The Nunes memo has been declassified and sent back to Capitol Hill for release.
Catherine Herridge (Fox) is reporting that the Clinton-DNC funded Trump dossier was the basis of the FISA warrant, while being shopped to media outlets, whose circular reporting was used by the FBI to lend weight to the same dossier… Intelligence Committee is expected to have the document available to the public in coming hours via their website.
Byron York has an early bullet-point report up. FoxNews just reported there are “no redactions”.

I find all of the Russian link troubling and I find Kushner and Trumps continued involvement in their businesses unseemly, Kushners inability to fully disclose multiple times deserves a punishment of some type. But the original charge of RUssian collusion in the election is not clear, the behaviour of the FBI and others is extremely troubling if only because they shot their own foot off chasing what might have been a legitimate line of inquiry.
I fear Trumps team, assuming they escape, will now do the very same thing to their opponents. Reminds me of the Tantalus Field in Star Trek.

What this means (now, whether politicians will see it the same way is debatable):
1) The USA has a secret court. This is something previously only ever seen in totalitarian, banana republic states. It is an anathema to democracy and almost certainly forbiden by the constitution, if the SCOTUS had any balls.
2) Congress allowed the secret court only with a set of requirements that were used to buy off SCOTUS and a large portion of congress, supposedly differentiating the secret court from the secret courts of other dictatorships: a) In applying for a spying warrant, they had to give ALL the evidence, not just that in favor of a warrant. b) A warrant against a US citizen had to be renewed every 90 days, and follow the same rules – ALL the evidence, including ALL the evidence gathered by previous iterations of the warrant.
So what happened here is that the DOJ/FBI did not present all the evidence, either at the initial application, or at the renewals.
They could claim that some of it was unknown initially (but that is a stretch, especially for an organization billing itself as the world’s best law enforcement/investigative agency). By the time of subsequent renewals it is not credible that they didn’t know that a lot of their evidence was bogus and the motives of those providing it politically motivated.
Using a secret court for political motives has to be a big no-no. It is an attack on the integrity of the state.
Those that lied have to face jail (or worse). The court judge(s) have to face an inquiry as to whether they acted as a rubber stamp or not (it looks like they may have).
The real problem is not spying on Trump (although that is bad enough) it is perverting the mechanisms of state for political motives.
People have found themselves against a wall for less.

Personally I think what is really going on here is the war between the ‘professional government’ (AKA the permanent members of the bureaucracy and the ‘amateur government’ (the elected officials. The professional government has succeeded in getting a goodly number of the amateur government to march to their drum beat. In particular the Dems and Rinos are puppets for the professional government. Them media is simply the propaganda arm of the professional government and parrots what ever the professional government tells them. Ever notice that when the professional government wants to go to war the media beats the war drums for them? The professional government tried to start a war with Trump and NKorea and the media fell in line immediately beating the war drums making it sound like the most righteous course of action would be to start a war with NKorea. Trump didn’t play along and the drums fell silent. Bush wasn’t smart enough to catch on to the Professional Government’s tactics and went to war with Iraq. Clinton did the same in Bosnia.
Of course the same is true in Canada. The professional government decided it was time to get rid of Harper and they succeed with the help of their loyal lapdogs, the Canadian press.
I am hoping that for a brief moment at least the Professional Government is brought to heel by Trump but I know that long term this is going to be a short lived victory. I personally think that the bureaucracy should be term limited so that no one spends more than say 15 years on the public payroll. Yes I know the government lovers in our midst would cry no end of crocodile tears and wail about how we can’t get ‘good people’ to man the bureaucracy. My point is simply that we don’t have ‘good people’ now.

The DNC hired CrowdStrike to investigate their leaked documents, and stated it was Russia. The FBI requested to inspect the DNC servers multiple times, but were denied each time. They were forced to rely on CrowdStrike’s assessment. It would be very interesting as well to fully understand the power and structure of the FISC. Is it like any other court? That is, is it part of the judicial branch as delineated in the Constitution? If it is like any other court, I would submit that the FBI and DOJ have committed perjury and contempt of court by, at the very least, failing to disclose the source and motivation of the Steele document. Or, does this get referred to the regular courts.
If I was a judge, and acted impartially and with utmost respect for the law like real judges are supposed to do, I would be some kinda cranky if I was lied to and if I issued a warrant on the basis of false, concocted information.
Warrants are issued by Judges on reasonable and probable grounds. We entrust judges to be the protector of the inalienable rights of any person and be free from the tyrannical and capricious actions of the state. They are there to ensure that every individual is subject to the full process of the laws that are in place to protect all of us.
