Carbajal-Flores was charged under Title 18 of U.S. Criminal Code, which legally disallows undocumented individuals to possess firearms and ammunition “or to receive any firearm or ammunition which has been shipped or transported in interstate or foreign commerce.”

  1. the frustration level a story like this, all thats left is a wish that thru some sequence of random circumstances, this ruling results in the judgey judge herself getting a bullet in the head.

    1. Anybody that gets his rights back from any government is a win.

      The ruling is correct. In the USA it IS unconstitutional to ban a resident from owning a weapon over misdemeanor convictions or immigration status. You can -deport- an illegal immigrant under the constitution. But you can’t take away his rights if you let him stay.

      Now, was this decision made to embolden illegal immigrants? Yes, I expect it was. Will -citizens- and legal immigrants get the same treatment? Hell not, they won’t. But it doesn’t matter, because the precedent is now set, if it stands. Federal, state or local, people with misdemeanor convictions and illegal immigration status cannot be banned from owning guns in the USA.

      Compare and contrast with Canada.

  2. The fact is, you can arrest someone for being there illegally, but you can’t arrest him for being armed. The fact that so many are too stupid to understand that is depressing.

    This is pure anti-gun media spin, like saying “Constitutional Carry means bank robbers can carry guns.”

  5. So he was charged under Title 18, SS 922 (g)(5)(A) for being in possession of a firearm, and the Judge just made law that he can’t be charged because of his status.

    I’m sure the Judge wouldn’t allow any legal alien the same latitude.

      But I don’t care, because in this case the disruption is going in my direction. Nice decision, I’ll take it.

    The latest ATF Form 4473 specifically states that a person answering line 21 L “Yes” is prohibited from receiving, possessing, or purchasing a firearm.
    “21L. Are you an alien illegally or unlawfully in the United States?”
    Wut?
    And then there’s that little issue with the FBI’s NICS e-check…

    1. They don’t do Form 4473 and NICS when you’re buying out of the trunk of a car behind a bodega in Harlem. Or Austin, for that matter.

  8. Owning a gun ought to be illegal. Minimum of 5 to be legal. ( Or two water cooled, belt feed, crew served )
