It’s not hard to see in who’s favor this dispute is going to be resolved once it gets kicked upstairs to the Feds.
A lobster fishing group in Nova Scotia has failed in its bid to persuade a judge that a First Nation does not have the treaty right to commercially fish for lobster out of season and without a licence.
In a decision released Wednesday, Nova Scotia Supreme Court Justice Ann Smith says the Unified Fisheries Conservation Alliance could not proceed with its claim against the Sipekne’katik First Nation because the court lacked jurisdiction.

Every benefit granted to the indigenous mythically self-governed “nations” by the Crown has no quid pro quo attached. If in this case, the taxpaying non-indigenous have to get permission and licensing to fish while the “nations” don’t, why should the “Nations” receive tax dollar paid benefits. Apartheid inversion isn’t a pretty thing. In the Queen Charlotte Islands, the Haida have Title and a forest resource that could easily sustain them along with fishing rights but prefer to harvest almost nothing while continuing with all the taxpayer paid benefits. In almost every revolution, Judges are prime targets for assassination which should be a mystery to no one. Most politicians could be added to that elite club.

I remember that Washington native band that insisted they had a ‘right’ to whale in their traditional manner: with a Zodiak and a .50 caliber Barrett. Turns out that they just wanted someone in the government to pay them *not* to do it (which they quickly did, after one brutal kill).

If the truth be known fresh water fish are federal too. There are a few federal fisheries officers in Alberta wandering around with their thumbs up their asses. They tolerate provincial fish cops but have been quite snotty in times past.

There is one court system with different levels. Lower level judges are appointed by the provinces. Higher level trial and appeal court judges are appointed federally. All courts can hear cases involving local, provincial, and federal law.
The Federal Court of Canada serves one purpose, that being a venue to sue the federal government. Tax cases typically start out in the Tax Court of Canada and are appealed to the Federal Court.

Treaty Land is Crown Land, they have zero rights, no vetos, and no say what happens.
Natives signed away their rights on those numbered treaty lands.
Any land developed/claimed without conflict is ceded land including Parks, roads, municipalities, any land they did not fight to keep.
