“We are similarly unpersuaded by Intervenors’ assertions that Congress
created the only currently available mechanism for determining whether a person
is disqualified pursuant to Section Three with the 1994 passage of 18 U.S.C. § 2383.
That statute makes it a crime to “assist[] or engage[] in any rebellion or insurrection
against the authority of the United States.” True, with that enactment, Congress
criminalized the same conduct that is disqualifying under Section Three. All that
means, however, is that a person charged and convicted under 18 U.S.C. § 2383
would also be disqualified under Section Three. It cannot be read to mean that only
those charged and convicted of violating that law are constitutionally disqualified
from holding future office without assuming a great deal of meaning not present
in the text of the law.”
so, the court says that if the state declares you an insurrectionist, but doesn’t bother engaging in a trial and conviction, you can still be disqualified…
Huh? That sounds really familiar … hmmmm … dum, dum, de, dum, dum, dum … ?
I’ve got it !! It sounds like EVERY college in America who EXPELS and HUMILIATES any male student ACCUSED of sexual improprieties … without due process. Without a defense. Because metoo … or something.
However, Donald Trump has never been charged with insurrection, let alone convicted. Who exactly are the ones guilty of treason?
The court even stayed it’s own decision pending the outcome of an expected SCOTUS appeal. Not only corrupt and sleazy, but cowardly as well.
The dildo of consequences rarely comes lubed.
yes, the girls and the gays of our society have done themselves … hard. and rough. Because they’re really fornicating themselves … relentlessly.
That’s something you would know about?
“The dildo of consequences rarely comes lubed.”
In this case, for the incompetent and overtly partisan judges who didn’t even bother to read what the Constitution actually says….but were at least smart enough to ‘stay’ their decision to avoid the embarrassment of having it so quickly overturned.
Meaningless political theater. Makes for great click-bait.
Is that just like all the other decisions you don’t agree with, but don’t bother to read the actual filing?
“Is that just like all the other decisions you don’t agree with, but don’t bother to read the actual filing?”
Who said I don’t agree with it? I enjoy watching them embarrass themselves almost as much as I enjoy watching you do it.
Judges are never accountable for their decisions. What percentange of successfully appealed decisions should be necessary to require a Judge to “retrain”? 20%? 30?
Ironically … my professional license MANDATES that I PROVE continuing education … in a very specific topic … else I won’t get my license renewed. And TBH the work I do puts far fewer people at any sort of risk than do Judges.
Successfully appealed is actually really low. The majority of cases appealed to SCOTUS or state Supreme courts aren’t even heard.
However, of the small remainder of cases, a large percent are overturned.
It’s not a scorecard you idiot.
No shit. And what cases DO the Supreme’s take up? Uh … I’d say CONSTITUTIONAL issues are paramount.
I was replying to the question. Your response is bizarre.
Told my brother years ago that a time would come when the good, traditional, conservative patriots in the USA would be forced to choose between only 2 options: submission or revolt. I believe that time is near and accelerating. Are there enough tough patriots remaining? We’ll soon find out.

I have said something similar for some time now. I believe you are correct.
Did the six Colorado Supreme Court Justices sign their names to the decision?
The three dissenting justices signed their dissent.
I was incorrect. There are only seven members of the Colorado Supreme Court. They are all Democrats, and the decision was 4-3.
Three democrat justices thought the decision was bad.
Reeeee – laaaaaax.
This will get up to the SCOTUS and be overturned.
Guilty until proven innocent. The New Murican way.
This will go badly for Democrats.
First, CO is a heavy blue state that elected Biden by 14 points in 2020.
Second, they will likely be humiliated by a 9-0 reversal at SCOTUS, with DeMarxists counting on a split decision.
Three, DeMarxists are fully exposed as believing they cannot win in 2024 without using unelected partisans.
Four, Red states can play tit for tat which if allowed could essentially ban Biden from red states and Trump from blue ones, which of course won’t happen, which only rabid radicals believe will, only proving their desperation.
All over a Soros funded bunch of DeMarxist appointed fascists in robes desperate to decide the 2024 election.
“In light of these and other proffered definitions, the district court concluded that “an insurrection as used in Section Three is (1) a public use of force or threat of force (2) by a group of people (3) to hinder or prevent execution of the Constitution of the United States.””
So by that definition, anyone calling for the homes of supreme court justices to be picketed or invaded is guilty of “insurrection” and thus ineligible to be on any ballot in the united states…

