Expect similar action from Saskatchewan in the next 10 days. If you remember back in September, Saskatchewan issued its Economic Impact Assessment Tribunal take on this emissions cap, calling it a production cap.

This is the way to push back against the tyranny of the Trudeau Liberal government. Use provincial powers to stop the federal government from interfering in provincial jurisdiction. Quebec has been doing this for decades, successfully. Of course the chattering class in central Canada will have a hissy fit but who cares.
Having the energy industry report only to the province, instead of the federal government, gives the corporations protection from the federal government. The federal government will have to deal with provinces instead of threatening private corporations. Saskatchewan farmers and RMs (rural municipalities) used the same method during a proprty tax revolt a couple of decades ago : the farmers paid the property taxes to the RMs, the RMs withheld the taxes from the provincial government. That way the farmers were in compliance with the tax laws while the RMs negotiated with the provincial government.
The power of a US President who’s party controls the house and senate is constrained by State governors, the SC and the Senate itself. In Canada a prime minister with a majority government rules unchecked.
The Canadian Constitution is supposed to keep the federal government in check but, via “creative” interpretations of the constitution, they have become a rubber stamp for Liberal Prime Ministers and a roadblock for Conservative governments, as does the Canadian Senate.
People seem to forget that the Founding Fathers of the United States of America were fully aware of what a Westminster parliament was and how it worked, and deliberately rejected it as a model.

And therein lies the rub. What will Alberta and Saskatchewan do when the Supreme Court predictably decides in favour of the a federal government? A court made up of 3 judges from Quebec, 3 from Ontario and 3 from the rest of CON-federation!
The Trudeau Liberal government will be gone long before the Supreme Court hears the constitutional challenge. The new Conservative federal government will end the attacks on the oil and gas industry.
You do make a good point though that Alberta and Saskatchewan rarely get a fair judgment at the supreme court level. The Canadian Senate is no better. I doubt there’s any way to change the bias against the two provinces under the Canadian governing system. The only solution is to copy what Quebec does – operate like an independent nation within Canada.
Alberta and Saskatchewan are the wealthiest provinces in Canada (by GDP per capita) so they should use that wealth to pursue their own economic interests. Enough with decades of being shackled and hobbled by central Canadian politicians.

I’m always surprised that other provinces don’t flex every constitutional prerogative they possess within Confederation e.g., the Federal “dental plan” should have died a quick death and the RCMP should have been given the bum’s rush as provincial police long ago.

In retrospect, they probably should have also insisted that there was a right to invoke the notwithstanding clause in the section of the constitution that deals with provincial jurisdiction, to prevent court approved meddling by the federal government in the province’s jurisdiction .

The factual basis for the SCC carbon tax ruling has disappeared. The Feds presented evidence of the consensus that greenhouse gas emissions contribute to global climate change. Countries around the world committed to drastically reduce their greenhouse gas emissions under the 2015 Paris Agreement. In Canada, the federal government passed the Act to implement its commitments.
The Court noted that global warming causes harm beyond provincial boundaries and that it is a matter of national concern under the “peace, order and good government” clause of the Constitution. However, the federal government has the authority to act in appropriate cases, where there is a matter of genuine national concern and where the recognition of that matter is consistent with the division of powers.
When the Feds exempted heating oil from the carbon tax, they showed that there is not a genuine national concern about greenhouse gas emissions.
Alberta and Saskatchewan should ignore the Federal decisions that harm people and the provincial economies – – – just as the Feds did when convenient.
There is no factual basis for the carbon tax as there is no evidence that greenhouse gas emissions contribute to global climate change.
It’s a scam to control people’s lives, nothing else.

It is time for Alberta and Saskatchewan to reassert their jurisdiction. To the point of stopping any flow of goods to eastern Canada – and maybe charging a road tax on goods going from the west to the east.

The entire west has only 24 senators, appointed by the PMO to represent them. NB has 10. NS has 10. Postage Stamp PEI has four. NFL gets 6 too. 78 senators represent the east, all appointed by the PMO as well
Prince Edward Island population 172,707, gets 4 seats in HOC and population per seat 43,176
Alberta population 4,601,314 gets 37 seats in HOC and population per seat 124.359

The choice is one between living free, on your own decisions and choices, or being sold into slavery through stealth.
I agree. Canada has always been for sale. For about 80 years after Confederation, Canada sought deeper and deeper ownership by British companies and defense agreements. For the last 80 years, it’s been to seek ownership by the United States. Canada has never been prepared to stand up on its own. Always it has sought out a nanny relationship.
Perhaps it is time to consider other options in dealing with a slim mandate which has been overstepped.
