Some victims are more equal than others.
A Quebec aboriginal man who repeatedly burned a five-year-old girl with a cigarette, leaving permanent scars on her face, arms, legs and genitalia, has been given a lenient sentence after a judge determined he is a “collateral victim” of residential school abuse.
Alain Bellemare, an Atikamekw from Wemotaci, Que., about 270 kilometres north of Montreal, was convicted of aggravated assault last June, and Crown prosecutor Éric Thériault sought a four-year prison term on the grounds that serious crimes against children have to be forcefully denounced. He noted that the 2011 assaults caused 27 third-degree burns — 25 from a cigarette and two from a lighter. The victim, who cannot be identified, was left to suffer without medical treatment.
But in sentencing Bellemare to 15 months on April 1, Quebec Court Judge Guy Lambert said the lingering effect of residential schools had to be taken into account under federal sentencing guidelines.
Two tier penalties create two tier justice. As aboriginal crime is most often perpetrated against other aboriginals, the net effect is lighter sentences for crimes against aboriginals. Good work, Gladue.

This guy is a sick f ck
Okay. The real kicker that neither him nor his parents attended a residential school yet they are still victims of that ‘system’ is mentioned early in the report.
If not for Section 15(2) of the Trudeau Charter, two tier justice would be impermissible under the rule of law. Unfortunately, there is no way to amend that abomination.
Who are you talking about? The Judge??
What a crock of fecal matter!!!!
Is the Judge a native?
DJ >
“This guy is a sick f ck”
Stop being a racist!
He’d only be a “sick f ck” if he was white, because abused white people don’t count as victims who victimize, even if they happened to actually have been victimized.
Ask JT, because he’ll give this guy a million dollars of your money to prove that YOUR wrong, and a racist for not agreeing.
gellenc= >
“Is the Judge a native?”
Far worse, a Liberal Progressive!
Where Justice ends and Social Justice replaces.
Blood boiling. Didn’t know they were teaching burning children in residential schools.
All treaties with these savages need to be considered null and void and reserves pacified. Conquered savages if they demonstrate any signs of disloyalty should be treated accordingly. Once and for all we need to stop pretending that their alleged culture contributed anything to humanity, ever. And while at it stop pretending that their savage bands were “nations”. They deserved to be conquered and they benefited immensely from it.
According to the traditional native way, they look seven generations into the past, to see what the elders did, and seven generations into the future to see how their decisions may affect their descendants. This ruling fits perfectly into that way of thinking, and we can expect four more generations to claim they’ve been affected by the residential school system…
Would I be incorrect to suggest that Indians were treated better in residential schools than they ever were at home? So how do you break the pattern of violence? It isn’t by having no consequences for deviant behavior. Canadians should take up a collection and rent the poor guy the house next door to the judge.
In some cultures the victims relatives would give the perp a much deserved ‘blanket party’ including breaking both knees so the perp would remember the lesson for the rest of their life.
What offended me was the crown -seeking- four years. Child torture gets four years? Really?
Man, I’m really out of the loop here.
Gladue was an embarrassment. This country is a third rate banana republic while that stupidity is on the books. What so lady justice is blindfolded except she can peek out to see if the guilty party is an Indian?
“But he grew up in an abusive household that the court heard was a legacy of residential school abuse suffered by his grandparents.”
I am SO f***ing mad right now,I could cheerfully shoot the sonofabitch, in the balls.
There is nothing this case needs more than a rope, a pony, and a stout tree branch about 15 feet off the ground!
His F***ing Grandparents attended a res School, so HE gets a pass for his sick f***ing actions! Has the world gone completely insane?
Trudopia, where torturing children is a Trudeau Charter right… for some… Yep, and we know that the idiot (feminist) son of the Trudeau Charter takes offense to female genital mutilation being labelled “barbaric”… That “judge” needs to be taught a lesson, nothing fancy, just a cigar to the eye… Clearly the “Judge” condones child torture, just like the Muzzie convert play acting as PM… sick bastards.
Don Morris >
“Has the world gone completely insane?”
Much worse, it’s gone “Progressive”.
That is the truth!
let me see now, my father was in a concentration camp, so this allows me how much latitude do commit what crimes????????????????????
I would support both judge and the poor indian being burned at the stake
Gentlemen take it easy with anything that can be considered a specific threat, you’re living in a country where freedom of speech no longer exists.
Now we have survivors of survivors of survivors. I see a profitable future for the
the merchants of Regina and Panama.
Just Us System.. working for who?
Certainly not five year old girls.
The upcoming”Missing and Murdered Native women” gong show will spend years and millions, to discover the dominant killer of native women…Will ,que the shock and surprise, discover native men .
The apartheid system works real good, to ensure native women have no rights and no defence.
A native woman gets tired of her violent spouse, presses charges, the judge releases the beater, cause Gladue, who comes home drunk and kills her.
Just Us Minions, we did everything by the book. Nothing we could do.
The Catch & Release for Just Us Business exists primarily to make judges and lawyers even richer. They farm criminals like cash cows. In most cases the taxpayer is paying for both sides in the Kabuki Theater the courts have become.
I’m so tired of people telling me that my great-great grandparents supported the type of thinking that ‘destroyed the natives in their own home’ or ‘agreed with or tolerated slavery’ so I am somehow complicit. Bullshit x10.
The same applies here in inverse terms. Just because your ancestors were treated badly (a suspect theory) doesn’t mean YOU get to act like an asshole.
The judge applied the law as he saw fit. It’s a bad law with stupid precedents. Anyone reading or knowing in detail what this animal did would, if they were human (and especially a parent) want him put away forever. Preferably dead. Traits like his do not go away through counseling.
