Montague and his wife Donna were charged in 2004 for their deliberate refusal to comply with firearms paperwork which they believe to be an unwarranted threat to their freedom, privacy and property.
Calvin Martin QC will be presenting the Montagues’ arguments to Justice John Wright.
“After over a decade fighting Bill C-68 at all levels of government, we’re excited to present a strong case to strike this expensive, ineffective and contradictory legislation off our books” said Martin.
“This is very costly and personally draining” says Donna Montague. “We really hope the courtroom will be packed with supporters demonstrating the concern of average citizens.”

The hearing will be held at Superior Court of Ontario in Kenora, Ontario at 2:00 pm, Monday. (March 12)

  1. I like the part where it says that even if you are in full compliance with all the clauses and stipulations and requirements ….. the authorities can still find you in breach and seize the firearms and lay charges.
    wow, what a bonanza for cops and lawyers and judgey judges and corrections system.

  2. Bruce had tried to get arrested for over 2 years prior to the unexpected “raid” of his residence and business in 2004.
    Bruce traveled to Ottawa and publicly burned his firearms licence and his registration certificates( he had complied with the law) then made written declarations to the ministry that he was in posession of unregistered firearms which he had owned peacefully for many years.
    The charges after the raid, purposely avoided Bruce’s intent to be charged under the sections of the code that prohibits ownership without registration…they hit him with dozens of trumped-up petty counts of unsafe storage and magazine capacity infractions…regulatory infractions…but the die was set and when the feds saw he was serious about a charter challenge they poured the heat on him and his family…
    …police intimidation, threatening to seize his home as “procedes of crime” ( so he could not mortgage it to buy legal help)…then they stalled by putting the trial dates back (hoping the registry-dismantling Harper government would be out of power by the time this made it to appeal)
    Watching the whole sad story unfold over the years, I am saddened at the vindictive and malicious nature of the gun bureaucrats, the Ontario justice department and the OPP policy wonks who staged this “gooning” of a solid citizen and his family ( done purely as a favor to the anti-gun Martin government’s election platform)….all over the petty politics of the Librano political gun registry hobby-horse….damn them! Partisan politics is bad enough but when you see it in the justice and police functions it is so much more insidious.

  3. What strike me is the heated vengance of law enforcement against this man and his family almost as though they had a personal stake in this issue. Does law enforcement nake the laws? Or is it just that the old saying is true, “the only difference between criminals and police is that one has a license to use their gun.”

    I suspect that the ‘constitutional challenge fund’ would never have accepted the Montague case for funding.
    Only approved special interest types were being funded.
    Same sex cases as an example.
    Gun owners would not have been acceptable, is my best guess.
    My wish is that the Montague’s win the day.

  5. Few, if any, street level cops actually support the gun registration as most find it has done little or nothing to decrease gun violence among the criminal element. However despite whatever their personal feelings may be on the issue they can’t pick and choose what laws they’ll enforce. If you don’t like the law perhaps the best way to combat it is to vote against those who support it and for those that will do away with it. Yes, the police brass and the judiciary have become politicized and the persaveness of the agenda of over regulation is astounding, but to suggest this has become a “bonanza” for the police is incorrect and detracts from the real issue. The laws don’t acheive their purpose which is to decrease gun violence. Instead they have criminalized ordinary taxpayers. The laws must be changed and those that support them not voted into power. What’s the desired effect here? If you want to hammer the cops on this one fine but you may find you’re undermining many that support your position. Remember cops vote too.

    Canadians, especially the MSM, don’t seem to realize how hard fought are our freedoms , and how delicate the system that keeps them in place.
    We have lobby groups in this Country, representing every “cause” in the alphabet, but few protecting us from the creeping socialism that has pervaded this Country for the last 35 years.
    Canadians are great at apathy, and fail utterly to understand the underlying principle of the American Constitution, that governments are not our parents, have to be held in a system with checks and balances, and have to be overseen with a suspicious eye.
    Power corrupts, and we have more and better evidence of that here, than in probably any developed Country on earth. From 1993 to 2006, we were ruled by banana republic dictators, the treasury was looted, to what extent we’ll never know. Canada became the private playing field of a small cabal of billionaires, and their hand picked puppets, who treated us with the contempt we deserved.
    The few voices of dissent came from Western Canada, and were quickly shouted down as the ravings of redneck hillbillies. “Don’t worry, the Great White Father in Ottawa will take care of us all.”
    One of the most important factors in a free society is the right to own property, and the seizure of firearms is nothing more than the government stealing from its citizens.
    The MSM did its level best to portray gun owners in a most negative light, not unlike the way European totalitarian regimes have portrayed religious minorities in the past. The vast majority of Canadians fell for it hook, line, and sinker. Gun owners became pariahs.
    After a lull in the storm, while the left gathers its collective breath, we’ve started down the same road again, this time the Holy Mantra is Global Warming/Climate Change. And once again Canadians will sleep peacefully, secure in the knowledge that Mommy and Daddy gubmint will love and protect us all.
    Half of this country deserve the epithet “sheeple”, maybe it’s time the rest of us got as nasty as the GW/CC activists. We’re losing our freedom to strident opportunists, might as well go down fighting.

