How can the mediator be affiliated with the same government department (Grievance Dept: Dept of National Defense) as the person filing the lawsuit, Richard Warman. Isn’t this a conflict of interest?

Let me get this straight. The serial accuser Richard Warman files a suit against someone and then, by coincidence, the CHRC appoints a mediator who just happens to work in Warman’s 50-person office.
This charade has gone on long enough. The federal government needs to step in and and shut this outfit down. The RCMP then needs to charge them with serious abuse of public office.
What, now it’s the CFGB vs FreeDominion?

chip – this is a civil suit, to be heard in court: the CHRC had nothing to do with selection of Korngold-Wexler as the mediator. It is possible that Ms Korngold-Wexler carries on a private practice as a mediator, and this is just a coincidence – although how happy her employer might be about her moonlighting is open to question. That being said, since she has a professional relationship with the claimant by virtue of their working together (and it is “difficult ” to believe that she was unaware of that, but…), her only course of action now is to advise the court that appointed her that she cannot take the assignment.
This is starting to look like the “Hatfields and the McCoys”.

The DND organization chart shows the grievance organization (not the board) under the Vice Chief of the Defence Staff (VCDS). The organization comprises a Director General in charge of three directorates:
• Special Grievances – Enquiries and Investigations;
• Grievance Analysis and Operations;
• Grievance Administration
If Warman is in fact the Director Special Grievances –E & I, and
if Korngold-Wexler is in fact the Director Grievance Analysis and Operations, then
THERE IS NO WAY THEY DON’T KNOW EACH OTHER.
From the Free Dominion description of the situation it appears that Korngold-Wexler is currently trying to schedule a future mediation session in her capacity as a listed mediator for the Ontario Attorney General:

When a ranking grievance bureaucrat in DND gets tainted with the CHRC and/or civilian SLAPP suits, something is very wrong. There has to be those in high places who are really wanting to shut down opinions on the internet and it seems are trying to money-out “the small guys” to make it all go away.

This is quite abnormal. In fact usually there is a procedure to challenge the ediator if you feel they are are biased or unfair. Of course, whoever appointed the mediator didnt do their job and the mediator should have recused themselves due to even the appearance of conflict.
Because this is in “real court” your lawyer is fighting by rules she understands. Stick to the law it is there for a reason, when it rules for you and when it rules against you.

But DND, for all it’s faults did not make the things, has no say in how they operate and can not control what its civilian employees do after working hours.
Sorry but this stinks to the high heavens, if the mediation fails I assume the mediator will present a report before the ruling judge and this report could make or break a libel ruling. Ergo this woman can’t possibly be allowed to mediate a dispute, this isn’t a SSSHRC court of law. Civil Law is real law, is something going on behind the scenes to circumvent justice?

Actually, Korngold-Wexler and Warman work for two different departments. The problem is that they work in two departments with similar names. Korngold-Wexler works the CF Grievance Board (CFGB) which is an independent body from the CF/DND, while Warman works for the CF Grievance Authority (CFGA) which reports to the Vice Chief of Defence Staff (VCDS).

Accordingly to Annex A the CFGB actually reports to the CFGA. Does that mean Korngold-Wexler and Warman have a working relationship? I don’t know. There is nothing to indicate that they actually have a working relationship or even know each other however, it doesn’t matter how you finesse it, the optics do not look good.