Next you’ll tell us you believe in equal justice under the law.
The are saying Trump violated Section 3 of the 14th Amendment…even though neither he or anyone else had been convicted much less charged with insurrection as it relates to Jan 6
The state has no authority here. Section Five of the Fourteenth Amendment vests Congress with the authority to adopt “appropriate” legislation to enforce the other parts of the Amendment….not the state.
That doesn’t make sense
“No person shall be a Senator or Representative in Congress, or elector of President and Vice President, or hold any office, civil or military, under the United States, or under any state, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any state legislature, or as an executive or judicial officer of any state, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof. But Congress may by a vote of two-thirds of each House, remove such disability”
See the last sentence.
“But Congress may by a vote of two-thirds of each House, remove such disability”
See the last sentence.”
Yes, especially the part about *each House*. Good luck with that.
My understanding was that the law was put in place to prevent political and military leaders of the Confederacy from ever wielding political power after the Civil War, but in their case the insurrectionist angle was pretty obvious. If Trump is guilty of insurrection, then shouldn’t he be arrested, charged and tried by the state of Colorado (or whichever state believes there to be grounds for such a charge)? If found guilty, he could then struck off the ballot. Without a trial, the grounds for this ruling are extremely shaky.
That said, what kind of crazy precedent is this going to create? Do these guys not think that Republican states are going to get very creative now that the door is open? It would only take one state to remove a candidate from the Presidential ballot to end their electoral chances in many cases.
Without any conviction of an “insurrection!”, this decision is, well, just plain old horse shit.
“Without any conviction of an “insurrection!”, this decision is, well, just plain old horse shit.”
Of course it is…that’s why the same people who made this idiotic ruling ‘stayed’ it immediately. A simple trial balloon, just to gauge the reaction from the public. Political theater at its silliest.
It is straight-up, deliberate PROVOCATION, specifically designed to push pre-positioned patsies “over the edge”
There seems to be a LOT of it about
The LSM is deeply embedded in the process, having long ago anointed themselves “opinion-shapers” and decided that the 1st amendment totally protects them from all “action”, “legal or kinetic”.
Hubris on stilts.
“It is straight-up, deliberate PROVOCATION, specifically designed to push pre-positioned patsies “over the edge””
Yup. Watch what happens when Trump’s poll numbers go UP again because of it.
Opportunity hands us Normies a litmus test to separate the Patriots from the Sleazes. Which Republicans will aggressively protest this decision?
“When tyranny becomes law, rebellion becomes duty”. – Thomas Jefferson
Great Quote!!! Too bad Canada and the USA didn’t have Thomas Jefferson now ! The courts of both countries are becoming Politicalized ! And it’s leading to REBELLION!
Colorado was never going to vote for Trump anyway.
Now if this was Michigan or Wisconsin or Georgia or Arizona it would be a really big deal.
Colorado: Upper-Left’ Kalifornia?
They’ll convict him in one or more of his court cases next. Try to imprison him, and also use that as a pretext to ban him from the ballots.
Failing that, they’ll move to take him out. As in, assassination.
They have been saying for three years that they will not allow him to be president again. Take them at their word. They’re not going to stop.
They are certainly priming the pump for an assassination with the latest media rethoric. Worse than Hitler, worse than slavery, he’s going to be a dictator, he’s going to shut down the internet, he’s going to round up people into camps and have them killed, etc. I suppose they are waiting for a nutcase to do the job before the election. If not, well, 50+ ex-intel agency bosses hate his guts so… let’s just say it wouldn’t be the first time.
It was a stupid move by whomever is pulling the strings (and make no mistake, the CSC got marching orders). This is like a paid advertisement for Trump. Colorado has the Biden disapproval up over 55% (after 538 played with the numbers a little…it was actually 59%). By this time tomorrow it will be over 60%. That’s unheard of for an incumbent running a re-election campaign. Biden’s approval numbers in Colorado are high 30 percentile. But, I’d be surprised if this latest escapade doesn’t lower it further.
If Biden’s running, then Colorado is up for grabs. Although, I still don’t think he is running. And, I think the axe falls in the first week of January …with a little assistance from the court system. ;D
“It was a stupid move by whomever is pulling the strings (and make no mistake, the CSC got marching orders). This is like a paid advertisement for Trump. ”
Expect another bump to Trump’s poll numbers. Watch the Democrats get hysterical in response.
FACT:
In 1860 ten Democrat states kept Abraham Lincoln off the ballot. Guess how that ended up.
This can all be solved with a few truckloads of axe handles, tar, and feathers.
When the Justice, legal systems, and , courts Fail and become corrupted ——democracy dies!
It’s happening in Canada and now is full blown in the US! Tranny and revolution will follow!!
Slightly off topic but humorous under the circumstance.

“FYI Biden’s name has been officially removed from the 2024 New Hampshire Dem Primary Ballot.
Not joking.”
Also for what it’s worth
“FYI Guess which Supreme Court Justice has the Circuit Assignment (oversight) for Colorado?
Neil Gorsuch.”

Trump’s biggest mistake was thinking he lived in a republic.. The rule of law and the constitutions in both America and Canada have been compromised with politics that serve a very narrow interest..
Its is time for the military to step up and set things right.. It is their sworn duty..
The top officers in any military are appointed by the sitting government. All commanders are appointed by those in turn. Obama carried out a little purge of General Officers and Commanders so that the top brass are ideologically aligned with the Dems. Remember Milley, the Chairman of the JSC that called the Chinese behind Trump’s back? That lied about troop levels in the middle east? The Colonel who ratted on Trump to get him impeached for a phone call? That is the kind of military you are dealing with in the US and it has only gotten worse. I mean just look at the anti-white and woke indoctrination that has been pushed on the military in the past years. That last uncorrupted branch of government has now been corrupted. I’m not talking about the rank and file, but top leadership have their marching orders and if one person has a problem with it, they are replaced.
Milley should have been subject to court martial. Don’t think Donald will make that mistake again.
No time for that. The US military is fully booked with Drag Queen story hours.
It is time for the people to step up and use their constitutional rights to set the country back on course.
There is great ballyhoo that the people who brought the case are Republicans. I haven’t even tried to verify this. Of course they forget to mention there is a competition for the candidcy. The real question is,who funded it? Would it perhaps be the same big money that has been thrown Nikki’s way? Far to big a leap of critical thinking for the average citizen. I would say these are very troubling times, but I believe it has been happening for a long time. I wonder how much longer we will have the illusion of democracy.
Soros.
The People’s Republic of Colorado has been utterly and thoroughly Californicated.
I don’t think this will stand in the Supreme Court.
All Presidential ballots in the U.S. have a write-it space where voters can write the name of any candidate they choose.
Leaving Trump’s name off the ballot does not disenfranchise him.
The court’s ruling also bars the Colorado secretary of state from counting any write-in votes for Trump.
