I suspect the first moves will be to designate the protest zone as a “no assembly allowed area” and then order in a lot more police, who will be told they must begin ticketing and/or arresting anyone present in said zone. The tickets will carry massive fines, no doubt. Simultaneously, they will issue orders to all towing companies within range of the protest to mobilize and remove the trucks, again under penalty of massive fines and/or arrest for noncompliance.

      The police will no doubt issue the tickets and make some arrests but that won’t be enough. The towing companies ought to hold the line and continue to refuse. If they do, the feds are left with little option but to mobilize what military assets that they can, and then we hit the real breakpoint. Does the military follow orders, or do they refuse to act against Canadian citizens?

      Trudeau’s putting his entire government on the line here. If the protest holds the line through the 30 days, he falls.

  15. In colonial India, any colonial officials who had to call out a British army column to maintain order had a very short career ahead of him.

        1. The invocation must be presented separately to the House and the Senate who must both pass it. If either fails to do so within seven days (I think) the declaration immediately becomes void.

      3. The reasons for the emergency must be provided to both Senate and HoC. Both houses must vote up or down with no amendments after each house determines it’s ready to vote. If the votes fail in either house, the emergency powers (that have been in effect since the initial declaration) are ended. If the government doesn’t provide the reasons for the emergency to both houses within seven days, the emergency powers end immediately.

      4. If 20 MPs or 10 Senators sign a notice to the GG that they wish to deny the government power to invoke the act, then either the HoC or the Senate (depending on which parliamentary group signed the notice) will vote on the government’s reasons no later than 3 days from the government’s announcement. The debate will last no longer than 10 hours, at which time the vote to approve or deny takes place.

      5. At the time of the announcement of an emergency, the government has the power to declare an area out of bounds, and deny people the right to travel in or out of the area. Forbidding any public assembly, etc. Anyone who does not obey the order can be jailed for six months on summary conviction, or if indictable offence, less than five years.

      6. The government has other powers, including taking over or assuming the operation and management of private property, public utilities, etc.

From my reading of his article, the Dear Leader does not have the legal authority to invoke it (though that won’t stop the Dear Leader). The reason is that the current situation does not pose a threat “to the security of Canada”:

    “There is, however, a catch or two. The act is limited to “an emergency that arises from threats to the security of Canada and is so serious as to be a national emergency.” The act’s definition of a national emergency presents a high bar, one that “seriously endangers the lives, health or safety of Canadians and is of such proportions or nature to exceed the capacity or authority of a province to deal with.” The protest wasn’t seen as meeting these criteria at its outset; the more it metastasizes, the more clear the fit becomes. A provincial sign on by the Ontario government would seal things.

    More challenging is the act’s definition of a threat to the security of Canada, where it relies on the Canadian Security Intelligence Service Act, legislation passed 37 years ago. The CSIS act defines threats to the security of Canada as limited to four categories: espionage or sabotage (for purposes of the current protest — nope); foreign-influenced activities (not really, given the clause would be applied to state-sponsored interference); threats or use of acts of serious violence “for the purpose of achieving a political, religious or ideological objective” (not yet); covert and unlawful activities that would undermine or lead to the destruction of the constitutionally established system of government in Canada (a big stretch).”

    As Minister of National Defence, I brought in the Act. If people are speaking about calling in the military, they should be aware that it’s the National Defence Act that applies to military aid to the civil power.
