Justice Shane Perlmutter of Manitoba Court of Queen’s Bench on Friday dismissed the eight ex-directors’ motion, filed in December, for an injunction against federal Bill C-18, the Marketing Freedom for Grain Farmers Act.

  1. I never expected this to drag on so. There must be a lesson in all this.
    It’s one thing to come between a mother and her cub. But it’s much more dangerous to come between a progressive and his gravy train.

  2. There is so many contentious things going on, I had forgotten all about this one. Great news Kate, is there any way they can revive or fight this decision,or will it take a stake through the heart?

  3. I just however read in the Western Producer that there is now another group suing the government over the CWB. These guys are unbelievable since they can still sell their grain to the CWB. The only change is that grain farmers are no longer forced by law to sell to the CWB.

  4. I DO hope the legal fees for these guys is NOT being paid by the taxpayers.
    Sounds like they intend to taker it all the way to the SCC. That’s their right,and I have no problem with that, as long as THEY pay for it.

  5. The only legal success that these guys have had was one ruling by Judge Douglas Campbell. Judge Campbell should be well known to Saskatchewan residents. This guy comes close to settng the record for having rulings overturned on appeal. Some years ago, he overturned an operating licence granted to Areva for a northern Saskatchewan uranium mine, McClean Lake. It caused chaos, but only momentarily, as his decision was thrown out on appeal about six months later.
    Perlmutter’s decision provides some indication as to where Douglas’s ruling on the Wheat Board is likely going to go as well.
    Eagle, of course it’s going to drag on. Just about every consequential decision made by any government can be challenged in court. Even if the case is hopeless, the appeals can drag on forever. Just look at the damage claims from the Three Mile Island supposed victims from 1979. That civil case did not get its final dismissal until the late 1990s. And that despite the fact that the plaintiffs could not show any evidence of actual harm.

    There’s your key right there. The judge has reafirmed parliaments right to pass legislation it deems necessary. This thing is likely over, or at least for this governments 4 year term, anyway.

    Although I agree 100% with the desicion,the above statement by the Judge is kinda asinine.Hasn’t there been disparities between provinces from day 1 of the creation of the CWB???

  9. I’ll say it again, this is good news. This whole thing is too late for me, but the fellow that rents our land is happy as are many if not most of my neighbours.

  10. A judge who respects the law as it is written without the usual contortions? Sounds like he could be used on the Supreme Court some day.

  11. So, elections may matter? Just shows that there is much more work to be done, once a Parliament worthy of the name is elected.
    It will take about 20 years to rid the system of this sort of rot.
