Weaver vs Ball: Case Dismissed

I got word tonight from David Ball, son of Dr. Tim Ball via Facebook messenger:
“This morning the judge dismissed all charges in the lawsuit brought against Tim by BC Green Party leader Andrew Weaver. It is a great victory for free speech.”
At the moment, I have no other details, but will update as I have them.

    Was the suit dismissed, or was there a trial and verdict?
    Maybe I am unfamiliar with Canadian Courts, but Mr. Watts seems to say both?
    Either way, Congratulations to Dr. Ball.

  2. case was decided by a judge, Weaver’s liar…erm lawyer did not call any witnesses. The greenies don’t want to have their BS put trial, as it would not stand the riggers of a court questioning, and that would help tank the narrative:-)))

    and then …
    On to reversing the “finding” of the EPA that “Co2 is a pollutant” and is causing the destruction of the globe. That is needed to inform the courts that this has all been a ruse to destroy Oil and Coal as our universal energy source.

  7. I don’t know if the Canadian legal system is like our USA system in this regard, but here, an order to pay “costs” usually means the person has to pay things like filing fees, expert witness fees – money that the winner had to put out of his own pocket to advance his defense.
    But – and this is the important part – it usually does NOT encompass legal fees.
    I haven’t seen the Order for Dismissal, so I don’t know how the judge ruled in this regard.
    If Dr. Ball isn’t reimbursed for fees, it would behoove any of us with a charitable instinct who want to help the good guys to go to his website at http://drtimball.com/donate/ and help him out. He ain’t rich.

  10. It’s good that it’s over but six years and thousands of dollars spent *is* the punishment.
    CAGW activists fear of courts is understandable, Gore’s Inconvenient Truth “facts” got shredded by a UK court in 2007. Lesson learned. The inability to withstand scrutiny is probably why CAGW activists are so opposed to the EPA director’s, Pruitt, proposed team- blue team debate.

    Since Canada uses the English rule… would it be beneficial to contract 6000 lawyers if you are ever hit with one? Basically, guarantee millions to billions in legal costs that the loser has to pay…

  19. Didn’t that piece of crap also lose a case against the National Post? He is a liar. I remember years ago Weaver seriously suggested that his laptop was stolen at UVic by oil-funded people or something along those lines. I was on campus at the time. There were signs all over the place advising people of a rash of laptop theft.
    That being said, neither WUWT or Tim Ball are reliable.

    Simply put, Justice Skolrood was of the opinion that a reasonably thoughtful and informed person who reads the article is unlikely to place any stock in Dr. Ball’s views, including his views of Dr. Weaver as a supporter of conventional climate science.
    Since Dr. Ball’s article wasn’t credible, defamation of Dr. Weaver wasn’t credible either. Congratulations Dr. Tim Weaver.

    True terry, but you left off to soon. Here’s the continuation of that article:
    Ball said despite the ruling in his favour, he’s frustrated that Skolrood saw fit to judge the quality of his argument in the article.
    Skolrood opened the trial by saying he did not intend to weigh in on the global-warming debate, Ball said.
    “Yet here he’s passing judgment on the quality of my article on something he knows nothing about.”

All that would like to study this topic purchase “The Deliberate Corruption of Climate Science” by Dr. Ball and support him in his fight!!
