Leonid Sirota: On the Emergencies Act, the Senate gets an equal say. It should lead
Back to the government’s emergency declaration: does the same convention mean that the Senate ought to follow the lead of the House of Commons and assent to it? It does not. Let me explain.
First, approving an emergency declaration is a different task from that of legislating. The House of Commons and the Senate are not making law. They are scrutinizing and checking the cabinet’s decision-making. Here, the electoral credentials of the House of Commons matter rather less than when it comes to enacting new laws.
It seems to me that the Emergencies Act itself is flawed. As the Emergencies Act has the effect of removing Charter rights, the invocation of the Act should require the same approval as a change to the Constitution itself. The Charter is, after all, 1. We are told, to protect its citizens from government and not the other way around and 2. a part of the Constitution.
The Emergencies Act to be invoked should require the same support as required by the amending formula itself. The provincial legislatures should be involved. Otherwise, the feds are simply overriding not only law, but all provinces all on its own.
If it is a TRUE emergency, then it should be quite simple to have the Act invoked. But this isn’t an emergency by ANY measure. The provinces have their own ability to enact states of emergency.
This is overreach on a biblical scale.

The first thing(s) after the Liberals lose the next election that the new government addresses should be to remove the Emergencies Act from the statutes, along with the likely soon-to-be-passed curbing of free speech bill (C10) and defunding the CBC and legacy media. Along with making the media grow up would be to acknowledge the alternate media, like Rebel News, True North, The PostMillennial, which along with Viva Frei, Donna LaFramboise and so many others showed the truth of the Three Weeks Fiesta on The Hill that the Freedom Convoy brought to Canada and the world. I noticed with some pride and satisfaction that Kate’s SDA was referenced as the go-to site on convoy news in a great many prominent platforms of the right. That was due to SDA’s tireless and creative crew and many astute commenters here. Even as independant journalists and reporters were maligned by the government and legacy media, who spread Trudeau’s “misinformation” about the nature of the protesters, they again proved themselves to be necessary, and helped awaken many Canadians.
The Liberals have lost all credibility, and must be wiped out in the next election, which should happen at the first opportunity. Opposition needs to follow the Truckers’ example and be courageous. So much is at stake.

Well, I understand there are a couple of court challenges coming forward.
People wanted democracy, well now they’re going to get it, good and hard.

If the prisoners in a prison get to elect their wardens from a pre-selected pool of candidates, then that prison is a democracy.
We have “Conservative” wardens, promising more yard time, and “Liberal” wardens, promising more free smokes.

Just rubber stamp the fascism already and stop the pretense of democracy.

The so-called independent senators are all Libranos. Any one who thinks they might vote this travesty down is whistling past the graveyard.
Well, I suppose I should apologize to the whistlers given that the possibility that the Senate might have been prepared to vote No may have prompted the about face, but, I won’t on the technicality that they didn’t actually vote.
I will give a nod to anyone who thought the Senate would do the right thing and say that they were whistling a very pretty tune. Heh, heh.