    This was a basic platform promise of Harpers to end the gun registration & its odious implications. If they are not freed of any charge, than all the work to bring sanity back to government has become for not. It will have just turned out to be another group of crooks or professional politico’s displacing an even worse crew.

    Absolutely! The right of non-criminal civilian firearms access is a corner stone of british commonlaw civil liberty and the bulwark of the right to armed self defense…it isn’t about duck hunting or target shooting…it’s about the fundamental right to defend yourself against armed aggression from criminals when and if the police cannot be present to interceed…..in a larger sense the right to civil firearms ownership is also a sign of a healthy democracy where the police-state has not claimed a monopoly on the justified use of defensive deadly force….the only licence you should need to exercise this right is a Canadian citizenship.
    Harper and Day have failed their commitment to the CPC membership who made it clear at the policy convention they wanted licencing and registration scrapped and replaced by a simple police background check and a one time issued certificate of compliance.
    If you had read Harper’s bil C-21 you will realize the compromise is so vast that all that has been done to C-68 is the dropping of a requirement to have a paper registry certificate in your possession….all the onerous and unconstitutional portions of the law remain intact.

  14. I read more and more criticism of Harper on this blog all the time. In this case eliminating the stupid gun registry. Remember he does not have a majority to allow him to get rid of these idiotic liberal make-work laws. You saw how the Liberal Senate has forced him to make changes to good legislation and even then tie it up for months. He has to pick his battles or do things in incremental stages. Witness the gutting of the Security Act by the other parties.
    It really bugs me when we conservatives won’t cut our leaders some slack and constantly eat our own. The Liberals don’t care what their party does, they always blindly support it. I don’t want us to do that but unless we support Harper for the long haul and get a majority to get rid of so much Liberal crap we will become the back-stabbing, disorganized opposition wandering in the wilderness once again.

  17. I must agree with Joe Molnar that the msm in this country are 85% creepy slimers who subvert all citizen’s Rights issues with contempt and denigration. They are beyond contempt.
    The journalists that I went to University with did not pass if they did not spout and spew Communist propaganda from both nostrils and their yaps. After awhile I dropped all these types from my communication list because they were very dull; not just boring but they were stupid and repetitive. I did not ever even contemplate that people would listen to them – or, even wilder, believe them!!
    The people I grew up with were not University grads but they were always interesting and they always had new ideas that sounded exciting! My grandad devised a car trunk to carry calves around in – if new calves were born in a prairie blizzard they had to be rescued; my grandad was 75 and he found it pretty hard to carry a new calf on his saddle in a blizzard. A colt kicked out the back seat in his new car so he made his new car into a van sort of thing. I found innovative thinking very interesting and I thought everyone did things like that – I was pretty far wrong!
    Gun ownership, like land ownership, was a given in those days – it was Turdo in his ‘scrap of paper’ (Charter of rules and restrictions) that ruined that freedom to think. My Dad kept a loaded shotgun in our stairwell at all times; my brothers and I were told not to touch it unless we intended to use it – we never touched it but we did know how to use it. I thought all people knew how to shoot a gun.
    I would like to donate some money to Bruce and his family for their fight against the Liberanos. If they loose this case then we need to demand an election right away – I know the minority Conservatives cannot rid the country of the albatross C68 without a majority. If the Liberano/Dipper outfit win the election it would signal that there is no hope for the nation of Canada; those of us who like Freedom could all move to the west and the Liberano/Dipper people could move east. This country has put the Right to OWN Property in limbo for benefit of the communist type billionaire elitists who want state enslavement ( the first move that Absolute power mongers make is to disarm the citizens – see Hitler, Stalin, Lenin, Edward II…..it is not rocket sciece to figure out that the Liberanos ‘plan’ to disarm the citizens was a plan to enslave the citizens of a free nation – some people are too insecure to live as freemen/women so they should be in their own pen -IMO) We must draw a line in the sand before it is too late.

  20. Let’s not forget why the gun registry was created.An islamic fundamentalist loser murdered 14 women. He figured these hateful woman with clitoris intact were holding him back,so he killed them. The liberals had to do something so instead of tightening up our immigration laws which would have upset thier large power base of immigrants,they went after hunters,farmers,sportsmen,etc. These people are largely conservatives,so no big loss to the party.Years later,Dion strikes down terrorist laws and the islamic fundamentalists celebrate in our streets,in Canada.I am not making this up.     Ordinarily I would agree that the court being stacked with Liberals would be bad for Mr. Monatgue, the problem they face is the decision they make will set precidents for future charter cases. If for example it is Ok to jail a citizen for five years for losing a piece of paper it is hard to say you can’t hold a terrorist for 72 hours when he is on his way to murder people. That is why the crown is trying so hard to drag it out and keep it from being a charter case. The judges will be caught in a catch 22 if it gets to the SCoC. The provincial challenge was easy for them to laugh at, cause they just gave more power to the feds. This one not so easy.

