There’s a new sheriff in town.

A top Republican investigator said accountability is coming for any of those individuals who may have committed crimes during the Trump-Russia investigation.
 
With the Justice Department conducting a review of that operation, Rep. John Ratcliffe said during a Fox News interview Sunday that he trusts Attorney General William Barr and Justice Department Inspector General Michael Horowitz to provide answers.
 
And while Ratcliffe said he does not want to prematurely accuse any specific person of a crime — as Democrats have done with President Trump — he stressed that it is clear crimes were committed by people during the Obama administration, including government officials.

            1 – Active Duty Military (including newly sworn in trainees)
            2 – Cadets and Midshipmen in officer training programs (OCS, ROTC, Service Academies)
            3 – Military Reservist and National Guard
            4 – Retirees
            5 – Members of Fleet Reserve / USMC Fleet Reserves
            6 – Persons in military jail serving a sentence from Court Martial
            7 – Members of the National Oceanic and Atmospheric Administration, Public Health Service
            8 – Prisoners of War in US Custody
            9 – Persons accompanying military (contractors / DOD civilian personnel) overseas outside of the United States and Territories.

            None of the people we are talking about above, FBI, CIA, NSA, Justice Department personnel in general, civilian politicians, NONE of these people are subject to the Uniform Code of Military Justice because they do not fit the legal criteria.

            The Authorization for Use of Military Force (AUMF), Pub. L. No. 107-40, 115 Stat. 224 (2001), enacted shortly after the terrorist attacks of September 11, 2001, constitutes the main source of congressional authorization for the war on terror. The AUMF grants the President the authority to use all “necessary and appropriate force” against those whom he determines “planned, authorized, committed or aided” the September 11th attacks, or who harbored those persons or groups.

            Major Provisions

            The AUMF beings with a preamble, which emphasizes the “acts of treacherous violence” committed on September 11, the “continue[d] . . . unusual and extraordinary threat” posed by such terrorism, and the President’s “authority under the Constitution to take action to deter and prevent acts of international terrorism against the United States.”

            Section 2(a) contains the AUMF’s main grant of authority:

            [T]he President is authorized to use all necessary and appropriate force against those nations, organizations, or persons he determines planned, authorized, committed, or aided the terrorist attacks that occurred on September 11, 2001, or harbored such organizations or persons, in order to prevent any future acts of international terrorism against the United States by such nations, organizations or persons.

            Section 2(b) provides that the AUMF satisfies the requirement under § 5(b) of the War Powers Resolutions for a specific statutory authorization while at the same time leaving the War Powers Resolution unaltered.

            The Role of the AUMF

            In Hamdi v. Rumsfeld, the Court decided that detention of enemy combatants for the duration of hostilities is an exercise of “necessary and appropriate force” that Congress authorized the president to use under the AUMF. After Hamdi, the AUMF became the main source of presidential authority to detain enemy combatants in Guantanamo Bay, Cuba.

            War Powers Resolution Law and Legal Definition

            The War Powers Resolution of 1973 is a federal law introduced to check the power of the President in committing the U.S. to an armed conflict without the consent of Congress.

            The resolution made Congress not only the sole authority to declare war, but to initiate any kind of offensive operations, big and small. The president’s initiative to defensive war was limited for the purpose of repelling sudden attacks.

            The resolution established:

            1. the principle of collective decision making;

            2. the concept of shared power in foreign affairs; and

            3. the democratic ideal that war power is placed with the legislative branch, which is the branch closest to the people.

            The effect of the resolution is that the President can send the U.S. forces into action abroad only by authorization of Congress or in case of a national emergency created by attack upon the U.S., its territories or possessions, or its armed forces.

            -John Walker Lindh: Fought for the Taliban against U.S. forces in Afghanistan, probably the only American who knew in advance of September 11 2001attack that something terrible was going to happen. Tried by civilian court.
            -Christopher John Boyce: Former American defense industry employee who was convicted for selling United States spy satellite secrets to the Soviet Union in the 1970s. Espionage. Tried by civilian court.
            -Mildred Gillars: American actress who did German propaganda radio broadcasts for the Nazis during WWII. Arrested and convicted of treason in a civilian court after the war. Sentenced to 12 years in prison.

            -Mary Elizabeth Jenkins Surratt: Boarding house owner who rented a room out to John Wilkes Booth. It was believed by a Military Court that she knew of Booth’s plan to assassinate the President.
            She was the first and only civilian woman to be executed for treason in the U.S. Such a trial by Military Court couldn’t happen today, the Uniform Code of Military Justice did not exist in the 19th century.
            This poor woman couldn’t be convicted today on virtually zero evidence.

            If any of you can show any example of a Civilian American citizen being tried by a Military Court under the Uniform Code of Military Justice since it was passed by Congress on 5 May 1950, and signed into law by President Harry Truman(taking effect on 31 May 1951), then I’m willing to entertain your fantasies about Hillary Clinton and her co-conspirators being tried by a military court. Until then, you people are just dreaming.

Is it the same Horowitz that didn’t even mention the immunity deal given to aids of Hillary Clinton for every single destroyed email while simultaneously keeping those emails outside the FOIA (by contractual agreement)?     And, who is going to prosecute these future indictments? Jessica Lieu won’t. She might offer up a slight wrist slap in a Plea Deal. But, she’s not going to level the proper charges. Is Barr going to have to step in and indict these people himself while circumventing his own employee? I doubt it. That’s a media field day.
