You wo’t hear a single timid whisper of criticism from any lawyer because, as we all know judges are infallible all-wise super beings incapable of bias or error.
But lawyers aren’t scumbags —-oh noooooooo.
How very Canadian. You think a Judge could actually actually make a definite ruling. Oh no, the Ontario Superior Court Judge takes the classic compromise position. What’s next the “right to face your accuser but not necessarily your accuser “?
Crticize a judge? Lawyers are simply too busy.
You know, sleeping with attractive clients, freeing pedophiles, buying new BMWs, suing people. Poor dears really are booked up.
(Oops I almost forgot – kissing the right political ass to get a judicial appointment takes a lot of time too). ;D

There is no reason she should not be expected to face her accused, face exposed. From all I’ve read the forced full facial covering is a personal choice by women in western coutnries.
Would she not have to claim and prove ‘real physical danger or harm’ and if so by whom?
If by her accusers, then why is this different than any other victim of crime such as this?
One time when I was in court I had on a tartan scarf and my jacket open. It was winter. When my name was called I stepped to the front and the judge very rudely yelled at me to take the scarf off. He was loud and pissed. Not a good way to start your hearing.
About a year later some Jamaican guy was in court and they packed the courtroom. They all refused to remove their big colourful hats. So the judge did nothing just carried on.
Seems like a double standard to me.

If this woman is a victim of rape she should have protection from her attackers.
The right to face your accusers in the case of a vulnerable person who would probably be targeted again are extenuating circumstances.
If I were her I would opt for testifying behind the screen.
If she is from a country where Sharia Law rules she could expect stoning, lashing and/or a jail sentence for compaining about being the victim of this kind of crime – because she is a woman.

I’ve never bought into this argument. No offense. But in Germany many people didn’t support the Nazi’s, in Russia many people didn’t support the Communists, in Cambodia many people didn’t support Pol Pot, Cuba, Egypt, etc. Sometimes the idiots just get into power and you can’t blame the average guy on the street. Not individually anyway. They all suffered like they did support them though.
What we in North America had though, which was supposed to stop this kinda stupidity from happening, was strong Civil Rights Laws. Civil Rights Laws were based on a long history of what’s right an wrong. People such as Rev Martin Luther King, Rev Adam Clayton Powell, Tommy Douglas, Jesus, Buddha, Gandhi, Thomas Payne, etc. Unfortunately the people against Civil Rights managed to get into power and rewrite the laws that should have been untouchable. Rich white folks like Trudeau, Bob Rae, Chretien, who cancelled out the Canadian Civil Rights Act and put in the Charter of Rights. Not being a scholar of American history I can’t name all the bastards who lined up to tear apart the Constitution so they could create the mess they have now.
