When The FBI Does It, That Means That It’s Not Illegal

Roger Kimball;

In the matter of James Brien Comey Jr., how finds the court? I do not mean a court of law. I mean the tribunal of history.

Granted, we will be hearing from a Virginia court of law about JBC quite soon. On Thursday, Comey became the first former FBI director in history to be indicted by a grand jury for a felony. The charges? Lying to Congress and obstructing justice. (For the legal eagles among you, the statutes in question are USC 18 §1001 and USC 18 §1505.)

Call it karma, irony, or just good old-fashioned just desserts: whatever your literary preference, there is a delicious symmetry in the fact that USC 18 §1001—which prohibits making “any materially false, fictitious, or fraudulent statement” to a government official—was the statute under which Comey tormented and bankrupted General Mike Flynn, Donald Trump’s National Security Advisor for a few weeks in 2017.

  1. John 8:44, New International Version, Jesus speaking

    “You belong to your father, the devil, and you want to carry out your father’s desires. He was a murderer from the beginning, not holding to the truth, for there is no truth in him. When he lies, he speaks his native language, for he is a liar and the father of lies.”

    The devil sure has a lot of children on earth.

  2. Where will Comey stand trial? Washington DC?

    If so, he’ll be found innocent of all charges (regardless of what evidence is presented).

  4. These charges are a place holder. The statute of limitations was coming up pretty soon. Also, keep in mind that indictment(s) went through the legal process requiring a sitting Grand Jury to recommend pursuing the indictment. That sitting Grand Jury was in liberal Virginia and they still saw cause to proceed.

    You will recall the burn bags found intact in the FBI HQ building. That, in its own right is suspect in that burn bags NEVER contain readable content. It is always pulped or shredded before application. Someone was protecting their own posterior after being instructed to destroy evidence. The likelihood that that ass protector is now a whistleblower is pretty high. The burn bags disappeared from the news almost immediately after Kash Patel announced the find. And, he’s not going to just stumble across them. Someone pointed him there.

    Then you have the full court press as Brennan (after a hiatus) pops up on just about every media outlet saying it’s a “nothingburger.” He’s worried, and should be. I expect James Clapper to start making the media rounds shortly.

    Comey’s problems are just beginning. This is the opening salvo. There will be more charges forcing him to consider selling out his cohorts. That’s when it’s going to get interesting. That’s when there is going to be a line around the corner of mid-level management FBI employees ready to spill what they know to try and survive the onslaught.
