We’re All In This Together

Blacklock’s- Dep’t Denies Duty Of Care

A judge has dismissed a liability claim by the family of an Ontario high schooler who died weeks after taking a Covid shot. The Department of Health had no “duty of care” to individual Canadians inadvertently harmed by pandemic measures, said the Court.

Sean Hartman, 17, of Beeton, Ont., died suddenly three weeks after taking a Pfizer-BioNtech vaccination.

    1. No, the mourning judge would recuse (of their own volition they wouldn’t even think of going against the grain) and the replacement would find in the exact manner that maximizes the power of the collective and simultaneously minimize the responsibility; in the one-in-a-million chance it didn’t result in an out of court settlement under undisclosed terms.

No matter what the only culpability or compunction will come by way of a weepy, meaningless, performative apology decades hence by whatever passes for a head of state by then.

  1. judgey judges just love setting precedents. l wonder if he got
    a call/visit from their superiors?
ah, BUT *from now on* leaves the door open for ANYONE AND EVERYONE to thumb their noses FOREVER AND EVERYTHING the mass ‘edicts from on high’. aka actions have consequences. hmmm. is that a question?

    1. Very yes. If they don’t have a duty of care, I don’t have a duty to accept “care.”

  2. There you have it. Nothing means nothing in this country. A good leader would immediately move to vapourize the Department of Health after this ruling.

  3. The courts have spoken, no justice for vaccine injuries or death in Ontario. Even my GP gave me a hard time because I am not vaccinated. We are f@#ked here in Canada.

  4. otoh, there are those whose lives surround the child, LOADED to the gills and when the child passes from such as this, the proverbial ‘bottom falls out’. but in their state of grief, a different personality characteristic takes over. with quiet iron-fisted resolve they convert all assets (that were destined to go to the now deceased offspring) into something of a tiny well armed army. trackers, spies, front line soldiers, and then on their own ‘D-day’ they strike and kill as many of those they hold responsible for the MURDER of the kid.
me? well, l thought of it didnt l? the missing part is the huge fortune.

  5. This is why a change of gov’t will not result in any meaningful change to the “way things are done” in what is left of Canada.
We have an unelected and unaccountable activist judiciary who will support any leftist agenda or narrative and quash any conservative or normative actions. All that the usual suspects have to do is appeal to the courts, and anything a conservative govt does other than window dressing will never see the light of day.

    1. It’s why go-along, get-along conservatives (aka Red Tories here in Canada) accomplish nothing that lasts. They leave the overall liberal framework in place; they just freeze it in place until liberals take power again and continue ratcheting everything to the left.

What Canada badly needs a leader akin Milei who’s willing & able to take chainsaws to large parts of the state apparatus, and there ain’t one of those anywhere in sight. We haven’t yet gone through the necessary decades of dysfunctional everything that Argentina did. Maybe by 2060 or 2070, assuming AB & SK haven’t smartened up and gotten the hell out first.

      1. “It’s why go-along, get-along conservatives (aka Red Tories here in Canada) accomplish nothing that lasts. They leave the overall liberal framework in place; they just freeze it in place until liberals take power again and continue ratcheting everything to the left.”

Exactly right. It’s why the Reform Party was first created…people were growing frustrated with the “Liberal, Tory, same old story…” routine. I’ve been fooled too many times now to trust Poilievre, especially given his past statements and actions that point to him being just another Red Tory in disguise. Someone prove me wrong. Please.

      2. Next to impossible with the Westminster Parliament form of government. Legislative and executive branches are one and the same. The executive appoints the judiciary. The rot and corruption just magnifies from there.

      3. We have one, his name is Max Bernier of the PPC party. However everyone wants change however no one has the balls to vote for it. Every time there is an election, it is always we can’t chance taking votes from the conservatives, therefore nothing happens. It is just a dog chasing its tail in this country. There are too many sheep out there. They let the press dictate as to who is going to be in the debate. All party leaders should be, but they do not want Max and his message to get out as it would change things. Canada, stuff it, I am hoping Smith has the guts to separate and become our own country. This is my honest opinion. God bless everyone.

        1. Max Bernier is a Lieberal plant to split the vote who lives in Florida. He doesn’t have a proper party structure. He has a private business. He has never on even a single seat for good reason. And that government papers at his organized crime related ex girlfriend is not exactly awe inspiring.

    2. The activist judiciary isn’t going to change any time soon. Take a look at the crop of legal beagles coming out of the law schools. MOST of them of the DEI/woke variety.

