Freespeechers Take Note

Free Dominion’s Connie Fournier writes;

The result of Marc Lemire’s Constitutional Challenge could literally make or break our fight against Section 13. It is IMPERATIVE that you email these people, and get EVERYONE YOU KNOW to do it, too!
We can put an end to Section 13 without having to wait for Parliament to wake up…but we have to act today!
I’m going to make this simple for everyone. Here is the list of emails:
THE CANADIAN CIVIL LIBERTIES ASSOCIATION
A. ALAN BOROVOY, GENERAL COUNSEL
e-mail: mail@ccla.org
BC Civil Liberties Association
Jim Braunagel
e-mail: jim@bccla.org
The Canadian Association of Journalists
Algonquin College
John Dickens, Executive Director
email: canadianjour@magma.ca
PEN Canada
email: info@pencanada.ca
Your letter just has to ask them to “intervene as an interested party” in the Warman vs Lemire Constitutional Challenge of Section 13 of the Canadian Human Rights Act.
Make it short and sweet if you like…even two sentences, but PLEASE write!!!

Written arguments must be filed in May, and oral arguments will be held before the Tribunal in June. PDF of the written argument.

  1. That is a well reasoned argument. I fear I skipped a bit of the preamble, but the balance was a good read.
    Cheers,
    lance

  2. Done and added a few politicians as well – like MP Keith Martin as he has a vested interested. Nicholson and Baird’s mail boxes must runneth over and if they dont get the message yet they will be run over next election.
As others have said, regardless of whether or not you agree with Lemire and his views – he really has done the “heavylifting” and exposing of this dangerous serpent and deserves everyones support.
    Does he have a”Paypal” account?

  3. My letter has gone to A Borovoy. In eastern Canada his voice carries a lot of weight and he is well known to be in favor of the freedom of speech issues being removed from all the HRCs given the directions that have been taken over the last 2.5 decades.
Hmmm,,, the BC Civil Liberties Assoc. I heard a rep from here on the local talk radio show recently and remember being highly unimpressed with his positions. Isn’t this group one that is part of the problem rather than being part of the solution?
The other letters will go shortly.

  4. A tip O’ me slouch hat in your direction, Kate- thanks for calling attention to this.

  5. I’ve just sent my letter to all the organizations Connie and Kate have recommended:
    “Date: 1984
“I am writing to urge your organization to intervene in the Richard Warman case against Marc Lemire, under section 13 of the Canadian Human Rights Act.
“In my opinion, s. 13 of the CHRA is an egregious and unconscionable violation of freedom of expression, freedom of the press, and freedom of conscience in a country which purports to be a democracy under the rule of law.
“Who ever thought that the warning of Pastor Martin Neimoeller would describe Canada in the twenty-first century? Certainly not my ancestors, the Baldwins of Cork, who arrived in York—now Toronto—in 1799, and were instrumental in the establishment of Responsible Government in what used to be our fair dominion (pun intended).
“Pastor Neimoeller’s prescient words: ‘In Germany, first they came for the Communists, but I was not a Communist, so I did not speak out. Then they came for the Social Democrats, but I was not a Social Democrat, so I did nothing. Then came the trade unionists, but I was not a trade unionist. And then they came for the Jews, but I was not a Jew, so I did little. By the time they came for me, there was no one left who could stand up for me.’
“Now is the time for all freedom loving Canadians to stand together against the tyranny of the state. Please take the side of justice and fairness and intervene in this precedent setting case.”
And, yes, I’ll cc it to a few politicians. I’m also going to let the Conservatives know that they’ll not be getting a penny from my family until they have the balls to SAY something! All they’d need to concede at the moment is that a large number of Canadian citizens have contacted them about the loss of free speech rights in this country and that they take these concerns seriously.
The HRCs are a creature of legislation and the government could relieve us of this monkey on our backs if there were the will to do so. Of course, with a minority government, the Conservatives are not in a position to enact such legislation. However, they could be actively supporting Keith Martin’s private member’s bill to abolish Section 13 of the Human Rights Act. The Conservatives’ prolonged silence about this crucial issue is a huge insult to their constituency, which generally includes those who are being persecuted. I feel quite abandoned by the Conservatives and they’ll need to do some serious fence mending if they expect my continued financial support.

