  8. Strange that SDA has not covered the the US Court of Appeals review of the US Court of International Trade’s finding that many of Trump’s tariffs are illegal.

    Oral arguments before the Court of Appeals were given today. The case is being tried en banc, meaning all eleven of the court’s judges are presiding, rather than the usual three. Onlookers claimed they seemed skeptical of the defendant’s (that is, Trump’s) arguments. A decision will probably be handed down in a few weeks, maybe sooner.

    Trump is probably gambling that he can postpone a final decision for many months and possibly years by appealing a disappointing decision to the Supreme Court.

          Fascinating. And precisely what action do you think can be carried out against a federal judge for ruling in a way that Trump’s supporters dislike?

          Keep in mind that the only US judges that have been forced off the bench were guilty of bribery and similar felonies.

        Trump — perhaps unwisely — has based many of his tariffs on the International Emergency Economic Powers Act of 1977. There are two problems with that. First, his justifications don’t meet the criteria for an emergency, and second, no where in the act does it mention imposing tariffs, which by default are a power that lies with Congress, not the President.

          1. I love how every judge who rules against Trump is somehow rogue. The US Court of International Trade is not made of a bunch of left-wing activist judges.

            There is legislation that allows the President to impose tariffs under certain situations, but the IEEPA doesn’t appear to be it. He should probably have stuck with the Trade Act of 1974, although that would probably be too restrictive for his purposes.

It also explains the uniparty haste in reinforcing their well lobbied loyalty in supporting the criminal conspiracy of supply management, a US trade irritant that if on the table, could have gone a long way to lessoning the imminent tariffs in store for us. “Elbows-up” worked wonders for the LPC/NDP/CCP regime in maintaining power and it’s perhaps their only campaigned-for mandate that they will honor.     Don’t forget Trump has threatened to tariff our auto industry 50-100%. The WSJ opined Trump is under pressure from trade, who, like, others, refuse to understand Trump is the one applying the pressure.

    If Canada obstinately refuses reciprocity, which is Trump’s endgame, we can count on much more pressure.

    1. I don’t think that’s true. I used to, but given the deals with other countries I think his goal is “tolerable tariffs for thee, zero tariffs for me”. I think Canada would be lucky to get 15% across the board, no supply management and a commitment to securing the border properly.
