If you dig around on how Britain and the United States dealt with the Oregon territory in the early 1800s, there was no clear sovereign claim to west coast lands.
History also shows very few indians lived in the interior part of what is now British Columbia. There was no meaningful social structure. Any settlements were basically a few people that were passing through the area. That is the basic reason why no treaties were signed by Britain, the United States, or Canada.

A Senate committee has voted ten to one to pass sweeping amendments to the government’s Bill S-2, ending what’s known as the second generation cut-off and implementing a one-parent rule, that allows anyone with status under the Indian Act to pass their legal identity and rights on to their children.

Certainly the Canadian government could do a Constitutional amendment saying that no foreigner or foreign tribe can make any claim to aboriginal rights and no court can entertain any such claim. Just do it. End the worst of the stupid.
There is no practical way to amend the canadian constitution.
