The director of the Internal Revenue Service’s Exempt Organizations division, Lois Lerner, is invoking the Fifth Amendment and will not appear before Congress to answer questions about the agency’s targeting of Tea Party and other conservative groups.
Lerner was scheduled to appear before the House Oversight committee tomorrow to discuss the improper conduct of IRS employees who singled out conservative groups, and why she failed to bring that behavior to the attention of Congress.
In self preservation mode, it’s odd how she becomes one of those constitution waving patriots she has spent so much time fighting.
It is to be hoped that Congress does not excuse her from testifying but requires her to attend to be sworn in and questioned and publicly invoke her right under the Fifth Amendment to not answer. They should be relentless in doing this to everyone connected with these scandals so that the litany of repeated invocations of Fifth Amendment rights will be in front of the voters. Everyone who hears it will take it to mean “I think we in government were doing illegal things and we want to hide it from you.”
The lesson is demonstrated over and over again and some people still refuse to learn. Even an organisation much smaller than a government bureaucracy is too big to keep its secrets. And as much reason as you have to keep something secret, somebody somewhere has at least as much motivation to find out what you have been up to, and nothing better to do.
In the interest of accuracy, the 5th Amendment:
No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or public danger; nor shall any person be subject for the same offence to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation.
For these characters treason is a fun game until you get caught…
Naturally, they all swore to ‘uphold the Constitution’; only now you really find out that what they meant was to ‘HOLD UP the Constitution’ for ransom at taxpayers expense.
For them it is just merely a word game amongst lawyers.
Occasionally, those oaths of office will come back to give you an almighty boot to the backside…well we’ve found out how much the Administration likes the 1st and 2nd Amendment; now everyone is going to find out how popular the 5th Amendment because nobody knows anything in this Administration.

Unacceptable. Give her transactional immunity for her testimony, related to her official, not political, duties and then hold her in contempt if she then refuses to testify.

Subpoenaed. Issa will make her invoke the 5th on-camera, bet on it. As many times as possible.
A special prosecutor needs to be installed and provide people with the option to testify and if they don’t hold them in contempt and throw them in jail. Only way this debacle will be solved.
5A is being invoked, according to her lawyer, because a criminal investigation has been opened. So if she is potentially a subject of the criminal investigation then 5A is her right.
Of course it may also be part of negotiating to get immunity. Same tactics that apply to RICO apply here. Start at te bottom and start to investigate up. It isnt little fish you are looking for.
I suspect that Lois Lerner is not a Susan McDougall and willing to suffer greta loss. If she has been co-opted it will be because of the promise of greater things. When those dont materialize she may not be so “sold on the cause”
Keep the pressure on, despite what some are saying. Public was pretty disinterested in Watergate and Iran Contra until a certain point. You just have to keep pushing.

Good point. In the short term, the 2014 election is the whole ball game. Just a few short months ago I was very depressed at the likelihood of another Democrat Super Majority. I felt at the time that the Democrat base would be very motivated, and the GOP base not motivated; and, add just a little election fraud for good measure, and the Democrats were poised to win big.
Today, I don’t see a ‘snowball’s chance in hell’ that the Democrats will take the House in 2014; unless, they step-up the election fraud significantly.

Just giver her immunity and find out what she knows. If she was following her official duties, she wouldn’t need to claim the 5th since she already can’t be held liable. Not wanting to tell us what she knows is not covered by the 5th.
