Let them take it to the International Court in the Hague or some UN commission where they can mentally masturbate over it for years upon years.

Let’s presume for one hallucinatory moment that these clowns won their law suit (after running through the Federal Court, Federal Court of Appeal and Supreme Court….nothwithstanding that Parliament is the ultimate authority in the land). What then?
What remedy would these morons seek? Would it be reinstatement of the fraud called “Kyoto”? And if so, Canada would then have to send off $14 billion to some unknown entity as a “penalty” for nor reaching the stupid targets “negotiated” by the Shawinigan Strangler. In other words, every Canadian family of four would have to shell out $2,000 to this unknown UN entity.
Yeah….that’ll go over well.
The government should investigate the potential for a HUGH counter suit and should seek full client/solicitor costs from these bozos.

I think the issue is that the government is ignoring an act of Parliament.
IF Parliament passed a law that brought us into Kyoto, there should be a law passed to bring us out.
Think of it this way, a Liberal or NDP minority government deciding to bring back the CWB single desk or to reimpose the Long Gun Registry without an act of Parliament.
Harper could be setting a bad precedent here.

The guy behind this, Daniel Turp, was not only a Bloc MP but also, more recently, a PQ deputy in Quebec. A cultivated sort of chap who wears bow ties, he’s personally charming & likeable (more than can be said for his comrade Julius Grey), and represented Mercier, the wackiest riding in the province, AKA Montreal’s trendy Plateau Mont-Royal district. He lost last time round (in 2008) to a far-left splinter candidate, Amir Khadir of Québec Solidaire, known for throwing shoes at pictures of George Bush & boycotting stores that sell Israeli products. You’ve got to tilt in that direction to have much hope of getting elected in Mercier.
Here all along I thought that those rumours of German U boats being fueled and restocked in Quebec were just rumours,now I’m not so sure.

No….the Kyoto accord itself contains the mechanism to withdraw from Kyoto. The government merely exercised that right.

Take the entire penalty out of Quebec’s transfer payments.
They were the province which supported Kyoto and hoped to benefit the most from it.

Collar Bob Rae and confirm he supports this travesty. Then give him sveral examples of Liberal arrogance in the past (No GST, wait, Yes GST – or perhaps the National Energy Board)and ask him if whether he thinks there is s statute of limitations on calling government decisions into question.
Do the same for the NDP.
Better yet, come up with your own lawsuit to change a prior government decision, one that is so absurd no one would consider it, and ask all concerned what the difference is.

Since the CPC has been the Government since 2006 I wondered why they would produce legislation like this “Kyoto Protocol Implementation Act”. This Act was a private members bill that the opposition in a minority Parliament got passed over the Government’s objection.
There has already been an attempt to have a judicial review of the Government’s performance with respect to this statute, an action raised by the group “Friends of the Earth”. The Federal Court of Canada found in 2008 that the legislation itself is not justiciable, meaning that there is no issue that a court can resolve. This decision was appealed and the Court of Appeal sided with the lower court. The Supremes rejected leave to appeal to them in 2009.

We never did, and there was no national referendum on it either. That makes the inclusionary act of joining an act of government and of the minister, and in turn the same would apply for canada leaving. That’s providing the justices have a lick of common sense, since most of the justices we have in the supreme court do seem to have this. I don’t think this will get very far.
They’re very leery of dealing with anything that tromps all over the whole separation of the levels of government.
This kind of crap will continue until we hold those filing these kinds of lawsuits resposible for all of the costs. This includes the lawyers on both sides, and all of the court time. As with the former CWB directors, if these people knew they would be held resposible for the hundreds of thousands of dollars the taxpayers are spending these political stunts would not happen.
There is no question whether or not Kyoto is dead. Just on the method it was killed. Harper can kill it as often as necessary with a majority.I like Oz’s idea. Take all associated costs out of Quebec’s transfer payments since that is the Mecca of the bark eating druids.

Eli, yes, there was indeed a Parliamentary debate over the Kyoto Protocol. It came with the resolution to ratify the Protocol on December 10, 2002. And it was a lengthy debate, as one CPC member filibustered the procedings alone for nearly two days.
The Kyoto Implementation Act has no force, as no government can be compelled by an Opposition to spend money against its wishes.
The media is getting this wrong of course. Peter Kent did no such thing unilaterally. It was done with a resolution by Cabinet which is sufficient to provide withdrawal notice to UNFCCC of Canada’s withdrawal. To tidy up the loose ends, the government can simply pass a House resolution declaring the 2002 ratification null and void.
Revnant Dream, its simpler and more corrupt than mere foreign money pouring in. The legal firm has the work contracted by a charity which then pays the bills by issuing a charitable receipt. What needs to be looked at is if the charitable receipts greatly exceed the normal billable hours rate. The charity gets free legal service, and the law firm gets a huge tax deduction.
WE pay the legal bills; ALL of them, not just the government’s portion.

Duffman, the history here is rather murky. During the 1990s, Energy Probe sued the federal government over the constitutionality of the Nuclear Liabiity Act. Probe lost the case, and the defendants were awarded costs. Which shows you how bad Probe’s case was.
The government let them off the hook. This after an eight-year case that consumed thousands of hours of time beforehand and hundreds of hours in court. The court sessions alone went through about 30 witnesses, each lasting 1-2 days.
Revnant, the real issue here is not the legal profession. The real issue here is how some politically oriented so-called charities corrupt the process.