  6. It’s not enough to write to the following:
    THE CANADIAN CIVIL LIBERTIES ASSOCIATION
    A. ALAN BOROVOY, GENERAL COUNSEL
    e-mail: mail@ccla.org
    BC Civil Liberties Association
    Jim Braunagel
    e-mail: jim@bccla.org
    The Canadian Association of Journalists
    Algonquin College
    John Dickens, Executive Director
    email: canadianjour@magma.ca
    PEN Canada
    email: info@pencanada.ca
I urge everyone to include individual journalists, TV and radio personalities, reminding them of the travesty that the HRC’s are in this country.
It’s not a left or right issue, it’s a state versus individual LIBERTY and FREEDOM a truly HUMAN RIGHT!!!!
Ignore the fact that Lemire may not hold the exact
views as we might as individuals, but whose benign speech will be next hauled up before one of these Canadian kangaroo bodies?
    It may well be YOURS!!

  7. The problem is these so called “Civil Liberties” organisations only support the lowest of scum and whackjobs.
Based on the type of oxygen thieves these organisations circle the wagons around, there won’t be much support for free speech for regular people coming from them.
Don’t be surprised to find them doing everything to counteract our efforts.
Call me cynical, but from observing their actions over time this is the only conclusion I can draw.

  8. Joe, Alberta politicians are fully aware of the HRC controversy raging in the blogosphere but are opting to remain silent and hope that all blows over. They have buried the HRC within a new department (Culture & Community Spirit) with a new appointed/elected minister (Lindsay Blackett). Who knows, they may even be planning to go the route of Czarina Hall and come out with a similar announcement in the near future. With their new (and huge) majority – the AB PCs don’t have to do/say anything they do not want to. They are doing exactly this. Welcome to modern day fascism where 20% of the eligible voters are in complete control for another 4/5 years.
The MSM are also perfectly aware of what is at issue but are opting to also remain, for the most part, very quiet – with exception of course of National Post and Macleans Magazine. IMO, this is based totally on fear of either being brought into and HRC or worse, finding themselves taken into civil litigation. Isn’t this a wonderful country!
Nobody can make any members of the MSM print/discuss anything they do not want to and they, collectively, can either make it happen publicly or not – witness Brenda Martin and the Syncrude Ducks.
The federal politicians are also very aware of what is at stake. National Post (Sat) – has a report of a speech given in Calgary (Fri) by Jason Kenny (see also Ezra’s blog). JK went about as far as he could in terms of castigating the “illiberal use of HRCs” to accomplish a number of nefarious agendas. I haven’t seen where either the Journal or the Herald have covered JK’s appearance in Calgary – much less cover what he said at this particular function. (A Race Relations group)
Click on Connie F’s link above and scroll to the bottom to see the “official” position of the federal gov’t – since the HRC operates at arms length – we allow them to do their thing (my words but the same message).
In the face of this – letters are likely going to be shelved and the CHRC will only be dealt with if and when the PCs get a majority – and who knows that it will happen even if a majority is obtained. 20% (central Canada) also controls the ROC.
The only change now is going to come via legislation and that will only happen when the will exists.
Along the same lines I just emailed
bchumanrightstribunal@gov.bc.ca to ask about the proposed date(s) of the BCHRT hearing coming up in June? (Elmasry et al vs Macleans). I also asked if this hearing was going to be open to the public and if not – perhaps they should re-think any decision not to have it open.
What comes out of these two hearings is going to be critical. ON is already deep fried as regards the ONHRC with the draconian measures coming up in June 30 that are compliments of the McGuinty/Hall duo. It remains to be seen if they are going to take the rest of us with them.

  9. It appears the Canadian Constitution Foundation has applied for intervenor status in this Charter challenge.
    Details here:

Please support them as well. Intervenor actions can cost up to $40K

  10. It is a shame that it takes Holocaust deniers (both Lemire and his lawyer) to generate such a well-written brief on such an important issue. But, it is nonetheless true that the cure for bad speech is not no speech; it is, rather, more speech. You damage a bigot most by publicizing what he says. An example is the recent YouTube video of Hamas’ recent account of the origins of the Holocaust.

  11. Jay: we (free speech advocates) sat still while raging zealots punked Doug Collins’ free expression rights and damaged free press rights because maybe he wasn’t “our kinda folks” because his opinions were controversial or offensive to the status quo…look what that got us…routine attacks on free political expression and the free press by an emboldened cadre of anti-free speech zealots.
Will you wait until an acceptable candidate steps up to the courts to demand free expression be respected? By that time it may be too late.
Free political expression includes everyone…even people we disagree with…particularly people we disagree with who may be unpopular or offensive, because a free society is judged by how it copes with dissenters and dissenting opinion.

  12. Done…
Feels good to take action, thanks for pointing me in the right direction.

  13. Mark Jay states that Marc Lemire and his lawyer are holocaust deniers. This is a very serious accusation considering that there is absolutely no evidence to back it up.
Don’t participate in the Lemire Smear. Expose this CHRC tactic at every opportunity instead.
