    It was not spitting at the other person. Coughing in their direction. The person in whose direction the cough was directed did not become ill. Is not covering your mouth or not turning your head when it is an involuntary cough also now assault? It must now be assault in Canada. What about getting in someone’s “personal space” and just breathing? That appears to now be assault in Canada.

    I hereby find the judge to be an ass. This is an act of assholeness within the definition of assholeness in the common sense code of Canadians.

      Let’s charge all politicians with criminal assault.

      So…if speaking is assault, and “silence is violence”, we appear to be in a bit of a pickle here.

    1. Kenji, it was not about a transmission of Covid virus, it was about putting molecules from your lungs towards another person, at best creating the possibility of transmitting something from his lungs that might or might not have been there.
      The headline of farting in someone’s general direction is really quite accurate.

        So the girl can’t immediately pay out because she doesn’t have cash, not her fault, he then coughs on her, intentionally, another patron in an attempt to mollify Mr Belligerent Asshole, offers him sixty dollars out of his own pocket. Mr.Asshole leaves, heads off to Boston Pizza for munchies and I would wager a few more wobbly pops, and then returns to the scene of the coughing and demands his remaining payout from the bar patron who previously gave him sixty bucks! The bar patron tells Me.Asshole to get stuffed and Mr.Asshole slugs him.
        Got it?
        Now if Mr.Asshole would have taken a moment to reflect, before engaging in a physical altercation in which he was the aggressor, in all likelihood LE would not have been involved, and that would have been the end of it, so no, coughing just gave the judge the excuse. Her last name is probably the same as his in any regards.

          Why the judge and the crown both think they needed the second assault?
          It is now a precedent that putting “molecules into the atmosphere” from your body is assault.

          1. I can’t believe SDA has stooped to the level of defending an asshole who spit in a woman’s face, and let’s face it, that’s what the asshole did.
            So the judge decided to use an already existing precedent, big deal.
            Moral of the story, don’t get drunk playing VLT’s, and intentionally cough or spit in someone’s face and then attempt to intimidate other’s by threat or by force. It won’t end well.

          What kind of sick fucks would approve of having a drunk walk in a bar, take his mask off, then cough on an employee with the intentions of using fear of Covid as a method of intimidation?? And in all this guy’s stupidity, he got off with probation when he should have been sent to a work camp in the Northwest Territories and tasered twice a day until he understood etiquette!! .

    What is it about judges in Calgary? Did someone spike the water in the Bow River or something?

    1. Pretty well all judges in Calgary were appointed for their Liberal Party fund raising skills. No need for legal expertise, skills or knowledge.

  5. Ha! Your title is the first thing I thought of when I read of the decision earlier. Is a fart in an elevator (or anywhere else, for that matter?) now to be considered assault? Going to have to test the theory after about a 4 day road trip on the Hawg with nothing but spicy foods and brewskies for sustenance.

    That said, coughing directly in someone’s face is grounds for a fist to the head in the first place, intentional or not. The guy is an asshole. There are many ways to make your point without being a complete douche bag. Second, now that it’s been legally defined as assault, then a fist to the head can only be considered self-defence, no? Third, the judge is an idiot.

    2. I’ve seen shit in a public elevator, piss in a fire escape landing, discarded needles et al in downtown Cowtown, so, no, this level of stupid by perpetrator and judge is no surprise.

  7. The perp is most definitely an aggressive moron and needs some alone time to get his act together.
    Having said that, if I’m not mistaken, other judges have cleared defendants where they had unprotected sex knowing that they were in fact contagious (HIV). As I recall in the instance I’m thinking of it involved him having unprotected sex with different partners, having first browbeat them into not using condoms. If that isn’t jail-worthy nothing is.

    I wonder if the story is the reporting ,rather than the conviction?
    If the “Judge” is accurately quoted..Hang him as well.
    The fear of life so consumes such morons,that they will never breath freely enough to live.

    So if the Judge comes to court with a cold,is he “Assaulting the Public”?
