As an observant Christian, I have grave fears about our courts doing the right thing here.
Let’s remember, over the last 20 years, it’s the courts that have allowed the gay rights activists to get their way over and over again and, by doing so, trump religious rights and freedoms EVERY time. (Like the HRCs, the gay rights activists have won all court battles in which Christian traditionalists–and other conservative religions–have had an interest.)
Rather than gaining new rights, e.g., the right to “marry” or adopt children–that’s an untried social experiment on our kids–via Parliament, these activists and their openly partisan supporters in the judiciary, such as Roy McMurtry, have made an end run around democracy and had the courts do what elected Parliaments would not. The judicial system is full of left wing cheerleaders for gay rights and these judicial activists think nothing of using the Charter to make a pretzel of the law.
Having seen the nasty outcome of their jugdments for traditional Christians at the HRCs, perhaps some activist judges are feeling somewhat contrite. (I doubt it.) It’s more likely they’re congratulating themselves for protecting the utopian–more like dystopian, if you ask me–world they’d like to see by making Christians bow to their command. Many judges have just as much left-wing zeal as the Lori Andreachuks out there–and more power!
Going to the courts, where due process is observed, but, believe me, not always honoured, isn’t necessarily going to make things right here. We’ll see . . .

Recently, with the barrage of news about ridiculous, unconstitutional decisions by HRCs, we have found ourselves, perhaps wishfully, thinking and saying that these injustices wouldn’t happen – or can be redressed – in a real court. Yes, I would still rather have my hearing take place in a real court, mainly because I am more likely to benefit from due process and a greater professionalism. But you are quite correct, that doesn’t mean that the result will necessarily be in accord with our historical freedoms or with natural justice.
You’re sadly right, felis. There are some real judges on the bench, but there’s a lot more who are cut fom the same cloth as the human rights people.

Churches and dioceses–who, believe me, have done far more good for Native Canadians than harm–are going bankrupt because of these law suits. Interestingly, it wasn’t Native Canadians who sued the Churches, it was Jean Chretien and his Liberal government who brought them in. Ironically, the first Anglican diocese to have gone bankrupt was the largely Native Diocese of the Caribou, whose bishop was a Native Canadian. Unintended consequences, I guess…
