Islamic law is to be effectively enshrined in the British legal system for the first time under guidelines for solicitors on drawing up “Sharia compliant” wills.
Under ground-breaking guidance, produced by The Law Society, High Street solicitors will be able to write Islamic wills that deny women an equal share of inheritances and exclude unbelievers altogether.
The documents, which would be recognised by Britain’s courts, will also prevent children born out of wedlock – and even those who have been adopted – from being counted as legitimate heirs.

Given the complete freedom already afforded in drafting bequests, all this is doing is saying “if you want your inheritance to be divvied up as per the Koran, here is how to do it in a manner compliant with the law of the land”.

It’s not made clear here that the Law Society sneaked this out, presumably hoping that no-one would notice until it was too late.
Even more worrying to me is the attempted takeover of some state schools by Islamic extremists (see link). One school in Derby has been closed, some of the schools in Birmingham are being investigated but nothing appears to be happening in Tower Hamlets and other places where this kind of thing is probably far more prevalent. Usually the extremists have protection from various political interests. As you can see the person behind the takeovers is employed as a consultant by the education inspection body and by the city council where this is happening.

There has been no change to the law at all, no special dispensations given to Muslims, nothing, beyond some practice advice issued to lawyers who may have Muslim clients. As Sage has correctly pointed out in common-law jurisdictions people are generally free to dispose of their estates as and how they wish with few exceptions. That means you can cut out your children entirely and leave it to your trophy wife, your favourite cat charity, the Church of Scientology, whatever you like. Some juridictions such as the UK or British Columbia may allow the will to be challenged by dependents or close family members, but generally speaking freedom of disposition is the underlying principle.
Now, estate law in common-law countries is very different from other legal traditions such as the Civil law systems derived from Roman law that are found in Scotland, continental Europe, Louisiana and Quebec, Sharia Law or Jewish Law. These other systems actually do not allow the testator to dispose freely of their estate but instead have a system of forced heirship where a portion (normally the majority) of the estate is reserved by law for the next of kin or various named family members, and the residual estate may be distributed freely as per the wishes of the testator. According to Sharia law 1/3 of the estate may be freely given, and the remainder must be divided between certain close family members. Men and women are not treated equally in that Women are only due half of what a men with similar legal rights to the estate receive. Likewise illegitimate children, and children married to non-Muslims have no legal right to the estate (though the testator is free to make a bequest to them out of the third of the estate that is freely disposable).
Now, due to the rather free-wheeling nature of inheritance law in common-law jurisdictions the testator is free to draft a will to conform with Sharia Law, or Scots Law or Klingon Law or what have you.
Now, all that has happened is that the Law Society has written a Practice Note that sets out generally the rules of succession as found in Sharia Law. The point of this exercise is that if a Muslim requests a will that conforms to the precepts of his faith, the lawyer will at least understand what he is talking about and will be able to provide him with legal advice and assistance in drafting the will and avoiding any pitfalls that may prevent him from seeing his wish realised. It’s basically a legal resource to help lawyers serve a certain group of clients better.
If people bothered reading the source document, the internet wouldn’t be overrun today with hysterical commentary about how Muslims are receiving special favours, Sharia has taken over the English legal system, and how we need to pass a law demanding equal treatment of heirs thereby trashing hundreds of years of English Law!

As a libertarian I tend to believe in complete freedom of disposition of assets with the possible exception of dependents, esp. minors and the disabled. And especially with the very real risk that I as a taxpayer may be forced to chip in for a irresponsible testator/testatrix.
You mentioned BC the land of the infamous Wills Variation Act where black sheep are often written back into a will typically by a liberal woman lawyer. I heard of one case where the black sheep was awarded MORE than his “fair share” because the other children had done well in life.
I was also told once that a pre-nup agreement in BC is not given much weight after about 3 years.
Libertarians believe in self ownership. Nothing is more critical to self ownership than the freedom to dispose of one’s legally acquired assets.
