I too am ambivalent with decriminalization of pot now but I reserve endorsing full legalization of all drugs to a future where individual responsibility is not outsourced to the state. IOW, we shouldn’t cherry pick libertarian tenets and make them addendum’s to the welfare / nanny state.
Emery is a somewhat pathetic character to try a frontal assault on the law and not expect consequences. If he wants to be a martyr he needs to man-up as you said. As a practical libertarian, I think it’s unfortunate and embarrassing that so many self professed libertarians make this issue their cause. I find the drug culture to be boring and irresponsible.

For years opponents of free speech went out of their way to accuse opponents of the HRCs as being nazi sympathizers and so on. They did so in an attempt to conflate the broader legal issue with the unappetizing characters at the center of the storm. It’s kinda the same thing here, in that – warranted – detestations of the *character* of Marc Emery are supplanting discussion of far more important issues than Mr. Goofball himself – issues like sovereignty, for example: if an offense committed on Canadian soil doesn’t warrant serious jail time here – and if you look at his record, and his repeated arrests, Emery’s apparently doesn’t – then what’s the justification for shipping him elsewhere where the punishment is harsher? I mean, other than the fact that he’s an ass?
I have always believed that when you’re in another country you should understand that you are absolutely subject to its laws, and not the laws of the country you come from. There are countries that prescribe the death penalty for possession of drugs, for example, and my attitude towards the sobbing arrestees has always been, “well, too bad for you, I guess you shouldn’t have marched around Singapore with a brick of heroin in your backpack.” On the other hand, if a Canadian was arrested here in Canada for crimes committed on Canadian soil and then shipped to Singapore, I would find it a bit disturbing – even if she’d mailed drugs to Singapore.
My unease in such a case would have nothing to do with feeling any sympathy for the perp, and it’s kinda the same thing in this case. The DEA (the Americans) asked the Vancouver police to raid his, erm, operation on Canadian soil, and they did, and now we’re shipping him stateside to face a far harsher penalty than he ever received here, despite him being arrested here numerous times.
Somehow, it just doesn’t seem entirely reasonable. Is what he did on Canadian soil a crime in Canada? Good. Arrest, charge, convict, and jail him here.
It seems like the arguments for sending him abroad to be jailed for crimes committed on Canadian soil are more based on dislike for the guy than anything else. Frankly I don’t think Marc Emery is important enough as a human being to supplant other larger, more important considerations that have nothing to do with him.
Anyway, back to talking about what a idiot/loser Marc Emery is…
The conservatives just shot themselves in the foot with this asinine decision to extradite Marc Emery for doing something which is completely legal in Canada. I suspect that the real reason for him being shipped off to the US is for cutting the value of kickbacks from large scale cannabis growers to politicians and police; after all if people can grow their own weed how are crooked politicians supposed to make money?
The closest that Canada got to a libertarian party was the 2002 BC provincial Marijuana Party which garnered a respectable 50,000 or so votes when they made their debut. They were the only party who had a policy of not enforcing federal firearms laws and got my vote as a result. Marc bankrolled the Marijuana party back then but unfortunately developed a fondness for Taliban Jack in the last federal election which I would put down to the stress of his legal proceedings.
What PMSH should have done was to tell the US government that we’re not playing along with your idiotic and totalitarian war on (some) drugs and Emery stays in Canada. That action would have resulted in more seats in BC where cannabis cultivation is the highest valued agricultural commodity and generates more revenue than forestry.
Those who seem to think the Emery extradition is a good thing should remember that cannabis was completely legal in Canada until the 1930’s and all of the “problems” it caused were since it was illegal. It was also completely legal to purchase a rifle without needing a license in the 1970’s and the same totalitarians that came up with the anti-marijuana laws are the ones coming up with C68 and related anti-freedom legislation. If you don’t like pot, don’t smoke it. Marc is on the pro-freedom side and doesn’t deserve to be shipped off to a communist country. Maybe we can make a deal with the US; shoot Khadr whenever you feel like it and Marc stays here.

Reading your earlier post speculating on whether he was a “damp post” from birth I remembered I used to wander into his bookstore in London Ont when I was in University. He was always a outlier in his opinions but then he was a pretty smart and quick guy, quite present in the moment.

It is also illegal to mail pot seeds in Canada but we never went after the guy. Really to pay that type of political price for nothing does not make sense. Why not give him to the US? He isn’t going to spend 3 months with his mother on house arrest in the US.

Article 3 clause 2 allows for the extradition of Canadians to the USA when they break American laws even if they are in Canada and even if the activity is legal in Canada. It’s at the discretion of the executive, ie Harper, but it’s the law.
It appears that Emery will serve in a Canadian Club Fed and could be out in as little as 10 months, which is roughly the same time Tommy Chong served in the USA for selling drug paraphrenalia, not incidentally. Emery has made millions, has more female groupies and fanboy admirers than you can shake a stick at, and knew when he sold marijuana seeds to Americans over the citizen he was risking arrest and deportation. He has by his own admission signed up “thousands” of NDP members and it’s not hard to imagine a paper trail from drug “entrepreneurs” like Emery to the same soft-on-crime politicians and parties who are now agitating for his freedom.

