  5. For information, the Federal Court of Canada does not try criminal law. The court was created to try claims against the federal government. There is a separate Tax Court of Canada that tries the vast majority of federal cases. There isn’t much left to try in Federal Court other than immigration.

    Canada has one general court system that handles municipal, provincial, and federal law. Other provinces differ but Alberta has Provincial Court and Court of King’s Bench (essentially trial division of Alberta Supreme Court). Provincial Court judges are appointed by provincial premiers and Court of King’s Bench judges are appointed by the prime minister. Simple cases with lesser penalties are tried in Provincial Court and more serious cases are tried in Court of King’s Bench. These courts handle all criminal and civil law except claims against the federal government. There may be minor exceptions.

  6. This is an example of the Cloward-Pliven strategy remodeled to overwhelm the court system. This can only work if there is equal scheming and support of the Solicitor General and the Attorney General(s).

    1. The provincial AGs do not generally deal with the Federal Court, which is a specialised court of limited authority, as scar has explained. This is hardly an attempt to “overwhelm” the court, more like an attempt to manufacture something for it to pass the time with.

Lay it all on the Supreme Court and the gimpy former Chief Justice Brian Dickson who in 1985 ruled that everyone has a constitutional right to an oral hearing and legal process regardless of their legal status in Canada. Immigration lawyers started flooding the immigration adjudication system immediately and the pretty much useless Mulroney PC government chose to allow it rather than use the notwithstanding clause to say no, tourists,do not have constitutional rights.

      It would invoke the not withstanding clause, and all the Canadians, who want to live under peace, prosperity and good government would still have a nation-state.

  11. Don’t worry, it’s all under control. They’re fast-tracking planeloads of experienced immigration judges from Karachi and Bombay to clear up the backlog.