  6. the entire justice system in canada is totally corrupt from the supreme court on down including the rcmp

  7. Exactly how the police have no responsibility for the safety of any individual person. If a person is murdered by a released violent offender, you can’t sue anybody. They’ll tell you “you are responsible for your own safety” but they also restrict your ability to protect yourself. And throw in jail if you do.

    Nice gig, isn’t it.

    1. Nice gig, isn’t it.

I believe the phrase you’re looking for is “It’s good to be the King’s men.”

  8. So governments can use coercive force and punishment to make you take an experimental injection but has no responsibility or accountability for injuries or death from those same injections. This is exactly why coercion by government during covid was appalling and unethical. Human and constitutional rights were completely destroyed and very few people seem to care. What a disgrace.

Kudos to all of us who said no, despite the abusive treatment by fellow citizens and governments.

    1. The coercion was also a violation of the Nuremberg Code. This is never acknowledged. Canadians should be ashamed of their country. Some are, but too many deny ay wrong doing.

      1. It’s an ego problem. Admitting that you were wrong is always difficult. Admitting that not only were you wrong but treated others inhumanely is impossible for most people. Very, very few people will acknowledge their bad behaviour under those circumstances. Only a handful, those with genuine introspection and integrity, would admit it and also apologize for their behaviour.

        Plus legal liability, of course.

  9. This just adds salt to the wound inflicted by the judicial process when the case of Detective Helen Grus is examined. Detective Grus, IMHO, was conducting herself as a dedicated law enforcement officer when she considered the possibility that the Covid injections were affecting nursing mothers, newborns, or pregnant women. For a court to find her guilty of actually caring enough to put her career on the line is another indication of how this country has been betrayed by the politically driven justice system. From all of the indicators that have been exposed over the last ten years, from the numerous political scandals, to the horse stompings, to the ‘fringe minorities’, to the ‘what are we to do with THESE people, to the vilification of the truckers convoy and the bank cancellations, to the charges of ‘mischief’, this country is absolutely DONE. There is no turning back from this sewage pit that we have allowed ourselves to be dropped into. As mentioned above at some point there will be an over whelming desire from the populace to right this situation and it won’t be accomplished at the voting booth, we are already seeing how the electoral process is already FUBARed. As an afterthought how do you tell the difference between an American and a Canadian? The Canadian, like sheep, will go meekly to the slaughter.

    1. Grus should be given an honor for her steadfast pursuit of truth. Instead,we honour that Chinese woman who is suing the truckers. I think the city face her and award of done kind. A shameful attack on democracy.

    1. Sure gym, because it was the bible pounders who arranged all this.

      You f-ing idiot.

      1. gym, you idiot! You actually believe “bible-pounders” support this corruption?
You are truly blind! You once accused me of not being “self-aware” (your words).
It’s well past time that you take a good hard look at yourself, but of course, you won’t, because deep down, you know the truth, but are too proud to admit how totally wrong you are about people of faith, who actually believe in something good. I’m afraid you’ll never know what that feels like, because you’re too focused on your hate to see clearly.

Capt. Ahab has nothing on you, but you should learn from his example of what obsession can do to a person if it’s not managed with reason.

    2. gym, you idiot (part 2)
I know of priests who were F0RCED to take the vaccine so that they can continue with their missionary work. Given the choice, this one priest that I’m thinking about would have never opted to take the drug, but thanks to “non-bible-pounders” in government, that choice was taken away!

      Open your eyes, for cryin-out-loud…

      1. Wasn’t there a bible pounding preacher in Edmonton who was constantly harassed by the cops for having the impudence to hold service during the COVID bullshit?

  10. This is not about politics, but morality. The government of Ontario, which preached vaccination, lockdowns, etc. and allowed companies to have coercive mandates to stay open for business in the face of said imposed lockdowns, also preached that the injections were “safe and effective”, signed stupid and damaging secret deals with Pfizer, Moderna, and J&J, and now denies any responsibility for their actions which is cowardice, denial of responsibility and lying. These traits come from misplaced and distorted moral codes. Yes, I am calling out socialist policies as fundamentally immoral. And there is no shame evident in any of them, a sure sign of immoral beliefs and ideological capture.

We are faced with an array of choices, all of them bad because the moral code is gone.

  11. L- Lessons from the Panic-demic: The Department of Health isn’t what its name says it is.

Would a A.I. high quality program presenting a list of true risks for said experimental injections, be able to explain informed consent truer than physicians threatened with losing their livelihood, bankruptcy and never being able to practice medicine ever again?

  12. The Covid release/escape response was an internationally coordinated Bio warfare response and cover-up. Being a multi-state enterprise its M.O. was deceit and control. The Judge has his orders.

