      As I always told my students, when you are dealing with the peace officers, don’t get into a nasty contest with them. You can ask for their ID and ask them to show you the law or regulation that applies, but always remember that they have the endless ticket book and pen.

      I have heard too many drivers talk themselves into a ticket(s) because their mouth was rattling like a loose board in a truck.

  22. A friend of mine once honked at a cop and gave him the finger. He was given a ticket for ‘use of a horn not condusive to safety’. This was decades ago in Nova Scotia. Technically the cop in this video might have been correct that honking for no reason is a minor offence. However, man-handling a senior citizen for this who was literally half his size in front of a camera was beyond idiotic. The government and the police are showing signs of panic. They are scared.

My basic question was, “Why was I stopped and was it reasonable.” The prosecution didn’t want to answer the question. I am not sure such a check stop would yet pass legal muster. Not a lawyer. Never lost a case in tax court for two reasons. I would never take an unwinnable case to tax court and in all but one case the government lawyer settled before it went to court. In the other one it was nice to hear my name mentioned in every tax seminar I took for the next 20 years. Winnable cases are usually the product of someone else’s incompetence not any particular competence.

      Ever get pulled over for speeding and let off with a warning? Lots of people have; it was when a cop could have enforced the letter of the law but used personal discretion instead.

      That could have been done here; the cop chose to go all-in and things got out of control with the camera rolling. Added to that was the obvious attitude by the cops and the thing presents terribly for the Ottawa police. I’d wager he wasn’t congratulated but was reamed by his staff sgt when he returned to his division.

      If a police officer is in plain clothes, they must tell you they are a police officer before trying to arrest, detain, or search you.

      If a police officer is uniformed, they do not have to tell you they are an officer, but if you ask, they must provide their name and badge number.

      Police usually have to identify themselves before entering your home or private property.

      2. CAN YOU REFUSE TO SHOW ID TO THE POLICE IN CANADA?

      You cannot refuse to present your ID if you are being stopped while driving or operating some kind of vehicle.

      You can refuse to show your ID to police if you are a passenger in a vehicle or if they stop you on the street, unless they are investigating a crime that has occurred or they are detaining you.

      Police cannot ask for your ID because of your race, because you are in a high crime area, because you refused to answer a question, or because you walked away.

      1. Interesting read. I’d like to hear a lawyer’s perspective, but most of what you’ve said makes good sense. There are many YT vids explaining why it’s solid advice not to give police any more info than ID required by law, and to ask “Am i being detained” if questioned.

        Talking in a reasonable tone might help prevent a situation from going sideways, too; I don’t imagine many cops use discretion and let people off with warnings who present themselves as utter jerks. A power tripping cop will probably happily go authoritarian on someone mouthing off and a regular guy doing his job may decide the polite motorist he stopped gets off with a warning.

        Regardless, it pays to know your rights and options in case you are stopped.

  34. A clear video of the license plate and or side number of the police vehicle along with the time stamp on your video pretty much defines which police officers are in the vehicle at that time.

    Playing the man is a losing proposition and makes you look very defensive and arrogant.

    What I saw was two angry and, almost certainly very frustrated cops, after all they have terrible leadership and are in an unenviable and difficult position regards current public opinion but that does not excuse their abusive and definitely unprofessional attitudes and behavior. They have done their profession and the Ottawa police force no favor at all. They just applied another push on the pendulum of public opinion that is already rapidly swinging against them.

    1. The Ottawa police took a driver without a license off the road. If you consider their conduct to be unprofessional then do something about it. You hate the cops, I understand that. So, be a man and file a complaint instead of posting anonymous ad hominum attacks against someone you do not know on this pathetic blog. Be a man old timer.

  37. I wish everyone could focus on the fact he WAS an old man. He was being roughed up by a guy twice his size. Larry-very aptly named, one day you will be old. Lets hope the cops do not do this to you when your are this man’s age (well kinda). Your lack of compassion is stark and frankly, I find it upsetting. Similarly I find the policemen’s equally bad. They showed no skills at managing a situation or the reasonable use of force. Not to mention enforcing a law in a obviously vexatious manner. I hope the old guy gets a lawyer and gets their asses canned. I am guessing he will.

    Larry the cop here was abusing his power and loving every minute of it.
    If he’s still a cop a year from now, its because whatever force employs him is rotten to the top.

    Get with the narrative,as this act of stupid violence goes viral,your intellectual superiors over at CTV,CBC and Global will all explain that the two uniformed actors are not Policemen at all..

    No no these are paid activists working for the Evil Freedom Convoy,staging a scene to make the valiant and law abiding Ottawa Police look like Government Thugs..