    I’m inside on this issue ( believe me I am) and what we have telegraphed to us from the CPC firearms stake holder’s group is NOT what was given to the party caucus as a member supported policy….nor is it what was promised to firearms owners by CPC firearms advocates.
    I would rather see C-21 withdrawn than acted on s it is an insult to our intelligence.
    I’m not making condemnations…YET…I’m saying that what we got is not what was promised nor is it what the Party membership had adopted as policy. Minority position noted….but the signals coming from inside on this issue are leaving a lot of people feeling betrayed.
    I’m on Harper watch…this westerner/gun owner/Reformer has been lied to by the best of ’em…PC, Liberal and Reform alike…if Harper does the right thing, then I will be amazed….compromise is soooo much more easy to accomplish.
    It will be a first. I’m willing tho give them that chance but I’m not optomistic based in a long past experience interfacing with federal politicians on this issue.
    It is a fact that the first thing the Liberals will do if they had a majority is ban civilian ownership of firearms creating millions of paper criminals and a civil non compliance level unseen in Canada since alcohol prohibition…so certainly we can’t vote for Librano despotism and social balkanization.
    It just gauls me that we are back to the same compromised ideals ith the CPC as we were with the Muldoom PCs…the attitude being that Firearms owners will vote for them regardless of how compromised their policy is…because they are the only game in town…it just reeks of status quo fed political manipulation….something we had hoped Harper would rid the process of….it will be back to going into the polls holding your nose and voting for the party which will damage you least.
    I haven’t given up hope…I’m just have jaundiced optics (from past experience looking at what politicians will actually do to eleviate the criminal code entanglement that lawful firearms owners have been oppressed with… with these recent CPC compromises it seems the pattern repeats itself.

    The majority of Canadians have a pathological fear of guns.
    Harper will do nothing. Besides, he has bigger fish to fry.
    I salute Montague’s great efforts on behalf of freedom. I fear he will be frustrated and wind up very bitter in the end.
    At the rate we are going in this country, only the police and criminals will guns. The rest of us will no longer be known as consumers or citizens, but rather hapless victims mugged and robbed by criminals and intimidated by police … and we will deserve it.

  28. I think more than any previous Government, the Harper Conservatives are reading their mail. If the public pressure seems to stear them one way they will comply.
    I think duck hunters have gone back to sleep. I have written 2 letters to my MP on gun control related initiatives I have heard of and received a reply from the pertinent ministry.
    Last indication I got from my gun club was they were afraid of being too political as it irritated some members! Our club has a huge contingent of identifiable minority members who I’m sure think all is well in the Librano camp. There is a letter posted from the LPC which says that the Gun Ban Policy Initiative that passed at the Convention was rescinded by the executive later. Doubt they have that power. If anyone can find some info on this, I will see if I can get it posted on the bulletin board. We have to kick the tires and get the bus rolling again.
    I get occasional hints that both the NDP and Libranos have lured many duck hunters back into the fold.

Every cop is either a father, mother, sister, brother, son, or daughter to someone and to wish that kind of grief upon them because you were burned is very distrubing.

    well, right in a way, nothing *at the time* I could do, but since then have had the opportunity to tear a huge chunk off the ass of about a half dozen of them. and it feels REAL GOOD.

    getting ‘burned’ ie getting the property stolen WASNT the final straw, this kind of reception happens LOTS; it was their *reaction* that ‘burned’ me.
    it ISN’T just a couple ‘bad cops’. this behaviour is endemic. they do it as part of some ‘bonding’ thing to show they’re gonna ‘go along to get along’ with their buddies. and the unwritten unspoken rule is your treat the public like DIRT when out of the glare of the crowd. there, now theyre all in the same boat. now none of the cops gets to ‘rat out’ another cop for this atrocious behaviour because, well, THEY ALL DO IT.
    ‘all in it together’ ie ye olde *male bonding ritual* crap.
    so I just feel now the time has come to dish out to them a taste of their own medicine.
    maybe they’ll think hard next time they get the ‘urge’ to treat a citizen with such unwarranted callousness.
    in the mean time I get to have all the fun hammering the lesson home.

    This AM let’s all hope that a principled Canadian is successful in recovering his lost property and rights from a charter challenge in the courts.

    I share your anger, my friend. I live 150 miles south of Fort Mc Murray, aka “Coke Capital ” of Alberta. Boomtimes can be a real bitch!
    But my real point is that in my small town we “RAISE” the sort that will visit empty homes and help themselves to someone elses property. Little c&nts that are “too young” for the “system”. Progeny of whores that bang out kids with no “decent” male role model in their lives, is part of the problem. Unwed mothers used to be cause for shame, these days it’s a mealticket for social services picking up the tab.
    That’s only a small part of what’s bugging me, but really man, do something constructive. You’ll feel better.

  40. Can someone give an update on what happened at the hearing? There are a lot of people who are currently being bullied by the Firearms Registry staff who want to know if the threats they received have any validity.

    To most of the “box a year” gun-owners out there, just remember… you’re not doing much for protecting your property. Like us or loath us, it’s the “box a week” (or more when I can afford it!) guys and girls at the range, with our “evil” looking firearms and PISTOLS, that are taking the legal fight to our adversaries, and pushing for our RIGHTS (not “priviledges”)