  13. Did they not suggest young males in Ontario not take the vaccine the second year in due to the risk outweighing the benefits? Even though some doctors were warning about heart damage the first year, or am I mistaken?
Most didn’t need it anyway but regardless unaccountable pieces of sht one and all.
And I’ll second what I.M. said above .
    He’s right.

    1. The odds of a 17 year old normal male dying of the Wuhan were probably 1,000,000:1.
In a just world, anyone who pushed this on children and teenagers would be crucified.

      1. It was 1.2 deaths per 1,000,000 using the Gov of Ontario’s data.
In comparison, accidental death rate for this age group is about 100 per 1,000,000 and suicide about 95 per 1,000,000 and homicide at 15 per 1,000,000.

  14. So in other words, the Department of “Health” can now order people to essentially invoke MAID on themselves.

  15. I don’t know if this is the same writeup at Blacklocks, I’ve copied this from a poster on Failbook and included the fundraiser for this person who is in Ontario, and I know nothing else about them except for what’s here, and the dismissal of the court case.
When “Canada” asks you to step up, to put your elbows up, or as JFK said long ago, “Don’t ask what your country can do for you, but what you can do for your country” … keep in mind that if/when it all goes sideways, they’ll toss you aside and claim they never knew you.

“Lawsuit against the Canadian government over teen’s sudden death following Pfizer COVID-19 vaccination dismissed by Ontario judge.
An Ontario judge has dismissed a lawsuit filed by Dan Hartman against the Attorney General of Canada, Health Canada, and former Canadian Health Minister Patty Hajdu for misfeasance in public office, deceit, fraud, and negligence over the sudden 2021 death of his 17-year-old son, Sean Hartman, who was found dead on the floor beside his bed just over a month after receiving a Pfizer-BioNTech COVID-19 vaccine.
In a ruling from the Ontario Superior Court, Justice S. Antoniani struck down the case without leave to amend, finding that it had no reasonable prospect of success. The court determined that the government did not owe a private duty of care to Sean Hartman and that public health decisions, including vaccine approval and promotion, were core policy matters shielded from liability.
Sean Hartman was a healthy, active teenager from Beeton, Ontario, with a deep passion for hockey. When the Ontario Minor Hockey Association imposed a vaccine mandate for the 2021 season, Sean complied, receiving his first and only dose of the Pfizer-BioNTech COVID-19 vaccine on August 25, 2021.
According to his father, Sean developed troubling symptoms within days of receiving the vaccine, including “brown circles around his eyes, a rash, vomiting, and an extremely sore shoulder, opposite to his injection shoulder.” He was taken to the emergency department but was reportedly sent home with pain medication.
Thirty-three days later, on September 27, 2021, Sean was found dead beside his bed. A government autopsy determined his cause of death was “unascertained,” meaning no definitive explanation was found. Seeking further answers, Dan Hartman consulted U.S. pathologist Dr. Ryan Cole, who concluded that Sean’s death was caused by spike proteins from the vaccine accumulating in his adrenal glands.
Dan Hartman initially filed a claim with the Canadian government’s Vaccine Injury Support Program (VISP), but it was denied within a month due to what the government called insufficient evidence. He has since appealed, providing Dr. Cole’s pathology report, but has yet to receive a response.
In his lawsuit against the government, Hartman alleged that Health Canada and the Minister of Health made false and misleading representations about the vaccine’s safety and efficacy, failed to assess and monitor risks in accordance with their own mandate, and did not properly warn the public about potential adverse effects, including death. The claim argued that these actions created a relationship of proximity between the government and vaccine recipients, giving rise to a duty of care.
Hartman further claimed that the government was negligent in failing to disclose an increased risk of myocarditis in individuals under 40, particularly in adolescent males, and that it failed to conduct adequate post-market surveillance to inform the public of potential risks. The lawsuit also alleged misfeasance in public office, arguing that Health Canada and the Minister were either recklessly indifferent or willfully blind in their oversight of the vaccine approval process and knowingly made representations that misled the public.
The defendants argued that their statements about the vaccine were made to the general public as part of a broad public health campaign and did not create a specific legal duty to individual recipients. They also contended that vaccine authorization and public messaging were core policy decisions made in the interest of public health, which courts have previously ruled are immune from liability.
Justice Antoniani’s decision follows legal precedents shielding governments from liability over public health decisions. The judge cited past cases in which courts ruled that vaccine approval and public messaging serve the general population rather than creating legal duties to individuals.
“The representations made by the Defendants here were the expressions of core policy decisions, made in an effort to protect the general Canadian public during a pandemic,” the judge ruled.
While the lawsuit against the government has been dismissed, Hartman’s case against Pfizer, the manufacturer of the COVID-19 vaccine, is still making its way through the court system. That case may take a different legal path, raising broader questions about corporate responsibility and vaccine safety.
Hartman has been outspoken on social media about his son’s death and has been working to raise funds for his legal defense.

