Since 1982 asking any Canadian court to determine if a liberal government is limited in its jurisdiction is a losing proposition, unless you are covered under the liberal protected species act (aka the charter).
With the foregone conclusion that the court would rule this way the better strategy is to frame the question in such a way to make the decision a poison pill for the court.
Rather than ask the court to decide if the government has constitutional jurisdiction to levy a carbon tax, ask instead if its constitutional for a federal tax to only apply to some provinces but not others.

It is highly unlikely it will be won at the scc level. There is however a simple solution. The Provincial government should take over the taxation. It should be called the provincial carbon sales tax . And as it is to be revenue neutral , it should be immediately rebated at the point of sale. Provincial sales tax is gst exempt. I believe it may be defendable in court.
Interesting workaround.
Alberta should add a climate action tax to all oil and gas leaving the province. Then we tell Canadians it’s revenue neutral … they get the money back in equalization.
It was a 3-2 decision so I wouldn’t be so pessimistic that it won’t be won at the SCC level. Obviously there is considerable disagreement. And this isn’t the only court case in regard to this nonsense. But I do like the concept of an immediate rebate at the point of sale.

It is highly unlikely it will be won at the scc level. There is however a simple solution. The Provincial government should take over the taxation. It should be called the provincial carbon sales tax . And as it is to be revenue neutral , it should be immediately rebated at the point of sale. Provincial sales tax is gst exempt. I believe it may be defendable in court.

Alberta should add a climate action tax to all oil and gas leaving the province. Then we tell Canadians it’s revenue neutral … they get the money back in equalization.
