It’s The Shift That Keeps On Giving!

A Toronto firm is suing the federal Liberal party for more than $8 million and demanding it cease using the firm’s name “Green Shift” for its carbon-tax plan.
Green Shift Inc. owner Jennifer Wright personally delivered a statement of claim at Liberal party headquarters today as she launched the lawsuit.
The statement says Wright is seeking $8.5 million for “general and special damages” and a further $250,000 for aggravated and punitive damages.
The lawsuit seeks a court injunction to stop the party from using or displaying the words Green Shift, or any other trademark or Internet domain name that is similar to the logo used by Green Shift, which has had its trademark registered since 2003.
The Liberal party has so far ignored Wright’s demands to stop using the firm’s name.

    Anyone know how quickly a case like this could take? 3 months? 1 year? 2?

  4. Kate Wheeler, Robert Fife and Kady O’Malley are going for Jennifer Wright’s jugular on behalf of the Liberals.I guess Garth is on a shorter leash and the MSM has to do the dirty work now.
    So, that’s 8.75 million for Jennifer. 3.5 million for Harper. Would you loan the LPC money when the next election is called?

    Now that total lawsuits against the party are amounting to almost $12 million dollars these will be noted on their financial statements as potential liabilities which will affect their ability to borrow money.

  9. Don’t know how long it will take to have the case heard but the injunction to stop them from using the name shouldn’t take more than a couple of days.
    If the stupid bastards had any sense, they would have ceased using it immediately after it was brought to their attention. Their arrogance is astounding.

    I would have thought that any organization (including a registered political party) setting out to coin a name or slogan for public use these days would at least have had the shmicks to do some googling first.

    They did google it. They knew about her before they unveiled their plan. They gave her a heads up. Then they ignored her request to stop using it.
    This is a case of arrogance, not carelessness.

  14. Andrew: Really? That gives the Libs *no* leg to stand on in court! If they honestly hadn’t known about it, they could’ve pled ignorance – that wouldn’t have gotten them off the hook but it would have mitigated the damages. But to find the trademark owner, contact her, then *refuse* to heed a warning not to use the mark? That’s willful infringement! It’s a slam-dunk case for Ms. Wright that even the most lib-friendly judge can’t ignore!

    Imagine that, who would have figured.
    Another thing to Ponder is how this is Not a Headline maker on there site,(ctv) If roles were reversed or if this were the tories being Sued that would be splashing big for days.

Well, that’s interesting the brain addled Fife and company believe copyright infringment is alright in their books even though the reasons the owner listed as their top concerns are entirely legitimate. Besides, they followed the law and trademarked their name at their expense so why wouldn’t you protect it. It is what all businesses do if they have a clue what they are doing. The Liberal boobs and their MSM divisions are just completely clueless….again.

  35. So, if all these lawsuits succeed, then the liberal party will have to declare bankruptcy. Harper and Wright will then get to divide the assets. I suggest, in view of the policies and practices of these two individuals, that they split the “brand”: Wright gets the red maple leaf, and Harper gets to call himself a Liberal…
    …the “Party formerly Known as the Liberals” will then rebrand as the Progressive Party! Diehard “Liberals” will object and insist on holding onto the past, Kinsella will wave a dinosaur at them, Turner (Garth, not John) will call them reactionary conservatives, and lo! The mole shall strike! A compromise is made and the rebranded party becomes known as the Progressive Conservative party.
    The Progressive Conservative party goes down to defeat in the next election (held in 2009), and the Liberal party (led by Harper) forms a majority.
    And the whole country is happy.

    The pic of Jennifer Wright facing MSM cameras and reporters with a life size poster of Lil Shifty in the background is priceless!
    Further to that, her performance during the press release contrasts sharply to Kady O Malley’s take and exposes Fife for the bootlick he really is.
    It seems Green Shift (the company) has done work for the Ontario Libs and it seems for the LPoC as well. Of course Bobby never mentioned that when he implied political motivation vis a vis a connection to the dippers.
    And finally. Much has been made by the MSM about the bravery of Lil Shifty venturing into the black heart of Alberta to talk to select groups (enviro teenies and Lib operatives) to defend his shiftiness. Big flicking deal.
    In contrast I think Jennifer Wright should be applauded for venturing into the weasels den that is LPoC headquarters to defend her property and rights.
    That took guts.

  44. Both cases has merit. This latest one especially.
    The real short-term problem for the LP is that they may not be able to get a loan to run the next election as the lender(s) would be behind these suit settlements.
    Long-term it could mean the financial ruin of the LP. and to simply rebrand will be difficult unless there is adequate directors E&O insurance to cover off the liability.
    For Dion and his advisors it speaks very much to their collective character, and the main characteristic is RECKLESSNESS. They continually take rash actions including this latest ‘green shaft’ gambit. IMO it will be the issue that delivers the CP a majority Oct’09.
