“The Supreme Court ruled on Monday night that the Trump administration could continue to deport Venezuelan migrants based on a wartime powers act for now, overturning a lower court that had put a temporary stop to the deportations. The decision marks a victory for the Trump administration, although the ruling is narrow and focused on the proper venue for the cases, rather than on the administration’s use of a centuries-old law to justify its decision to send planeloads of Venezuelans to El Salvador with little to no due process. The justices did not address the question of whether the Trump administration improperly categorized the Venezuelans as deportable under the Alien Enemies Act, finding the migrants had improperly challenged their deportations in Washington, D.C. The justices determined that the migrants should have raised challenges in Texas, where they were being held.”

My understanding of this is that plaintiffs can no longer judge shop in D.C for a temporary restraining order that the district court judge then applies nationally. The plaintiff must apply for a writ of habeus corpus in the jurisdiction where held. If that’s Texas, find a judge in Texas. Not head to D.C. courts where the deck is well and truly packed and stacked. I’m sure that the Democrats will continue to push. I think this is Justice Roberts way of avoiding Congress impeaching a lot of these partisan clowns.
Congress doesn’t have the votes to impeach these judges.
I tend to agree with you about this but, Justice Roberts has a fixation on preserving the court system as it is. Given that, the process of impeachment is the punishment. It would drag the judge and possibly embarrass the entire Federal Court system. He knows these district judges are corrupt Trump haters. It’s why they were put in place in D.C.. The Left has long used the courts to overturn laws they didn’t like. This threat of impeachment may be enough to force Roberts hand to quash these out of control wanna be presidents and tyrants.
They don’t need to ….but they are about to change the rules. As they should.
What about the due process argument? My impression about the beauty of what Trump and Homan are doing is the speed at which they are grabbing illegals and deporting them (immediately), but it seems like this decision reiterates that they need to be brought before a judge and given a hearing. That’s fine, as long as they are incarcerated and it happens immediately and not in 10 years.
I have not red the Act in question but it essentially gives the president, Commander in Chief, the power to deport
on an emergency basis without any interference or review by the courts. President Eisenhower in the 1950’s deported some three million illegals because they were working jobs that could be done by Americans at better wages. Not just farm labor either. Essentially, being here illegally is properly reason enough to toss you out.
Essentially, being here illegally is properly reason enough to toss you out.
Why wouldn’t it be? Why shouldn’t it be? Without that power we aren’t a nation and there’s no such thing as borders … which leads to the next thing … no private property. Squatters rights … which will come down to weapons and killings to establish the final rights
All these people complaining about the poor ILLEGALS are treated badly………THEY ARE ILLEGALS……..that is the main point, GET THEM THE HELL OUT OF OUR COUNTRIES
It was my understanding that many of, if not most of these fools that Trump is ‘drop-shipping’ to El Salvador were not only in the US illegally, but had either had their ‘due process’, and were found ineligible for asylum, committed some sort of crime while in the US, or failed to appear at their promised asylum/deportation hearings. They need to go.. and it should be brutally apparent to everybody watching that Trump is in no mood to suffer these fools, and that the best time for them to have planned their ‘exit strategy’ was ~4 months ago.. the next best time is.. yesterday..
You are correct.
And due process, as stated in the 14th Amendment, does apply to everyone. That is one of the reasons why this SCOTUS ruling and final vote went the way it did — the people deported had already had their due process and the left was trying to retry using that amendment but outside of the true jurisdiction (judge shopping).
So a needle had to be threaded; SCOTUS cannot be seen to be disregarding the Constitution, especially an amendment that refers back to the Bill of Rights while at the same time knocking down an attempt to tinker with our legal structure for political reasons — what the left (and certain segments of the right) were trying to do with this challenge to the, quite legal, deportations ongoing.
They also need to be brought before a judge in the proper jurisdiction, no judge farming.
They have no right to due process. Get some oxygen.
Meanwhile, Amy Barrett again votes in the minority.
What a mistake she was, she votes with Dee wining, not with the GOP judges.
she was Trump’s biggest mistake, perhaps she finessed him
Well, I hate to say it, but… (no, actually I don’t hate it at all)
I had a bad feeling about ACB, because I had read some stuff at the time of her nomination that Trump obviously didn’t want us to know.
But I had faith in Trump that he knew what he was doing when he nominated her.
Now, I’m not so sure.
I know I supported Trump throughout the nomination process, and I still believe he was the better option than his opponent in the general, but my goodness, the chinks in his armor are getting to numerous to ignore.
ACB is just your typical leftwing RINA-bortion Catholic creep. Yeah, she gave abortion back to the States but now she is aborting and dismembering the US Constitution. Bad choice.
*little* (or no) due process.
well there ya have it, dont keep them in suspense eh? also sends a message to the wannabes, MAYBE HANG ON TO THE MONEY THE TRAFFlCKER QUOTED IT MAY NOT WORK OUT AS IT DID WITH SOME DEMENTIA BIDEN SOMETHING
Due process:
Are you a citizen?
Do you have a visa or green card?
No to both questions? Well, off you go then.
So it’s impossible for ICE to make a mistake and deport someone who is legally entitled to be in the US?
ICE will never abuse power. Trust them. In Government We Trust.
Funny how government overreach and absence of due process was a massive issue for conservatives during Covid but when the issue became immigration, that’s met with aggressive indifference.
If you are not a citizen, and/or did things to avoid becoming a legal citizen, then you have no right to due process. Due process is for legal citizens, or those making the effort to become one.
Only exception to get due process would be to visitors legally allowed to temporarily enter the country.
I reiterate: do you think that ICE is incapable of making mistakes which could result in some who is legally in America getting deported? Or do you think that is just acceptable collateral damage?
“I reiterate: do you think that ICE is incapable of making mistakes which could result in some who is legally in America getting deported? ”
If that ever did happen, it would obviously be the deportee at fault, not ICE. Government ID and immigration records would easily prove his/her immigration status. Don’t have any ID? No record of a Green Card or Visa or any other proof that you are allowed to be here? TOO BAD for you.
Then how did ICE mistakenly deport Kilmar Garcia? Was the administrative error that ICE admitted to somehow his fault?
So what is old is new again?
Cheech & Chong; “Born in East LA”.
So some USA citizens are going to get deported,accidentally..
Sure beats being Murdered by Drone Strike, without a trial..
Which would you prefer?
Government will always screw up,its what they do best.
The first FU gets a holiday in South America, with some “very interesting people”.
And the chance to sue.
The other FU leaves you very dead.
Democrats are just fine with option 2.
