I am not critical of the judge. Most judges are smarter than you realize and O’Mara was not critical f her. She knew the politics. She knew there was no evidence to convict. So what does a judge do in that situation? Rule against the defence. This insulates the result (and it was,obvious to all that acquittal was the only reasonable verdict) from appeal. Smart judge.
The state could not appeal an acquittal anyway. Double jeopardy is specifically proscribed by the US Constitution.
I defer to your expertise on US constitutional principles, but appeals of acquittals happen with regularity in Canada and many go to the Supreme Court of Canada.

Mr. Martin had 4 MINUTES to leave and go to his residence (approx 30 seconds away) but returned to stalk Mr. Zimmerman, fatten his lip, break his nose and bang his head on the concrete. I was intrigued by the Jury selection of 6 women but it certainly worked. This was neither a civil rights case nor should anyone attempt to make it a sexist one. My hat’s off to the strength of these 6 women who resisted the pressures and returned the only possible verdict. Their lives will never be the same and could possiblly be subject to a reaction that could affect their own personal safety. Then again, I know that women handle stress much better than most men. BRAVO!!

What I find curious is that the coroners toxicology report only mentioned THC in TM’s system. From one of the links on this thread, it appeared that the little angel was a heavy DXM (dextromethorphan) user. People who are stoned on THC don’t generally get violent which is why the Vancouver police seize liquor at large gatherings but pointedly ignore people smoking weed. DXM is an NMDA receptor antagonist and, in large enough doses, acts indistinguishably from PCP. I’ve had to deal with some PCP crazed morons when I worked as a bouncer and I’ve never understood what the attraction was for this drug. I noted, from the link, that DXM is now known as “the poor mans PCP” which means that the price of PCP must have skyrocketed as 40 years ago it was a very cheap drug used by those who couldn’t afford hash and had no plans on using their brains for anything productive.
