Federal public defender convincingly argues that the FBI used an unprecedented “modern-day general warrant” to seize personal data of anyone who “could have been” in the approximate vicinity of the Capitol on Jan 6. “Defending democracy” by obliterating bedrock civil liberties.

The warrant was “fatally over-broad and devoid of particularity, and therefore impermissible under the Fourth Amendment.” There was never any particularized probable cause cited by FBI — making it certain that searches were conducted on people who committed no crime whatsoever.

Rather than establishing any basis for probable cause that subjects of the search had committed a crime, the government relied on hypothesis and conjecture that merely “equated presence at the Capitol with criminal activity” — bizarrely invoking “the pandemic” in its reasoning.

In other words, to obtain its general warrant and seize the personal data of thousands of people without establishing any particularized probable cause that they had engaged in criminal activity, the government simply “equated presence to criminality”.

  1. Worse … they relied on the FEAR of COVID agoraphobia for their illegal search warrants. The COVID “emergency” has been quite useful for the totalitarian Deep State. And we are STILL in a state of COVID “emergency”. It’s time to restore our constitutional rights. Now!

  2. What makes this more interesting is that the geolocation technology used by the FBI is EXACTLY what was used in the film “2000 Mules” to establish the fact that illegally harvested ballots were deposited in the dark of night into unsupervised drop boxes during the last Presidential election.

    Left wing media panned the technology as being “too imprecise” to be credible.

    Well, it’s good enough for the FBI to persecute citizens.

  3. Just be glad the FBI still feels the need for the fig leaf of a “warrant”. At some point they’re not going to feel the need to mask their criminality, and that’s when you’ll know it’s too late.

  4. The actions of the FBI are a symptom of the true cause (which in case was a Judge who signed off on an illegal warrant). Who would that be? Because I don’t see the name of the Judge/ Magistrate even mentioned in this article.

    1. It appears that the judiciary doesn’t pose any obstacle to the FBI.

      You simply go shopping until you find a compliant Obama appointed judge. Not hard to do. There are a lot of them.

    2. The warrants are sealed, so there is no way to tell what they include, nor who signed them. Might be Sullivan, he seems to be a willing patsy for the FBI

  6. Antifa member John Sullivan together with CNN reporter Jade Sacker walked into the building broke a window offered a weapon to other protesters. All documented in their own video. He got released hours after arrest a few days after. Interesting how the law only applies conservative protesters.

  9. Knowing full well they have no legal leg to stand on.. They take a protest that got out of hand* and turn it into a insurrection complete with political prisoners and a two year show trial.. A million opinions later its a nothing burger.. I’m of the opinion that Jan 6th had a point or ten and they got put down hard because of it.. Coups are top down affairs.. Revolutions are bottom up..

    So.. IMO America crushed a revolution with a coup.. It never did see a court of law.. The truth hurts..

    Why?.. Our society is obsessed with slaying imaginary dragons.. Our leaders and media do nothing but talk about unmeasurable concepts.. Crafting law after law based on opinions.. Things like hate crimes and environmental laws.. All weather is climate doom and equality really means equity..

    Social responsibility are rules and rules in the hands of powerful people are laws, even if they are not in the books.. The FBI first regulated itself outside of the rule of law.. From that point its only natural that they would extend these modern regulations to the rest of us.. Its not just the FBI its everywhere that matters.. As the old saying goes.. Who is watching the watchers.. The zealots..

    Reminds me of the Knights Templar.. A organization that forgot who they were and got erased for it…