Marc Emery is a Canadian hero. He turned himself in after doing everything he could peacefully to stop the politically motivated DEA “witch hunt”.
To me his extradition is an example of our lack of sovereignty and lack of democracy. The Southern emperor says “jump” and Harper says “how high”. That’s the reality.
Personally, I want cannabis studied. With the mountain of anecdotal and growing scientific evidence that the ingredients in cannabis are effective medicine for a number of ailments including shrinking cancer tumors. Study is the logical choice. The Cons are suppressing it and have cut funding for it’s study. I have used Rick Simpson’s “hemp oil” (Google “Run from the Cure”) and it works for migraines, sleep aid, and other conditions. Hundreds of people are claiming it cured their cancer. Imagine if you could throw away most of your pills and grow effective, SAFE medicine in your back yard. Just who is benefiting from cannabis prohibition? Certainly not the average Canadian.
This extradition has more to do with loss of liberty than cannabis. Marc Emery fought against other attacks on liberty such as book bans, censorship, and Sunday shopping bans. You can applaud this injustice if you want but at least acknowledge that you are applauding the loss of your very own liberty.
One day they may come for you because of your choice to have an abortion, your sexual orientation, or the color of your skin through mandatory minimum sentencing legislation. Persecution is alive and well in Canada and this is a very dark day in our history.

Drug prohibition CREATES crime and makes society LESS safe. Look beneath the surface and the soundbite. It is obvious. The “justice” system needs crime, it’s a symbiotic relationship. Drug prohibition has nothing to do with public safety and more to do with criminalizing populations and pandering to the religious and uninformed for votes. As a control measure and in the US example it’s working like a charm with the poor and minorities overflowing prisons for non violent drug crimes. Check out LEAP (Law Enforcement Against Prohibition) or see the positive results in Portugal after 9 years of drug decriminalization. AT least think about it and do some research. Do not fall into the “willfully ignorant” component of the Harper base.

I don’t think the Conservative party is aware of the significance of cannabis in BC. Marc Emery was a bit over the top when it came to decriminalize cannabis but someone had to do it.
The caricatures of cannabis users that some people have posted previously are as realistic as using a skid-road drunk as an example of a a typical alcohol user or Gamil Gharbi as being representative of firearms owners. In Vancouver people can be open about their cannabis use and when I first moved to the interior I was struck by the seeming lack of use of cannabis. I’ve since found this is because people are very secretive in this conservative area and I usually find out when I suggest trying nabilone for chronic pain and get comments like “don’t bother writing that prescription doc, I’ve been smoking weed for 10 years now for my arthritis pain”. A substantial minority of people here are frequent cannabis users, and if we add in all of the owners of unregistered firearms, there is probably majority of the population that are paper criminals.
Alcohol is far more dangerous drug than cannabis and cannabis prohibition makes as much sense as alcohol prohibition did in the 1930’s. The strongest proponents of criminalization of drugs are those who benefit from their illegality: the police/prison industry, organized crime and statists who see drugs laws as a means of passing ever more totalitarian legislation. If people were allowed to grow their own pot, the only people who would be making money in this scenario would be the fanatical botanists who specialize in producing ultra-potent cannabis strains. One of the little appreciated advances in botanical science is how, over the last 40 years, cannabis THC concentration has gone up to an amazing 30% in some strains and the stuff that people used to smoke in the 1960’s is now thrown out by the growers as there is no market for it.
Cannabis in Canada is now in a weird legal situation as there are more and more medical uses being found for THC. There is a very extensive endocannabinoid system in the brain and one of the most exciting potential uses for THC is as a mood stabilizer. 5% of the population has Bipolar2 and many have been self-treating with cannabis. In Vancouver I had numerous patients who would smoke a joint every evening so that they could get to sleep. I’ve seen a number of patients now who I’ve diagnosed as being Bipolar2 that seemed to be doing unusually well and then found out that they were daily cannabis users; almost always in the evening. A quick search of the medical literature turned up multiple papers in which the same observations were reported, but it is telling that even though Grinspoon first published on this topic in 1998, no-one has actually done a double blind clinical trial to determine how effective THC is as a mood stabilizer. The only thing I can say with absolute certainty is that such a study won’t be carried out in the US or Canada.
Nabilone is a semi-synthetic THC derivative and works extremely well in treating fibromyalgia and post-trauamatic stress disorder (PTSD). In PTSD nabilone eliminates peoples nightmares and this is a hard thing to do with non-cannabinoid drugs. People quickly realize that cannabis is a lot cheaper than nabilone which is $6 for a 1 mg capsule in BC. THC is an effective analgesic (and has been used in this manner for thousands of years) and doesn’t have the constipating side effects of opiates which can be particularly problematic in the elderly.
I think that PMSH just blew any chance he had of a majority government with the deportation of Marc Emery and the more repressive drug laws that have been proposed/passed.

As you say, the people you’ve seen it happen to have been serious abusers of the stuff. Negative consequences are going to land on anyone abusing any substance.

Additionally, most people seem to forget that it was the Liberals who criminalized marijuana in Canada to begin with.
Last election, Marc Emery was getting an endorsement from Jack Layton.

On the flip side look at the US situation and the harm (selective) drug prohibition has cost that society and that has spread like a cancer throughout the world through their foreign policy. Look beneath the surface. Why have 13 US states decriminalized medicinal us of cannabis? Why is California, the most populace US state, on the verge of legalization. Loki – you should pick up the book “Booze” by James H. Gray. Much of the received wisdom on prohibition (both the motivation and its success) in Canada is flat out historically wrong.

I don’t have an opinion on weather Emery should be deported or weather pot should be legalized,but what ever happened to flying under the radar? Were the police breaking down his door to arrest him while he was zoning out?I suppose being a marijuana martyr is as a noble profession as any.
