And yet, at least 20 years or more ago, I would tell people that they were at risk from the courts, particularly the Supreme Court, after it was allowed and encouraged to become an activist entity by the Constitution and people laughed at me. I told them that the Human Rights Code was not about human rights at all, and they laughed at me.

    Actually settling the French Canadian question could have been done in 1763.

    Nothing short of that has ever settled a tribal dispute anywhere. They go on until one tribe or the other is destroyed.

  5. I’d be a far bigger fan of the Charter if it proved to be an effective bulwark protecting individual rights.

    It hasn’t turned out that way. It’s proven too easy to override such protections by insisting that a restriction “can be demonstrably justified in a free and democratic society”.

    1. Yeah, its whole validity is called into question in that the government of the second most populous province in Canada refused to ratify it (although that same government explicitly takes advantage of the Charter every time it invokes the Notwithstanding Clause).

      1. It is an act of the federal government. No future parliament is restrained by a prior parliament. This is the principle of parliamentary supremacy. The constitution act can be amended or trashed by any majority government.
        The concept of ratification by provinces was hokey from the get go. Not needed. Means nothing.

          Peeair Turdhole did not even meet the requirements as laid out by the Supreme Court of that time which stated that vandalizing the BNA act and imposing constitutional change would require unanimous consent from the Provinces which Turdhole never received.

            Part I of this act contains the charter.
            Part V of this act specifies how to amend this act.
            What is to stop another federal parliament from simply revoking this act passed by another parliament 40 years ago?

            The Constitution Act, 1982, included some amendments to the British North America Act. How can the Canadian parliament change an act that was and remains a part of Canada’s constitution? Answer: parliamentary supremacy.

            With your logic, if today’s parliament added a provision into the Income Tax Act that it may not be amended without 50% of provinces with 50% of population agreeing, that too would stand against any future parliament. It would not!

All democracies eventually transition to tyrannies after reaching this point.

    Does the Turdhole Charter protect John A MacDonald and the Englisg culture as one of the founding “nations” written into the Turdhole Charter ? Does the Charter protect any historically English speaking person or cultural figure or cultural site ? No it does not !
    In fact it demonizes them and cancels them, try doing that to any french speaking historical figure and see how fast the french language gangsters of the french language racket descend upon you with the full force of, “the Turdhole Charter”.

    Turdhole did not care about the so called Quebek anglo and stated so many times he simply thought that the bigots of the separatist movement thought to small. Why force Quebek to speak french when you can force the whole country to be french, that was Turdholes goal.

    The Turdhole Charter doesn’t protect individual Canadians, never has and never will because that was not its purpose.

    The purpose of the imposed Turdhole Charter was to destroy Canada as an English speaking nation with historically English speaking institutions, like the Supreme Court and Parliament. It set up a system that destroyed the notion of Common Law and put the french Quebeker in charge of everything.

    The sinister nature of the Turdhole Charter and the damage that it continues to inflict while offering up zero protections for rights and freedoms for Canadians is how the thing was designed.   14. I happened to be in Ottawa that day, and played hooky from work to go see the ceremony. It was a cold April afternoon, and the skies overhead were the sullen grey that seems to permeate the Ottawan soul. The crowd was smaller than I’d thought it might be, and the ceremony was similarly restrained.

    Betty, as always, was perfect. Her remarks were uniformly positive, and stressed how she shared our excitement at this next step in the Canadian journey. They were received with warmth and affection. She then turned the podium over to Pierre.

    I only remember one thing about that. I don’t remember a word of what he said. His English speech was delivered in that banal monotone some of us remember and detest, and I don’t recall a single memorable phrase. I understand from others that his French remarks were delivered from the heart, and that Pierre himself spent hours on his French oration, but his English one was written by the PMO. Regardless, as a monophone, his French words meant nothing to me, and his English ones, not much more.

    But I do remember one thing vividly, and I chuckled a bit at the time. As I mentioned, the skies were threatening, but they held off during Liz’s remarks. But just a few moments after Pierre took the mike, as he stood before the crowd to finally complete his heart’s mission, and bask in the glory as the man who brought the Constitution home, it began to rain.
