Ontario Superior Court Justice Robert Smith said prosecutors had failed to establish that the man knew it was against the law to have sex with his wife without her consent.

As many would recall the case in Fredericton this past summer where a Syrian refugee was convicted of beating his wife with a hockey stick(nice assimilating touch there, Sand Monkey), he also claimed that he “didn’t know it was against the law to beat one’s wife”. He was convicted but was only sentenced to time served while in custody(less than a month, I believe). So he was immediately released. Maybe he signed up for marriage counselling later(ha ha). Anyway, he may have grounds to appeal and get his record cleared. FFS!!

First and foremost, the judge did NOT, repeat, DID NOT, base his ruling of ‘not guilty’ because the man did’t know his behaviour was criminal in Canada.
Look at the actual article:
1. The alleged RAPE occurred 15 years ago in 2002.
2. The couple DIVORCED in 2013 (11 years after the alleged event).
3. The husband denied the alleged rape ever took place.
4. The judge ruled that Crown had not “proven the allegations beyond a reasonable doubt.”
Take away the nonsense about culture and this case comes down to “he said, she said”.
Given that they divorced and it is common for divorces to result in accusations of malfeasance by both parties, …… in the absence of any actual evidence, how could the judge rule any different.
Your first clue as to the total nonsense spewed is the fact that this is from the “Daily Mail”, a paragon of in depth and accurate reporting.

So, the judge says, right there, that he probably had sex with his wife on many occasions without her specific consent.
Yes, the story states: “However, the issue in this trial is whether, considering the whole of the evidence, the Crown has proven the allegations beyond a reasonable doubt.”
But the fact that the judge stated that the Crown had failed to prove that the accused formed the required criminal intent is bullsh*t because “ignorance of the law is no excuse” according to the Criminal Code, therefore criminal intent in this case is not required.
The Crown better appeal this, or they will be eating crap sandwiches from the Middle East for years to come as folks just say “I didn’t know, I come from a different culture where this is just fine. I had no criminal intent.”
