁰C / year or 1⁰C per 7176 years.
Is this the best use of our limited resources?
The problem is our government buys the science and our judges have no clue the real science is.

There is a conjecture that doubling CO2 concentration in the atmosphere will increase the temperature (anomaly?) by a measurable amount. The IPCC thinks this may be between 2.4 and about 8 degrees. Recent temperature records suggest it is lower, somewhere around 1 degree C.
So much potential thrown away for nothing. The “climate change crisis” will eventually be recognized as the greatest mistake of all time. Our government’s energy policies are destroying Canada.

Not this. It allows a legislature to keep an act in place even if the act has been found to violate certain specified provisions of the Charter.
This case turned on the national concern doctrine, which basically says if there’s a problem of national concern and the provinces are unable or unwilling to deal wiht it, then the feds can legislate subject to certain conditions. The SCOC effectively re-wrote the constitution to apply the doctrine in this case even though it was never intended to cover this matter and even though the legislation is clearly a matter of provincial jurisdiction.
I am still reading it but Justice Brown’s dissent is admirable, coherent and, in my view, correct. The implications of the ruling are vast but these judges don’t care cause they don’t follow the law or precedent and just find the way they want to find to achieve the result that accords to their political preferences.

YES THANK YOU. That was the real betrayal-and incompetency. I mean if you’re not willing to take some heat for a controversial policy proposal, don’t propose it. What would be even better would be actually sticking with it. Same thing with the coal mining betrayal by Kenney.
I think he is in over his head, and the bureaucrats are just leading him around by the nose. He is a weak leader at a difficult time. Others are making decisions for him.

Did anyone expect any different? The Supreme Court is made up of failed lawyers. They were appointed based on their skill and ability to raise funds for the Liberal Party. They will side with their benefactors every time. Even cases where they “rule against” the government are set up to benefit the Liberals in one way or another.
Given that Canada’s electrical grid is 83% non-(Co2) emitting (63% hydro, 19% nuclear, 1% unreliables). the primary tax target of the Spawn’s government (and nationwide idiot complex) policies are heating and transportation for one of the coldest and most spread-out nations on the planet. If Canadians could scrape together enough brain cells to vote for people who had Canadian interests instead of those of the UN and US-funded hysteria pimping foundations, we would see policies that might encourage or ignore potential warming rather than the faulty belief system that our suicidal actions make any difference to the planet’s climate. The two most populated nations in the world are literally “pouring the coal” to industrialize while we debate the legalities of methods of deindustrialization and impoverishment.

Be careful with nation-wide figures like that. There’s a sharp divide in Canada between provinces who are blessed with ample hydroelectric resources like Manitoba (97%) and Quebec (95%) and provinces who are all but bereft of it like Alberta (2.8%) and Nova Scotia (8.7%). A carbon tax slapped onto such provinces will be hugely disproportionate in impact, not that Justin cares. He hates AB & SK (13% hydro) anyway and NS is just collateral damage.

No it’s not. That doesn’t change the calculus of global warming in the slightest, and I have no idea where that 3.9% number comes from. I doubt you do.
