After the declaration of a mistrial in the horrifying Massachusetts murder case involving Lindsay Clancy, what is there to say, except to note how wildly inconsistent we’ve become in measuring concepts like “capacity” and “responsibility.” We’re a culture that doesn’t forgive, but quickly excuses. I don’t know what it means, nor do I understand how this case became a such a rallying cry for — something? What, exactly? How can “mental defect” have a lobby? What’s happening to people?

  1. Shocking that allegedly, one lone male on the juror was not buying the “temporary insanity, BS, and kudos to him for holding out.
    Otherwise, the bitch could be released in 5 years from the institution. 5 years of cushy living for killing her kids.
    If you were her parent, would you tolerate her calls or presence, given she killed your grandchildren? Nope, I think disowning her would be the default, given this cop out strategy at trial.
    Hell isn’t deep enough for her, or her attorney.
    That said, the prosecutor needs to do a much better job next time to avoid this circumstance.
    And, don’t date/marry any woman from Massachusetts, clearly.

        My wife and I had a “talk” about this, and she did not defend her, but described an incident of horrors of hormonal imbalance within her extended family. The requirement of forced mental health care to stabilize until there was a settling back to normal function. Lots of questions.

    Oh … and I look SO forward to the multiple civil lawsuits against her Doctors and Health Insurance Company.     Should a child be made aware that some moms think Clancy is innocent?
    Should you date a woman who agrees with Clancy?
    If her mood swings permit her to murder her children, should she be flying an airplane at certain times of her cycle?
    Should she be serving in the military? Or any other stressful job?
    What other events could she be part of if her mood swings remain “untreated”?
    Is she now similar to that person in Canada who can’t be found guilty of a crime as he’s of diminished capacity?

    Lindsy Clancy murdered her children 3 1/2 years ago and we never heard BOO about it until 7 weeks ago.
    Now this dog and pony show. The U.S.A. has around 340 million people and horrific acts of murder happen.
    Why is this a showcase trial except it has been made to be by political mass media. This was tailor made.

  12. The law needs to be changed. Massachusetts seems to be the only state that requires the prosecution to prove that the person wasn’t insane under their Not Guilty by Reason of Insanity defense, as opposed to most other states that require the defense to prove that the defendant is insane.

    Of course, the real change needs to be that either insanity should be considered at the penalty phase as a reduction or diversion of the guilty party, or change it to Guilty by reason of insanity, and they never get out.

  14. I think Alaska has the right idea. You can be convicted as guilty BUT mentally ill. In that situation, if you provide convincing evidence that you are no longer ill, they send you to regular prison for the remainder of your sentence. So, yeah, you first spend time in a psychiatric facility, but your prison term is not overlooked. If you are mentally ill, you remain incarcerated in a care facility. If you “get better” it’s off to the slammer for the rest of your time, which (depending on your sentence) could be for the rest of your life.

  17. I do not think that this is finished yet. Since discussion is under the shade of political correctness, it would be more efficient to observe actions. Of course, the reaction of people to this new normal will pass through the lens of politically correct media, it will be dim at first, but clear over a period of time.

    at the same time the Redbook magazine published an article on the topic how to ‘recognize’ a

    the article was pure speculation, catering to a specific audience. the judge got wind of it and
    — CLEARLY — — AND — –SPECIFICALLY — ordered the jury to NOT consider ANYTHING in the infamous article. sure enough during deliberations, somebody . . . . . . . pulls out a copy of the magazine and ‘yada yada yada the magazine this the magazine that’.
    l wish l had more detail but it looks like it predates online publishing.
    l remember thinking *what else in gawds name* does it TAKE to get a juror to ignore VERY SPECIFIC CLEAR instructions from a court official??? what sort of selfish indifferent GALL to do so in front of all the rest of them???
    l then concluded the mechanism for screening juries was horrible flawed.

  20. Obviously no-one watched the trial. The prosecution was inept, presenting weeks of evidence that Clancy was clearly a nut case going through months of failed treatment by multiple psychiatrists. Internet talking heads were all asking why the prosecution was doing the defence’s job. The prosecution’s expert witnesses came off as incompetent and one even quit his job days within after testifying. I suspect competent psychiatrists weren’t willing to risk their reputation by denying post-partum depression. The defence expert witness was an old fossil who wrote literally the book on post-partum depression. He had interviewed Clancy within weeks of the crime instead of after years of treatment like the prosecution experts. That the jury voted 11 to 1 in favour of not guilty because of nuttiness is a surprise to no-one but the people here.
