11 Replies to “12 Trademarks”

  1. I guess the Patent Office forgot about the trivial inconvenience called the First Amendment. A trademark obviously has to be on the extreme side of racist or vulgar to be denied protection. Apparently the N-word is okay but Redskin, a word that most people don’t even see as racist is not.
One other thing, an unregistered trademark is still protected under common law. A user of the name Washington Redskins would likely have to prove that he was unaware that the name was owned by someone. If you’re selling football jerseys, that might be difficult. Why don’t they just give the owner $ 2 Billion.

  2. Never saw an Indian or any other of the human race with a red skin unless they got sunburned. The Indians/Natives are laying claim to our lands so why not claim the term redskins if they can cause the white man trouble and expense? IMO we should ignore them. What’s next? What’s next on their agenda to stir up shit? The Braves, the Hawks?

  3. Liz – Yep, they’re not red is correct, but I’m called “white” and I’m actually a pale beige if my mirror is not distorting things. But perhaps I am a “paleface”, yet I haven’t seen that term banned. This whole thing is a politically correct tempest in a teapot (unless it is a TEApot and then some twit would call that raciest on the erroneous assumption that the TEA party is racist not just against higher taxes). I despair for “modern” society.

  4. liz, one tribe used to dye their skin red. there is more info out there it can be found if one looks. I can’t tell where but I did read about it a few weeks ago.

  5. and then there is “Gypsies” who mistakenly thought to have come from Egypt but are from India. More bullshit, we came from the caucuses, moved to India, and then back to Europe, these fools can’t even git things rite. And yes, gypsies are largely a bunch of welfaring, thieving lazy SOBs.

  6. If an American Indian owned the Washington Redskins, this wouldn’t be an issue at all.
It’s class warfare brought about from the same people that keep “lower classes” of people, stuck in lower classes with their socialised everything.

  7. I can only assume that the owner of the Redskins is a Republican or some other sort of class enemy.

  8. Yes, that would be “war paint”not their natural colour, they did have their pow-wows. Now some chiefs just dress up in feathers and beaded leather garb and prance/dance for special occasions but never see any red painted faces unless from the vino.
Not sure if the chief who said they would bring this country to it’s knees was decked out in “official” garb, but it makes them look much more important.
I don’t apologize for being fed up with their antics, if they want respect they better start showing respect for the hands that feed them by honouring ancient treaties and setting up homes on reserves in remote areas not suitable for a livelihood. They no longer live off the land, they use all modern conveniences and machines like snowmobiles and four wheelers. The chiefs live large, we know some drive Caddies most working people couldn’t afford. We need to call a spade a spade, cut the crap.

  9. This is a Marxist principle that has been used by Courts in applying “the laws of today” to successful business & established norms. If they get away with the Redskins..Look-Out
An example was the PEW Trust that was created in a Will in 1948, and included a benefit “only” to Irish Students…The PA Courts overruled that benefit in the Will in the 90’s. The present PEW Heirs, on the Board, are communist and did not fight the change
    Black Robe Communist Trash
