2. In a society where all citizens should be equal before the law, the very concept of Gladue being an accepted guideline or rationale in sentencing, is accepting of gov’t entrenched and sanctioned racism.

   On an unrelated to Gladue note, I wouldn’t advocate for a sentence longer than the minimum for 2nd degree murder though, as in my opinion, it raises the possibility of 2nd degree murder being the ultimate result in cases of sexual assaults / rape. A parent may try to do the best they can with their child after an event such as this however damaged that child is, but there is no recourse once they are dead.
   That’s why.
   It’s grotesque, offensive to most, but I think I’ve got this right, unless of course all murders are raised to 25 years (for example) which could then allow for sexual assault / rape sentencing to be raised to 15 years +/-