  16. Unvaxxed and proud.

Nothing in the last 5 years has even suggested that I might be wrong.

  17. “Yeah, yeah, even better, let’s stick it in pregnant women and baby’s arms.”
    Leftards

  18. I’m no lawyer … but that’s an INSANE Legal theory.

    a) The government can mandate a personal “medical” procedure(s), under penalty of the Nation’s full power …
    b) The nation bears no responsibility for harm arising from their edicts

    1. Sorry Kenji, that is not an insane legal theory. Not even in the USA. That’s how it is.

Divine Right of Kings: the Crown cannot be held responsible for harms occurring because of their edicts, actions or inactions. Not even preventable harms. Not even obvious, well-known and inevitable harms.

Gun control, Kenji. The State of California bans your sidearm, they come and take it away, and the next day the gang-bangers kill you? Your heirs have no case! The State of California has no duty to protect your life, even when they take away your only means of defense.

That’s why the Framers of the US Constitution added the First and Second Amendments. Because they were honest men, and knew scoundrels would arise. People would need the means to resist tyranny.

And that’s why Canada was formed the way it was. Because the Founders of Confederation were a bunch of lying, cheating, thieving nobles with their eyes on the main chance. Men who cared not a single damn for the lives of Canadians. You can tell by the structure they put in place. Peasants do the working, starving and dying, the elite do the eating and enjoying life. Shut up and get back in line.

Makes me want to spit at times like this.

      1. I understand sovereign immunity … kinda. So what category of sovereign immunity does THIS breach?

        https://www.npr.org/2021/03/13/976785212/minneapolis-agrees-to-pay-27-million-to-family-of-george-floyd

Our Western Nations surely put the knee of personally endangering COVID edicts on the entire population. And when that knee caused harm to vulnerable citizens, then where’s the payout?

“Civil Rights violation causing wrongful death” … yeah the COVID edicts did EXACTLY that

        1. There was another case lately, last couple of days, from I believe Florida, where a guy got the schlitz beaten out of him by “ruffians” in front of a cop. Said cop did not get out of the car to stop the beating. Disgraceful. Guy nearly died.

It goes to court, and the court blithely decides that the police have no “duty of care” to save the citizen from the “ruffians” and therefore no duty to pay damages for their obscene dereliction of duty, or for their abject failure to enforce the law.

But family of George Floyd gets $27 megabucks because the cops DID THEIR DUTY.

Because what somebody really wants is for the cops to never get out of the car. Unless you didn’t get your mad-science jab. They can get out of the car for that.

          1. Oh, oh, oh!! I have an idea! There’s no liability for COVID … because … because … EMERGENCY!! That’s the ticket! All Constitutional and Civil Rights were suspended because … “Emergency Powers”!!!

Oh. Wait. George Floyd got kneeled on May 25, 2020 … during the COVID “Emergency”.

            Nevermind.

          2. Yes, the Emergencies Act, in Soviet Kanuckistan, says exactly that. I believe the text reads “100% get out of jail free, do anything you want.”

And it works. Nobody went to jail except the Freedom Convoy people. Not even the cop that trampled an old lady with his horse.

      2. Ohhhhhh … silly me. Nowwwwww I get it.

“Two-tier” … we are living (surviving) the era of “two-tier” Justice.

    2. L- Kenji, yes a most astute observation! By law, it is the individual physician, who is licensed
to diagnose illness and treat patients, and thus takes professional responsibility for that.

I recall a judgement in Portugal ruled that only a physician could diagnose a patient to have a Covid-19 infection. When Public Health officials, aided and abetted by Colleges of Physicians,
prohibited physicians from diagnosing via symptoms rather than an P.C.R. Test alone and prohibited them from treating sick people. Literally, Departments of Public Health aided by Physician regulatory bodies, in effect, collectivized medicine. They violating the very concept
      That of individual Rights.

The Right to Life, bodily integrity and informed consent violated but not repealed, as Common-Law nations are based on the theory of individual Natural Rights, given by God. Without Freedom of Speech, no other Right can long endure tyrannical government. Are there a majority on the Supreme Court of Canada believe in the theory of Natural Rights? No one
here had any right to even ask.

In Canada, there is no public vetting of Supreme Court appointees. Certainly, no questioning by any elected Senators, as you have in America. P.M. Justin Trudeau had absolute power in his appointments.

