  1. The SCOC makes up and defines what words mean, and attaches those words to reality, deciding that a crime which normal people find wholly repugnant and deviant, and decide that to be “unconstitutional”.

    Expect at some point in the future, a disproportionate response to everything the gov’t has levied against citizens. If this is grossly disproportionate, then what is the very constitution which decides this? if not a grotesque violation of our liberties? If not a grotesque violation of what were to be our very freedoms to exist and to decide the consequences for deviating from what is demonstrably good?

    I’m never surprised when the SCOC deviates from what is good, my expectation of “good” from the SCOC,
    is zero.

    1. Guys, just bear in mind that very likely 99 out of 100 canadians couldn’t name 1 (one) of those judges.
      Those same fine canadians probably couldn’t tell you how many are on the SCOc.

    Not just those who destroy the lives of the unborn innocent but also destroy the lives of the living innocent.

  3. The charter as written authorizes the state to determine what rights you do and do not have.
    Under these circumstances the SCOC decision should not come as a surprise.
    Not a flaw, a feature.

    1. 5-4, if I read it correctly. And, how is a one-year minimum sentence for possessing and accessing child porn cruel and unusual punishment?

      What boggles my mind is how only two of the five female judges dissented. Did they even see any of the evidence or was that not relevant to their decision? This is one sick country in a sick world.

  4. Called it. The SCOC make the laws now and any Conservative leader who thinks he can rev up his base with the tried and true “time to get tough on crime” schtick doesn’t know what he or she is talking about.
    If they need to rule on something that affects your Charter of Rights protections? Not a problem…POGG it shall be.

  6. I think a closer look at the original Judge on this case is in order. He’s no longer a Judge. He is the one that gave such an original light sentence to Senneville and started the AG forward on challenging such a light sentence. He based it on the defendant being sorry for this acts. This is despite the defendant originally lying to the Court stating that he was collecting evidence and was planning to be a vigilante against the “offenders.” He got only two 90 day intermittent sentences, with benefits on weekends. 2 years probation, and registering as a sex offender for 20 years.

    Pull up a photo of Bernard Tremblay (the original Judge) and I have to say. He has that “look.” But, in addition, he was brought up on charges and an internal investigation for sexual harassment in his own office (inclusive of a fired employee who made the original complaint). 3 or 4 other employees relayed inappropriate behavior by the Judge in the resultant investigation. Ultimately, he got a warning. But, he’s no longer a Judge, is he?

    The charges, and ultimate guilty plea by Senneville were absolutely disgusting. Two 90 day intermittent sentences was a joke for what was found in his possession. There is no way the Judge should have given such a light sentence. The Supreme Court case was about mandatory minimums, which in my mind, had little to do with the Senneville case. His sentence should have far surpassed any consideration of a minimum sentence. That’s a totally separate issue from the case itself.

    That Judge Tremblay, IMO, deserves closer scrutiny. He did the same thing on a separate case involving even more egregious offenses, that was, also, attached to the Supreme Court case.

  7. It is sad to watch Canada become more European.
    This is very much like the Swedish case I posted last evening where the court decided that severe punishment of a rapist was not needed, because the rape was of “short” duration; as if that had ANY relevance to the tremendous physical and psychological injury suffered by the young woman who was raped. Enabling savagery is wholly unacceptable.

I do believe that the ever growing fascination, glorification and money spend on the promotion of death and gore has some connection with the ever growing depravity and confusion between Good and evil. I do think that there is a reasonable connection. But perhaps you are correct and they are completely unrelated.

  8. Like I wrote the other day: there used to be Hanging Judges to solve mandatory problems.
    Not advocating, but now the mandatory solution appears to be judges hanging.
