There is no such thing as a “right to respect for group identity”, and it isn’t even found along with the fake rights in the Charter, let alone the real ones. There is no “balance” to be found here, and it is never the issue anyway where rights are concerned. The proper angle is to figure out which rights take precedence under which circumstances (yes, there are occasions where freedom of speech must be subordinate, but “hate” is not one of them unless it has led to threats or harassment).
If a person’s rights are violated it means he or she has been the victim of coercion. Hate speech may certainly lead to coercion but it is not the same thing. Therefore, in and of itself, it should be no concern of the state.
The only person whose rights have been violated in this entire fiasco is Bill Whatcott.
Moreover, “dignity” is not properly a legal issue, and the attempt to make it one is in reality a malevolent attempt to introduce vagueness and fuzziness into the law, with the goal of doing further damage to our rights. That shows contempt for justice.
Here’s why the decision is a big step toward the destruction of a free society. If you are not allowed to speak vigorously against the list of “favoured groups” in human rights codes — itself always defined by leftists, to their own advantage — and if ‘political opinion’ turns up on the list (it’s already listed in Quebec’s code, for example) then no serious political discussion is possible. There are certain political viewpoints which deserve our hatred: communism and fascism. It might well come to the point where a reference to the tens of millions killed by communists will be considered “hate speech” by people like today’s leftists. They will try to get away with this, for sure. Meanwhile they’ll try to write off opposing viewpoints as non-political, by saying that capitalism is “just an economic system”, so it’s not covered under the list of “favoured groups” and therefore they can spread hate against capitalists or businessmen as much as they want. In fact, ‘political opinion’ need not even be listed — in Vriend, the Supreme Court inserted sexual orientation into Alberta’s human rights code, so what’s to stop them from doing the same with political opinion?
Make no mistake, this utterly shallow judgment is a disaster for freedom of speech specifically, and for freedom in general. As I said before, although it was written by Marshall Rothstein, it has Rosalie Abella’s filthy pawprints all over it.

I clicked on Global Calgary and caught the last part of an interview with the mother of Ethan Yellowbird,the 5 year-old that was murdered by a trio of gangbangers in Hobbema. She was saying something about inadequate funding. I can’t say for sure but she appears to be passing the blame to PMSH. That is the kid’s mother talking.
While unsuccessfully trying to track down the complete interview,I found this nugget of native wisdom,on CBC of course.

BTW,all three wannabe gangstas had been taken away from their baby mommas at an early age for the usual reasons. Another BTW,the aunt of the boy was murdered next door a few months later.