    3. This is Canada Kenji, you see it through the lens of a free country. The Laurentian Elite decide the law here, the judges backstop it, and you….STFU if you know what is good for you.

  19. “The Department of Health had no “duty of care” to individual Canadians inadvertently harmed by pandemic measures, said the Court.”

Yes. Under the current Canadian system, the government and it’s minions do NOT have a duty of care. The cops don’t, firemen don’t, the health authorities don’t, and so forth. It doesn’t matter what they order, they are not on the hook for it when it all goes wrong.

But you, John Q. Citizen, have a duty to obey. You will TAKE the mad science genetic modification shot, as commanded, and you will shut up about it, or you will suffer the consequences. Which will never stop, so long as you still live.

Yes my friends, that is how it is, here in the Demented Dominion. And it has always been this way, since 1867. Only now do we finally see the reality hiding under the maple leaf propaganda.

And people wonder why #Liberals love gun control.

    1. “The Department of Health had no “duty of care” to individual Canadians inadvertently harmed by pandemic measures, said the Court.”
“But you, John Q. Citizen, have a duty to obey.”

This is why our system is 100% void of integrity and logic. And why it is (almost) impossible to do something about it. Depressing.

  20. So the government can poison us using the pandemic act but they have no duty of care, did I get that right? My gawd we aren’t even afforded the rights of a dog or cat, that judge should be removed from the bench-my opinion.

  21. It brings to mind the tragic front page story from Britian that Kate showcased precovid of a person struggling in a muddy duck pond while surrounded by at least 20 high vis, yellow wearing emergency response people, firemen, cops and ambulance watching him die.
The only action they made was to arrest another citizen that dared wade out to fetch the drowning guy back in from the waist deep water.

  22. We’re back to the feudal system. You are not a citizen but a subject. No different than regular livestock. The laws are there for the benefit of the monarch, the lords and the barons. There is no justice system. It is a legal system and rules are to be followed no matter how unfair.

Sadly, the majority of Kanadians are fine with this. Government takes on their responsibilities for self awareness and thought processes. The vague free stuff keeps them quiet. Anyone that objects is made the subject of scorn and ridicule. Most Kanadians cheered, if they knew about it, when the TPS mounted unit stomped two people in Ottawa.
The annoying trolls here on this site with their lieberal ignorance and arrogance prove my point. Next scamdemic, Kanadians will still fall in line for the cull shot and ostracize anybody who says “wait just a minute here.”

    1. “Sadly, the majority of Kanadians are fine with this.”

Because misery loves company. You are not truly Kanadian if you’re not miserable along with the rest of the population. It’s your duty as a Kanadian to be miserable, and to shut up about being miserable.

So start waving that flag, team Kanada!

  23. “Compostable Canadians are Soylent Greenbacks for Central Bankers”

  24. All despotic Regimes that pretend to be “democratic” and only do whats best for their slaves foster and nurture a corrupt Judiciary.
Turdholeland is one of the most corrupt despotic institutionally racist country’s on the planet.
Corrupting the judiciary is a key part of the, “Just Society”

  25. Judicial power is a helluva drug. Look what’s happening South of us…a no name Biden appointee judge who got his degree from a cereal box is giving Trump fits.
Don’t know if anyone remembers but I sure do…in the mid 2000’s I wasn’t sure who was PM, Harper or Bev Mclachlin.
Mandatory sentences? Nope, sorry, unconstitutional…please try again. And on and on it went. Our Charter was a living breathing document. And when they find themselves really behind the 8 ball they’ll pull out the ol’ tried and true. “Peace, Order and Good Government” ruling.
Where is she now? Rubber stamping Chinese edicts to Hong Kong.
Of course she bristles when she’s accused of being a Chinese lackey…”If that were true I certainly wouldn’t allow myself to be here”. No right…because you’re that righteous. Uh huh.

  26. Isn’t there a saying that the bigger the criminal organization, the lighter the punishment? A government is the largest organization of all, so even if their actions lead to someone’s death, it’s shrugged off as no big deal. The larger the organization, the more it’s assumed to be acting in good faith. Yet, if you fail to pay a ticket, your life can be destroyed. As an individual, you’re automatically seen as worthless.

  27. Sounds like there is no way to address government negligence and duplicity. It is not surprising that people are losing faith in their institutions. The institutions have abdicated responsibility for their actions..

    1. I lost all faith and trust in all institutions years ago (2020, the year of gaining 2020 vision).
Recall that at the most recent WEF coven, the theme was “Rebuilding Trust.”
How is that working out, agenda ghouls?

  28. I never really do what I’m told.. Its sad that such a negative character trait ended up being the right decision..