‘destroyed the natives in their own home’
You’re making it sound like a bad thing?
Funny how the Indian is the victim of the residential school but the 5 year old girl is hardly the victim of the Indian adult.
His victimhood trumps her victimhood.
All nonwhite perps and their nonwhite victims are victims of British Colonialism.
Ooops sorry, Euro Colonialism.
The judge correctly applied the Arbour deflection as intended.
Off topic I know but worth repeating nevertheless:
‘agreed with or tolerated slavery’
It was the western world that went to great length to eradicate slavery and yet is still lingers in parts of mooselimb world in Africa and Asia. Estimates vary but it is probably reasonable to assume that about 120 millions people died from mooselimb slavery over the centuries.
“This country is a third rate banana republic while that stupidity is on the books”
Can we add the Indian Act to your list?
The Indian Act has to be abolished. And I don’t think it is racist to call for the abolition of the act. This act keeps Indian people separate and apart from Canadian society, an apartheid policy. Also the department of Indian Affairs or whatever they call it today has to be wound down. Initially the dept was created to only run for a certain number of years until control would then be handed over to the Indians to run their own affairs. It’s been something like 124+ years since creation of that department, Indian people don’t need civil servants running their lives anymore.
a·part·heid, NOUN, a policy or system of segregation or discrimination on grounds of race.
Liberalism is a mental disorder.
the old abuse excuse to excuse abuse doesn’t float with me.
The only thing missing here is an apology from the government.
It appears to me that the effects of “Gladue” are perpetual. M. Bellmare’s *grandparents* attended residential school. His crimes, however, and the trauma they caused his victim, are blamed on residential schools. But surely that victim (and all of the other victims of aboriginal crime) may be so severely affected by what has been done to them that they will commit unpunished crimes, etc. As aboriginal novelist Tom King relates, “It’s turtles all the way down.”
My brothers and I grew up in a sometimes violent household with a shell-shocked WWII father. Sadly, he was not the exception as he witnessed all types of horrors in his 4 yrs overseas defending our very way of life.
Just wondering where I go to pick up my compensation cheque and get out of jail free card. Gee, hope it doesn’t matter that I’m white.
BTW, I’ve been really impressed with the energy levels of aboriginal activists these past years. I see they are now 100% behind their newest movement, “Idle Again”.
He didn’t commit violence against anyone who abused him, he perpetrated the violence against a completely innocent person you stupid effing incompetent poor excuse for a compassionate human being judge.
Good one Gopher@ 9:31
Canada is an apartheid country replete with race laws. Check out the Wildlife Act in any province. Some citizens are more equal than others.
We set the first immigrants apart from the rest of us on their own lands (reservations). Send them to their own schools, integration is not encouraged.
We may not be South Africa of 50 years ago but SA studied the Canadian system when it set up apartheid.
A modern first world nation should not have race laws.
Residential schools are just the latest excuse on order to deflect from the real problem with Canada’s Indians, the apartheid system of the Indian Act.
It wasn’t our generation that put these acts and policies in place, but yet they get passed on year after year. Why should one feel guilty or ashamed of what our forefathers did. Both sides maintain the status quo, the gov controlling people’s lives with the Indian Act and the Chiefs making darn sure that is going to happen.
Hey, I once saw an actual residential school from a distance. It was standing there, intact and everything. I bet that’s good for at least one free axe murder.
Another recent example of this obscene race-based justice was covered in the Globe recently, with what must have an unconsciously delightful headline: “Suspended sentence bucks convention; Aboriginal man convicted of trafficking given no jail time”. There is indeed this rule in our law, but to refer to it as a “bucks convention” seems more than a bit tasteless.
Sure can tell the Girl was not a member of the Laurentien Elite
I understand there is some discussion when the First Nation Immigrants were travelling to the East from Asia some of the people in their dug out canoes were sea-sick and this led to a Terrible and Unjust first weeks after their arrival on the brand New Continent.
Apparently the little girl was part of the Scots-Irish doreced out of the British Isles by the Ancestors of the Present Bureaucracies of the Government/UniversityAcadaemia, The Duke of Cumberland burned all of her Family; Women; Children; Infants; and Elderly in the 1745 massacres of the Scots and burning of their boarded up Houses burning everyone of them forced to remain in the Burning Houses.
The remaining members of the Girls Ancestors from Ireland are part of the Mass Burial Mounds who died of Starvation.
Naturally the little Girl who was tortured and burned for Years in Canada is not part of the Liberal Party Of Canada Governments Court Appointee Process and/or part of a Captured Voting Block so any of the many Cigarrette Burns are to be Treated as Collateral Damage in Canada’s future.
What you are all failing to realize of course, is the State’s fear and hatred of religion, and especially of Christianity, in all its forms. Not all the schools were run by low-paid Catholic clergy and women religious, many were protestant sects, and their clergy who gave their lives to the care of bringing these people into the 19th century, also. Most of these people would not be alive today had it all been handled by Liberal and socialist atheists. The fact that Trudeau Jr., would not sign the papers of pro-life candidates, and the growth of euthanasia and other convenient ways of dismissing the sick and poor, are evidence of this.
That said, you can be sure that their will never be any mention of curtailing Muslim and other beliefs – that would be discriminatory – dontcha know?
Here’s an even better idea – have the guy babysit the judge’s children or grandchildren.
I love it.
The same system could be used when assessing dangerous felons for release.
Also, halfway houses should be incorporated into the homes of all officials responsible for determining parole status. Our prison systems would never release another questionable soul.
If Lieberals like two-tiered justice how come they don’t like two-tiered health care?
Just thinking about the title, can you even buy a small TV anymore? Plus the cost of larger TV has plummeted in the last few years. My 36″ is now considered small…..
